Hi, my green card will be expired on 19th Nov 2015 and I will be submitting my paperwork to USCIS for processing my paperwork on 17th Aug 2015 which will be 90 days before my expiry date of removal conditional of permanent resident. The question is " Can I still travel overseas after my submission of my paper work to USCIS because my green card expiry date was on 19th Nov 2015?" My husband and I planning to take our kids to go for a week on a cruise overseas trip to Mexico this year and we have not decided on which month yet due to my husband working schedule as he is worked offshore.

  2. Hi, I'm from Singapore and i got married in USA after entering into US with my K1 visa. My green card will be expired in mid Nov this year. I'm currently getting ready to gather some of my paperwork for submission before 90 days which mean i need to submit around mid Aug. I need advise on submission of affidavits sworn to or affirmed by at least 2 people who have know both of us since my conditional residence was granted for evidence of the relationship. Is there any sample or format letter on this that i can follow?

  3. Hi, I will be submitting for my application for petition to remove conditional on my permanent residence in State in few month time. I need some advise on where i can find a sample or is there any form for Affidavits Sworn or Affirmed? I read on USCIS website and they require this when we do the submission to our petition but i couldn't find any sample or form for it.

  4. Thank for the reply. Her passport does not contain the "First, Middle, Last" name format. It just show her full name. When we were filling the petition, we were confused as to which to put as the last name.

    Regarding Name Change in K1 Fiance(e) Visa Adjustment of Status (Green Card)

    When i applied for my K1 fiance visa I-129F, i was using my legel name which show in my birth certificate for all my paperwork.

    I had my K1 fiance(e) visa interview in Singapore US Embassy on 6th Feb 2013 and i had my approved visa on 20th Feb. I entered into US with my approved K1 Fiance(e) visa on 26th Feb. Just last month, i get married to my fiance whom is a US citizen. We went to apply for my social security on 20th March but i have not gotten my social security yet. But when i apply for my social security card, the stuff put my first name follow by my husband last name. I called up social security and the lady told me that my application is still waiting for federal dept verification on my approved visa before they can proceed to process my social security card.

    I'm currently preparing and filling up my I-485 Application to Register Permanent residence or Adjust Status, G-325A Biographic Information, I-864 Affifavit of Support to submit to USCIS. But i'm not sure how am i suppose to fill up my last name in these application. Am i suppose to apply these application by using my legal birth certificate last name or am i suppose to use my first name followed by my husband last name? When i submit my social security application with my passport and marriage certificate, she help me to apply by using my first name followed by my husband last name.

    Is there anyone over here facing the same issue and is there anyone over here can give me some advise on this? Will it affect my passport if i had my new married last name in it because my passport show my name as in my birth certificate? Will it affect immigration issue if i travel back to Singapore for vacation after taking my green card and my green card using my new married last name and my Singapore passport show my birth certificate name?

  5. As said by Jay-Kay, if you want to use your husband's last name as your new last name, you HAVE TO write it on the AOS form. They will certainly not reject your application because of that. Some marriage certificate don't reflect the new name change, but the marriage certificate in itself is a valid proof of last name change.

    About the SS issue, they may not be able to locate you on their system because your new last name doesn't match the name on your visa (and on their system). Some other people had an issue with it. If you get a negative answer from the SSA, I would recommend to apply for a SS number again but with your maiden name (the one on your passport and visa). You will then be able to update your SS card when you'll receive your EAD card or green card (because they will have your new last name on it... so fill in the AOS and EAD form with your NEW last name!). What matters first is to get your SS number as once given, it will be the same one for your entire life. It doesn't matter if it's your maiden or married name on your SS card for now.

I was so worried that they will reject my application and if that happened i'm afraid it will affect everything because my I-90 is expiring in May and my visa will be expiring in July. I think i'm going to proceed to fill up my application by using my husband's last name instead of mine.

  6. Hi All,

    My wife and I just had our AOS interview today at 12:50pm. We arrived around 15 min early. Our IO officer was nice and asked my wife many questions from the I-485 to confirm the information. She also asked when was the first time we met and how we met. She asked us for original documents of our birth certificates and US citizenship papers, marriage certificate, then she asked for our joint documents. We submitted copies of bank statements, auto insurance cards, medical insurance cards, and our apartment lease. We also showed her our wedding and honeymoon trip photos.

    One question that got us off guard was why did we choose to be together in US instead of my wife's home country, Singapore.

    Bring original and copies of important documents and answer the questions honestly.

    In the end, the IO gave us a paper with "Further Review" checked and we were so nervous, disappointed, and worried.

    1 - 2 hours later, I checked my case status furiously and finally, the decision has been made: APPROVED!!!

    Until ROC in 21 months!!!

    Congrats!!! I'm currently filling up my I-485 for adjustment of status too. But I'm not sure how am i going to fill up on my last name portion. When your wife submit her I-485 application, does she submit with her legel last name stated in her birth certificate or submit by using her new married last name which is according to the husband's last name? Because i understand that after married, my last name should be changed according to my husband's last name but just not sure am i allowed to fill up my new last name in the application. Maybe you can advise me on this since you have gone thru this AOS and is finally approved.

  7. But how am i going to change my last name to my husband's last name because in our marriage certificate don't reflect my new married surname. Our marriage certificate reflect both our legel name according to our birth certificate. I wanted my green card to reflect my new married surname but not sure if i submit it according to my first name and follwed by my husband last name....will they reject my application. I called USCIS for advised on thise issued but the guy that i spoke to ask me to check with my agency instead. And we are filing it on our own and we are not going through any lawyer or agency.

  9. My fiance submitted our K1 visa application on March 6th 2012 to Dallas Texas. They sent us an email to inform us that our K1 visa application have re-routed to Vermont for processing. Cheque was cash so we guess is going good. We also recived I797 Notice of Action on March 20th and gave us a case number. We are thinking everything is going smoothly at this point though its still early in the process. We redone our K1 Visa application 3 or 4 times at home just to make sure it was all perfect before mailing it out. In fact, we used this website as our guideline on how to file and what are the document to send to USCIS.
