  1. I received the Biometrics appt scheduled at August 5 and I will leave on August 4. So it falls into my travel window. What do you mean about not to close to my biometric appt? If I do walking in next Friday (July 25th) to the same office I am assigned, is that ok?

    Depends on your local ASC, but it is within 2 weeks. Walking-In doesn't hurt so try it. But make sure your departure is not to close to the your biometric, because if FBI won't accept your fingerprint result, you will have to take biometric again.

  2. Hi, I sent my I-751 package on July 3 and NOA1 dated on July 7. But I will have a business trip to other country from Aug 4-Aug 13. Base on the other people's experience, I will have a big chance to receive the bio apportionment during the travel period. Does the bio appt letter come in about 2 weeks after NOA date? I am not sure which way to go if the appt fall into the travel period. Rescheduling the appointment or early walking in? Any ideas? Thanks.

    2) You are going to have to interview where you live. You can't transfer to VA unless you change your address to VA. And it will definite delay your interview. By the way, why were you living apart from him? Do you have a good explanation for the interview?

    Changing the address was my original plan before I received this notice, Because I expected to receive the notice on August. I don't want to delay the process, can I just go the NJ to take the interview or changing address is mandatory upon moving? We went to the same school in NJ. Right now he is working in VA, and I am finishing school and want to move together.

  4. I just received the AOS interview notice today. I have two questions about the this interview.

    First, it states the items needed, one of them "Your petitioner's Birth Certificate and your petitioner's evidence of United States Citizenship or Lawful Permanent Resident Status". He was born in US, Birth Certificate will be enough to prove citizenship?

    Second, the interview was scheduled on July 30 in NJ (where I am living). But I am going to move to my husband's place this week and he is living VA. Can we contact USCIS to take interview in VA? I aware the notice" Please be advised that rescheduling will delay processing of application/petition, and may require some steps to be repeated." So I am not sure that would be a good idea? Opinions or suggestions?

  5. You only fill it out if you need to use your accounts for assets to meet the 125% above poverty rule.

    If your sponsor's income is sufficient, you do not need to use any kind of assets. Put N/A on line 7 and fill the blanks with zeros. You are not lying, you are not using that information. You are only filling in blanks. I did this on my I-864 and it was approved with no problem.

    Thank you for the response, do you mean I wrote with a pen N/A at side of Part 7 ? Becuase I can not input N/A with computer, they all change to 0.00.

  6. I am doing double check of the I-130 with I-485 package. I read abou the NO BLANK suggestion for the application forms. In I-864, my husband (petitioner) has enough income to support me, can I leave the 'Part 7 Use of assets to supplentment income' as blank or put N/A?

    Another question: he was a graduate student from Aug 2008 to May 2010 and started to work on Dec 2010. He includes only his 2011 tax return and employment letter to I-864. He got tax exempted fellowship during 2008-2010 (above the 125% poverty line), so he didn't file tax return from school employer among Aug 2008-May 2010. The school didn't send out any exemption letter but W2s which stated his fellowship amount, and then W2Cs which adjusted those income to zero. He wrote a explanation letter includes the fellowship offer letter, W2s and W2Cs of 2009,2010. Would be this enough? Thanks

  7. It will be a red flag, but it's not something that cannot be overcome. Be prepared to show ample and strong proof of bonafide marriage and relationship preferably spanning all the way to 2009, save your tickets from when you go and see each other, and if there is any way to show proof of you planning to relocate to VA once you have graduated, include that. Maybe even send a few big packages of your stuff there now, and obtain proof of that. Livign apart because of school and/or work is pretty common. Still, it is considered to be a red flag if a couple who is married has never lived together. Dot your Is and cross your Ts.

    We have shared health,car insurance card, and shared car ownership. i will send a few pics too. About those travel receipts and other memory support, can I just show during the interview? At least i will give a chance to meet the immigration office, right?

  8. I am doing the paper for myself and petitioning through my husband. I am ready to send out the whole I-130 and I-485 package. But suddenly, a question pop out from my head.

    I have attended school in NJ since 2008, we met each other there and started to date at school early 2009. He's moved to VA to work at end of 2010 till now. We did all the commuting to see each other almost every weekend since then. I am still at school till this summer and move to his current VA address. We just got registered recently,and plan to have a wedding reception in this October. My question is we have never lived together. Will be a big red flag for my case?

  9. Well, you guys haven't moved there yet so don't do that. Provide the address of where your husband lives because if you write a new address & they might send documents onto that address, that will be problem. When you are moving to another state with your husband, then only send an email to NVC notifying them your NEW address. So, you get your documents that in future.

    Thats how I have done too, but I forgot to notify them & they sent on the old address... again to resend the letter, it took 3 months! :( Our case got slow.

    He has been lived there for one year. I am in different state than him because I am still at school, I will move to his current address after I graduate (after 3 months)

  10. I have a question about the information i should input on I-130 form. In qustion 18, it states "Address in the United States where your relative intends to live". the situation is I (beneficiary)am at US and living in a different state than my husband (petitioner). Because we knew each other at the same school, and then he graduated and worked in another state. I will graduate and move to him in 3 months. I don't know which address I should place here, his or my current one. I appreciate your help for this question.Thanks.
