    Anyone can apply for a visitor visa. Anyone. The applicant apply on his/her own. The applicant must demonstrate strong ties to their country that allows them to overcome the presumption of illegal immigration.

    Having a US citizen child does not help give the parents any special consideration for a visitor visa. In fact it can hurt since a US citizen child may help a parent illegally immigrate.

    You should read my great thoughts again... I was trying to make a point that if this member is a USC she/he should go through bringing their parents through their legal right and legal way . I didnt mean if they are citizen they can invite them, they can file a nonsens application and there is 90% chance that they will get refuse.     Really? My aunt didn't have to file at least 200 pages of documents to get her visitor visa. The amount of documentation will depend on the individual applying. Your aunt might be a lucky geeg ... they issue one or two visas just for their records but real game is they will make sure you are not breaking their rules by inviting someone and keep them here. They worked hard to make their country this way, its not that east to just buy a ticket and fly to USA, NO BABY!

    Really? His parents will be deported? So, no chance that IF their AOS was denied, they can't voluntarily leave?     It is illegal to use a non-immigrant visa to enter the US with the intent to adjust status to a green card holder. That's fraud because the individual is using a non-immigrant visa to immigrate.

  2. I live in USA and want to call my parents for visit visa.

    My question is:

    1- I want to know how long will it take to come in usa at visit visa?

    2- Can I apply for them for immigration after visit visa?

    If you are a US citizen, Yes. You can get your parents to come and visit you. Waiting time is a game of luck. Standard rules dectates a visa process should be completed within 180 days, if proper documents are submitted.

    That's where the movie starts. If you give them what they need, they might be granted 3 or if you are lucky 6 months visa.

    NO! You can not apply for an immigrant visa for them from US. If they suspect you have this plan you might lose the chance to get them here very soon however of you are a US citizen you have the right to bring them as a immigrants which is a 18 months process but if they come and you apply for them not that they will deport them the might but a ban for a few years on them so take precaution!

    Once they entered into their system there is no way in the work that for atleast 15 years to remove a bad record.. if you want them to come here and settle down go through proper channel ...pass the waiting game it will be safer and faster.

  3. Yes, they will hold on to your passport until the process is finished.

    This member either don't understand English or can't read. My sister applied from Australia to go to the US, it took a total of 11 months after her interview (visitor visa). Everyone should understand USA is the only nation in the world that has no obligation when it comes giving permission to come to their land. They follow or the person who has the papers has almost 90% control of a decision to "how long he/she) keep the file on their desks. They don't care who you are - how much patience you have or not. There are people that have the right to come here they delay them forget a visitor ...its like do I have to accept you as a temporary guest in my house or not? Who the ....... is a visitor to make them rush to grant a visa.

    I think this friend should go research more. If he/she is in rush to get the passport back why the world they summited it in the first place... they don't care someone need their passport, they don't even want it there it's just we the needeies go and give them. Why would I rush them... people get so excited when the US embassy asks them to leave their passports thinking there is a green light. Normally they never ask for passports because they don't want to be responsible.

    as i said it has just been 7 working days (easter holidays last week ate 4 days and now saturday sunday 2 more days added).

    Relax man... You are asking permission to come to USA not india. Administrative process can take up to 6 months if you keep bothering them by forcing your well they will simply send your passport back and Denied!

    Have some patient people here in USA have been waiting for their kids - wives and loved ones for years and years. Its not that easy to jump on a plane and come to USA.

  5. I don't have any personal experience with this matter, but I don't see any reason why in your situation you wouldn't be able to apply for an F-1 from Canada.

    Only Canadian citizen are allowed to apply F1 Visas from canada. Infact Canadian can apply within the US and get it authorized by us and canada border. So you have to return to your homeland and gi through proper channel.

    So you are in the US and are seeking change of status from B2 to F1? That information would be helpful in your opening post.

    No. I am not in usa. I am planning to go there for study.

  7. You apply for F-1 status at the border. All of this I-20 and SEVIS business is for F-1 student visas. The only difference is that you can apply at the border - you don't have to apply at the consulate as a Canadian citizen. You won't have a visa in your passport, but you will be under F-1 status and have a I-94 (authorized stay card) marked as such.

    As a Canadian citizen I can stay in USA for 180 days. I found a community college who are doing the process of I-20 for the students so this mean If I go there submit the necessary documents meaning funds - ties to Canada and get the I-20, can I simply walk to the border with those papers and get F-1 stamped . Do I still have to cross back the border and go from Canada side, it does not make sense I think from either side, right?

  8. Hi – I was researching to go to usa for a 2 years study. I am 24 years old from Quebec. I am hearing too many stories and reading different options ok I will make it easy. On usa embassy website it says -

    Canadian Citizens do not need visas to study in the U.S. You do need to obtain an I-20 (or DS-2019) Certificate of Eligibility from the university that you plan to attend. At the time you receive the I-20 (or DS-2019) you will be registered with SEVIS, the student tracking system. You will be assigned a SEVIS number, and be required to pay a registration fee (see below).

    When you cross the border to study you will need to provide the Officer at the port of entry:

    • Proof of identity and citizenship (a Canadian passport for example)

    • The original I-20 (or DS-2019) certificate

    • Proof that you have paid your SEVIS fee

    • Proof that you have the funds to pay for the school that you plan to attend

    • Proof of your ties to Canada

    Now a friend of mine was saying I have to apply for F1 visa who is right. Help and thank you
