  1. My Fiancés visa was approved 6/18/2012. Considering she was 34 weeks pregnant w/my child she immediately flew to the US arriving on 6/21. Due to her pregnancy, we wed the very next day (6/22) so that I may add her onto my medical benfits plan. On 8/3/2012 our daughter was born. All our focus and attention has been centered around our new born for the past month. With that being said, we completely forgot about my wifes visa which expires on 9/18/2012. I read online that we need to file for an adjustment of status that costs >$1K. Considering expenses related to having a new born, we just don't have that money right now.

    Question: Do we need to file for adjustment of status before her visa expires? And is there anyway to notify immigration that my wife and I are already married without filing for the adjustment of status?

    Thoughts or guidance in this regard will be greatly appreciated! Thank You.

    Thank you for the advice. I did send email inquiries to nvcinquiry@state.gov and nvcreasearch@state.gov on 4/11 but have not received a response.

    Looks like we'll just have to buckle down and prepare for our baby's birth in the Philippines.

    Isn't there anyone that we can contact to help expedite this process considering that we are now beyond 30-days of the approved petition date?

  3. Brief Summary of Finance Visa Filing:

    10/22/11 - Mailed Complete I-129F form and all related documents

    10/26/11 - Received NOA1 confirming receipt.

    03/20/12 - Received NOA2 (I-797) - APPROVED

    As of 4/18/12 the NVC has confirmed that they have not received the petition filing from the USCIS. An inquiry was sent on 4/11/12 to nvcresearch@state.gov along with a scanned copy of I-797 form. Email response from the NVC on 4/16/12 stating approved petition has not been received and an inquiry will be sent to the USCIS on my behalf but I have not received a response to date. I've heard from friends who went through this process that once the NVC issues a case record number, the consulate in Manila, Phillipines moves fast. My biggest concern is that my finance is pregnant with my child and the doctors may not allow her to fly beyond mid-June 2012. What are the chances that this entire process including consulate interview and issuance of the finance visa will be completed by June?

    Additionally, I'm looking for guidance in the event that the petition process is delayed further. Considering my child may be born in the Philippines what steps should I take to obtain either a passport or visa for my child so that mother(fiance) and baby can fly together?
