The case was closed by USCIS in March 2013, the embassy in Cairo is the one who didn't closed it there, I sent an email to the embassy to let them know that the Petition for Visa Fiance or K1 was closed since 2013, my husband's interview for the new petition (I-130 Petition for Alien Relative) was on September 23 this year, that was when the Consular Officer told my husband that they have two open cases in his name at the embassy, well, after that I received 2 emails from the embassy, they told me the consular officer was reviewing the case, I sent another email to the embassy yesterday, they emailed me today telling me that they sent the case back to USCIS for revision, and re adjudication. I just called USCIS, and they told me to wait a few days because they didn't get it yet.

    I am kind of sad, nervous, not knowing what's going to happen next, how long is going to take for this to finish, I am just praying to God to help us. We have hope!

Long ago my husband in Egypt had the interview for a visa fiance, the consular office was so rude to him during this interview, she told him she will not give him the visa, and that she will send our case back to USCIS, he was so sad and confused that he asked her what we're supposed to do next, she told him: tell your fiance to come to Egypt to marry you here, we assumed we will never get that visa approved, so that's what I did, I went to Egypt in 2012 and we got married in Cairo.

    I cam back to US and two months after that I received an email from immigration telling me that our case was approved, but of course we were already married so that visa was not good, I called the Department of State in February 2013 and I told the lady about what was going on, she told me they will close the case, then I received an email telling me that the case was already closed.

    I applied for the CR1 ,and today my husband had his interview, the consular officer told him that they have two cases in his name, and both were approved, in that case he will have to send our case back to immigration here, and he gave to my husband a paper, I don't know yet what kind of paper is because my husband will have to scan the paper and send it to me to my email today, the CO told my husband I have to call immigration here, and they will let me know what they need from me. My question...what else they need from me?

    And of course my husband paid for the DHL, and the CO told him not to worry about that money because he will have to go back to the embassy, and they will not charge him again for the DHL service.

    I will appreciate if somebody knows what in the world this people are trying to do, what they will need from me, because I really don't understand what happened today in my husband's interview.

  3. Hi there! I am using my friend's account here to ask a question about affidavit of support form I-864, I am the petitioner of my husband, and I am using a joint sponsor, I sent to the NVC an I-864 in my name, and another one in the joint sponsor's name, the NVC is telling me that they need evidence that I have the money I said I have, I asked the NVC representative if I have to send a letter from the bank, I was thinking I sent it already, anyway, then he told me that I have to check on Part 6 13a.1 joint sponsor's affidavit, because he says it has an error there, that question is nothing else than total income of the tax year 2013 (the most recent) where is the error?

    The representative told me that I will need to send the joint sponsor's affidavit of support with the corrected error to my husband, plus I have to send evidence of the money I said I have in my bank account, because then they will send an email with the interview appointment date, and my husband will need all this documents that day.

    I wonder how I will fill out this affidavit in the right way according to the NVC?, is there any agency that I can call to help me with this? I need help! I will appreciate any response. Thanks!

  4. in our petition K1 I didn't called him husband, it is a petiiton for fiance, in my heart, in my mind he is my husband, that's not a reason to deny a visa, But I will go, I will marry him, and we will do whatever we have to do to be together, because at the end that's all we want, we want to live a normal life, as a husband and wife, Egypt is a nice country, but we think, is better for us if we live here in US, I don't see a future in Egypt, so we will do whatever we can do, and God will help us, we trust to God, and this is just an experience, a bad experience, but we learned.

    i'm just assuming. but maybe her calling her fiance "HUSBAND" that cost them K1 denied?? :blink:

    esp. if they read ALL their communication logs.

    anyways for OP i'm so sorry dear.....but marrying him is not the answer...you need to do something about this. perhaps hiring your own lawyer...

I was not working in that time, that's why I was not able to go back just for a visit, but then I started to work, and I saved all my money, I am divorced, no kids, I am almost 39, he is 51 yrs. old, you can see our pictures here in my profile, they have so many conversations from Skype, I printed all and I sent it, phone calls...more than a 1000 dollars in phone cards, and from Skype too, everything you can imagine emails, pictures, conversations, phone calls, my divorce certificate, affidavit of support approved, but she was so mean at the interview, I just don't know why, not even my "fiance" knows why she was acting like that, about our religion, she didn't asked anything about it, he is Muslim, I am Muslim too, but I didn't converted in a mosque, I did it myself repeating the Shahada, nobody knows that, just God, my "fiance", and now you guys.

    There's a red flag right here: "she asked why I was there just for a week" That means you had a short stay for your first visit. Just meeting in person for 5 days and then filing for a fiance visa is most likely a red flag to a Consulate Officer.

    Do you have an age difference?

    Did you meet his family?

    Have you been married before? Have kids?

    Your religion?

  6. That's what I will do, I will go for 2 or 3 months and we will get marry there , but I don't know if I can file the I-130 from there, or if I have to come back to US and file from here.

    Go to Marry him and stay with him as long as possible.I stayed with my husband 2 months before we married of course at his parents home.Since that time I been to Egypt a total of 1 year before our 2nd anniversary.Shortest visit 2 months.If anything go live with him there and file from Egypt.If this didn't work out that's exactly what I was going to do.Maybe the short visit had something to do with why they denied you.I'm so sorry for that I know how you must feel :( I'm no expert in this situation GOOD LUCK with what ever route you 2 decide to do (F)

  7. Thanks so much Kim, that's right, he is my fiance, in my heart he is my husband, my future husband, thanks for your help.

    She meant to write Fiance, her wording isn't exactly right during her time of sadness. To any of you who have gone through this will you please tell her what's the best she and her fiance can do from this point. She realizes that she will have to go to Egypt to Marry her fiance, stay for a while and then return home to file the I-130.

    CR-1 folks can probably answer most her questions best...Thanks

    But at this point what we can do?, we have to keep trying, we love each other so much, this is a really sad day for both of us, and what bothers me is the way they are treating people at the interview, is not fair, there is not need for that kind of attitude towards people.

    You can get married but that does not necessarily mean that your next petition will be approved. What are your red flags?

The lady who interviewed my husband was the one who said: call her and tell her to come to marry you here in Egypt, he told me she didn't asked too many questions, she asked why I was there just for a week, and he explained to her because of the situation of the country, I went there in January 2011, 5 days after I came back to US, they had the revolution at Tahrir, and when he said that to her, she kept asking stupid questions like: how did you knew they will have a protest there?, are you like a CIA agent?

    I am so sorry to hear this for you two.

    Did the CO tell him why u were denied? Reason why I ask is marriage doesn't always answer the issue if there were problems.

    Once u two can really sit down and discuss the whole interview questions asked how he answers. Do u have red flags. How many times u visited for how long.

    And what if anything did the CO write on the denial form.

    Once u get all that then u will know what to do next. Maybe after talking to him u can request a 2nd interview maybe u can go their talk to CO. Do not give up fight. Fight for love k.

Hello!, I don't feel like writing today, my husband in Egypt was denied today at his interview at Cairo's embassy, it is a sad day for both of us, the lady who interviewed my husband today after denying the visa, my husband was concerned, so he asked her: what we can do now?, and she, in a mockery tone, answered: Call her, and tell her to come to marry you here.

    I went online, to Cairo´s embassy website, and I found this information there, I just want to make sure if that all we have to do to get marry in Egypt, if somebody here had the same experience, I will appreciate any help, whatever information you can share with me, I will really appreciate it

    Thanks Danneh!, in my case, my fiancé (the beneficiary) he live in Egypt, he was living in Australia for 4 years, we are in the K1 process now, he needs the police record from the time he was living in that country, I found the AFP form on the internet, I´m a little bit confuse because I don´t know what code number we have to choose, the 33 or the 35, the 33 is for Immigration/Citizenship, the 35 for Overseas Employment/Visas, and what about the fingerprints check?, I don´t know if he need that too, in the packet 3 you will not find the word fingerprints, if you read the AFP form , and if you choose code number 33 it says...Please note that fingerprints are not required by the Department of Immigration and Citizenship (DIAC) unless you are otherwise advised by them, and if you choose code number 35 Overseas Employment/Visas, that option does not says a word about anything.

  13. Do I have to file form I-824?, in NOA2 says: The Petitioner can also file Form I-824 to request that we notify to ANOTHER consulate of the petition approval for visa processing purposes. What this mean?, if I don't file this form they will not notify to the consulate in Cairo about the approval of this petition?, this is making me crazy, because at the beginning of NOA2 says...The above petition has been approved, AND FORWARDED TO THE LISTED CONSULATE....so do I have to file I-824 anyways?

    Thanks to true_loves_journey this is the answer to my own question....With the K-1 visa there's no I-824 needed.

  16. The I-134 should be mailed to your fiance. " If " you were married before ( divorced ) your fiance will need a certified copy of the divorce degree at the interview. When I mailed my documents to Egypt it took 10 days to get there. Good Luck :)

Yes it will be sent to your fiance in Egypt not to you. you ll need to send him an original employer letter from wherever u work states when u started work with them and states annual salary, last 3 years of IRS tax return forms and last 3 years of W2 forms. and any other financial documents u stated on I-134.and letter of intent with new date that's not a necessity but its better for him to have that and he will send these documents off to them when he get the packet 3. of course u ll send these stuff to him via Express Mail like DHL or FedEx never via normal US post because he ll never receive them if u send them via normal mail. Good luck

    My fiance is waiting for the packet 3, the NVC is still processing this petition, the petition was approved by USCIS, they sent the info to the NVC, the NVC sent me an email telling me the case number, and they said this case is still in process, my question is...do I have to send the affidavit of support (form I'134) to my fiance now, or do I have to send that form to USCIS for them to be approved?

    Thank you very much for the info, I was thinking in using UPS or FEDEX because last year I sent him a simple letter using the regular mail, and he got the letter after 2 months, the letter was all dirty, so definitely I will use FEDEX or UPS, thanks again!

  19. Thank you all for the comments and advice. What forms/paperwork can I go ahead and get started on before the petition gets to the Consulate?? Also, does anyone know if I will be needing to provide any information to the NVC once they receive the petition? I have read in certain places that they require some things from the "petitioner" before forwarding the application to the Embassy. Is this true or False??

    Egon645 if you are the petitioner you will find what you need if you read the instructions of form I-134 (affidavit of support), a letter from your bank showing how many deposits, how much money you have in your account, you will need an employment letter showing the date when you started to work , if your job is temporary or permanent, last year tax return is another thing you will need, and the affidavit of support, if you are applying for a K1 visa the form is the I-134. about your question....I don't think that's true.

  20. the consulate will send what is called packet 3 to your address with all forms that u need to fill in for them and other documents u need to send for them and also where u should do the medical examination. forget about calling them send them an email thats better and they ll reply and tell u whats going on.

    In this case I am the petitioner, the consulate will send the packet 3 to my fiance in Egypt, right?, but me (as a petiotioner) what I have to do now?, the form I-134, letter of the bank, income tax return, etc, what I have to do with all those papers?, do I have to send it to my fiance in Egypt?
