  1. A family friend (permanent resident) made a petition for her daughter (who was under 21 back then) to come to the USA in 1995. The I-130 was approved and an interview was scheduled.

    They didn't show up to the interview because they needed money to pay and didn't have it at the time. So she didn't come but they didn't receive anything saying it was disapproved.

    The last update they have on uscis's my case status says that the I-130 was approved in 1995 and for them to follow the steps on the papers (which was to go to the interview they didn't go to.

    Now the mother has money and wants to bring the daughter to the USA and wants to know if she can continue the case without starting over again because the daughter is now over 21. She needs to know if she can just schedule the same interview now after all these years. help?

  2. Hi there :) I got my interview appointment for next month and I have a few questions.

    Will I have to bring the forms (I-130, I-485 and all the others) to the interview?

    Also, I and my husband got married in March, I had arrived here in January. We are together everyday all the time (24 hours a day). We are waiting for our course to start in September, which we will go together to too but we don't really know what to bring as proof of relationship. We don't have an account together since none of us work or is making money at the moment. We met in person in January after we were dating online for 5 months (met in a online role playing game, same as World of Warcraft). We have a lot of skype conversations( really A LOT) even though we voice called each other a lot too, but there are no phone bills because all we used to talk before was skype and messenger. We have some pictures together since I came to the USA but not that many because he is shy to take pictures lol and our wedding was very simple (we are thinking of having a wedding party when we can afford it and invite my family from Europe). We have been to Disneyland, Las Vegas (twice), Seaworld, always with his parents and many other places together but there are not many photos. Everyone knows how in love we are and that we are literally together all the time.

    So I'm thinking of bringing screenshots of many skype conversations, all the pictures we have, registrations for the same school, 3 affidavits by his family. What else could we bring in our situation? Its ironic to think how in love we are and that we haven't been without each other for a minute and we don't have that much proof to bring lol I think the best proof we have is that we know everything about each other.

  4. To calculate current annual income as an hourly wage earner, follow this formula:

    wage per hour x hours per week x 52 weeks

    So, if your joint sponsor works 40 hours a week, then:

    $20.10/hour x 40 hours/week x 52 weeks = $41,808

    $41,808 would be what you would put.

    That would only work on the question asking about past year's income. The OP is asking about CURRENT annual income. There is of course no tax return done yet for 2012.

  5. I have paystubs showing how much money the joint sponsor has made since the beginning of the year and a letter from the employer stating how much she makes a hour. Should it say how much it makes a year or is it ok since in the pay stubs it shows how many hours she works? Is this enough to prove how much she makes a year?

    Also how can I prove that she left the business she had? it was a delivery business with a truck.

  6. Oh ok, then easy peasy! put that amount and send some paystubs.

    The business loss and why the adjusted income was only 10K last year will be explained by the 2011 transcript.

    The most important is that her current income meets the requirement.

    I would also include a few paystubs from last few years to show that they're all from the same company and she has held this steady job for a while.

    It wouldn't hurt to attach and explanation that she has now given up that business endeavor.

    I think this would make for a better case :)

    "You may include evidence supporting your claim about your expected income for the current year if you believe that submitting this evidence will help you establish ability tomaintain sufficient income. You are not required to submit this evidence, however, unless specifically instructed to doso by a Government official. For example, you may includea recent letter from your employer, showing your employer's address and telephone number, and indicating your annualsalary. You may also provide pay stub(s) showing your income for the previous six months."

  7. On form I-864 on line 24 - annual income, i should put the gross income she makes a year, right? thats 43 000

    But on the tax transcript it says that her total gross income is 10 000 because it says on business loss - 33000 ( we dont know why) so the total was 10 000.

    So on line 25 federal income tax return information for the last year - 2011 i should write 10.000 right? but thats not enough for a household of 5. She makes enough but i cant put enough on that part of the form. What can we do?

  8. The joint sponsor makes 43000 a year, more than enough for a household of 6. But she fills IRS together with her husband, so the transcripts come in both people names, so her husband should fill a I-864A? He only receives money from the government, he is not working. Can or should he still fill?

    Also, on the Form 4506T to request tax transcript, on line 3 it says "Current name, Adress..." <---What is current name?
