  1. Other petitions (son petitioning for their mother) processed through the INS are given a 10 year green card. Why?? Because the relationship from mother to son does not change after two years.

    What is the point of giving two year temporary green cards?. if that person can file on her own if she wants to after two years?

    You are given a 10 year card if you are still together with the US citizen, if you still want to still to help that person to stay in the US out of the goodness of your heart, I guess that's your call. As someone said:

    This proves the inadequacy and ridiculous nature of the system (like we need any more proof of that), and the fact that people should feel free to work around it if they so desire.

  2. I dont think that you can file for the permanent green card wiithout your husband. That is the whole point of first giving a temporary green card as opposed to what other individuals doing other kinds of petitions (son petitioning for their mother, etc) get. Immigration wants to make sure that you people still together, otherwise there would be a lot of fraud. Unless you are a victim of domestic violence, (husband convicted by a court of domestic violence) (you did not say you were) you can not file for permament green card. Immigration does not care whether you are pregnant, they dont care if deportation will result in extreme hardship, daily they deport people that have children (born in the USA) I know of a person about to get deported, she has a five year old and a three year old. I guess you can get a lawyer and make your case, Good Luck

  3. I am sorry to hear your story, I dont know anything but for what you wrote, I think that the chances of you and you wife getting together are very very slim. You said that she is very happy and that she has no desire for the two of you to get back together. If I were you I would do eveything that I could to send her back to where she came from.

    You are good man and try to do eveything to help her but dont try to get her, a permanent green card if the two are not together, write to the immigration department and tell them the truth that you dont live together, that things did not work out and you want your wife to be sent back to Venezuela.

    A person filing for permanent green card can only continue with the process without the husband of she can prove that her husband is an abusive partner and you are not, right? The only help that I would provide to her would be to help her pack.

    I am sorry to sound harsh, I wish you the best of luck and I hope that you find somebody that you love and that also loves you. It is out there somewhere.

  4. In the list of items that we need to bring to he interview:

    A completed medical examination (Form 1-693)

    A completed Affidavit of support (form 1-864)

    I submitted both of these items when I filed for the AOS early in the year.

    I DONT HAVE TO BRING ANY OF THESE DOCUMENTS TO THE INTERVIEW IF I ALREADY SUBMITTED THEM, IS THIS CORRECT?

    Or do I have to complete a new affidavit of support with all updated supporting documentation (recent pay stubs, etc)

    It seems to me that there are very a few documents that we need to take to the interview (We are both single, never had children): Birth certificates, Notice of action forms, I94 form, "proof of relationship".

    Is there anything that I am missing

We applied back in January, the effective date (or whatever is called) is February 09th, she had her biometrics appointment on April 11th, about a month later we receiver her emplyment authorization card. We haven't heard anything since. In june I called to notify them of our new address, we received a letter about ten days later stating that they had changed our address. We are still waiting for the interview date...

  6. It has already been six months since we filed for the adjustment of status and still nothing. Up to this point I have been very patient and I have not even tried to inquire why it is taking so long as I knew they were going going to tell me that "it has not been six months yet". Well, now it has been six months.

    Are cases taking this long?

    What should I do now?

    Should I schedule an infopass appointment?

    When I called the 1800 number that is on the notice of action, the clueless rep could not even tell me where my paperwork was: Missouri, Texas..?

    any advise?

  7. My wife and I are waiting for our appointment for our AOS interview. My wife came in December, we got married in January, had her biometrics appointment in April and are currently waiting for our appointment for our interview. I was hoping that we had our interview before we moved to a new apartment, but it doesn't look like that is going to happen so now we have to submit the change of address form. I have two questions regarding filling out this form.

    1. I am in the United States as a...None of the choices apply (visitor, permanent resident, student) do I have to choose "other" and then explain that she came on a fiance visa (which expired three months).

    2. If not a permanent resident, my stay in the U.S expires... Fiance Visa expired back in March. Do I write that?
