  1. Hi Everyone

    I have posted for sometimes and hopefully I post the right place.

    As of today 5/21/2013, my wife informed me that two investigators came to her house, my wife was not home at the time. While they were waiting, they looked everywhere inside the house.

    Once my wife got home, they asked her to sit down and started to ask questions, all questions are the same they asked my wife at the interview in the Consulate office.

    I know that it is a good sign that they start up my my (CR1). Anyone that went through this process, please give me some advice.

    After the investigators met with your spouse, How long before they inform you that the visa issue or refuse? Appreciate your time.

  2. I will be traveling to HCMC and planning to visit the counselor. Is it any benifical to my case or harm my case? I hope to receive feedback from people have had experience regarding this topic. By my case in AP last 1/18/2011, CR1 and CR2. Thank you

  3. If your phone rings at 11 PM or so and you see a 202 # you will know who it is before you answer..:whistle: be ready to answer questions that MUST match her responses,,,

    You stated that they will call me around 11 PM or so. What kind of questions do they ask? my guess is that the questions have to be related my our wedding date, city, anything that relates to my wife. If you have experiences with these questions, please give me some sample questions. One more thing, I am working on 3rd shift, from 7 PM to 7 AM. Is is a problem if they can not get a hold of me?     Any word yet? The tipping point is when you get a phone call in the middle of teh night asking you questions, or if someone shows up at her work or her home asking questions... From then its usually only a month or two later before they give in... You should be hearing something in the next few months.. I know it seems like forever, but its likely bringing you two closer together than ever...:thumbs:

    At this point, My wife has not heard anything from consulate office or any one yet. My case has been in AP since January 18, 2012, it is very close to 6 months. I hope to hear something near future. We are pretty close, we talk every day. I will post if I receive news.

  5. I spoke with my friend earlier today, he informed me that he is going to meet with the lawyer and preparing to file a writ of madamus in the federal court. His case cr1 only has been in AP since January 2012, in Ho Chi Minh City. The lawyer fee will be $4000. It is a lot of money and besides his case in AP not that long. I told him that to be patient, soon or later your case will be completed. I also told him that the lawyer just wanted his money, does not matter with the outcome. I just hope that the case will be sucessfull. That is my opinion. What everyone think on this topic?

  6. Yes all they did was a reception (party with a few friends), no French government involved or anything. And that friend of mine didn't ask for any immigration (even if she asked, obviously he can't do anything.) My brother is well aware of the situation, he is not gonna to do anything until everything is settled down in the US. He said he would confess anything to my sis-in-law. I just ask for his situation, if my friend has a baby with him, and she will clearly put my brother's name down on the birth certificate, will he be able to claim the baby later? Assuming the baby birthday is when he is still married to my sis-in-law. Please understand, they didn't file anything with authority over there. The baby could be a result of an affair not a bigamy marriage, and she/he is innocent, adults commited mistakes not the baby. I know what he did is bad, but I believe deep down he didn't want to do that. If you all have something like this, you would understand and feel sorry for him.

    what you have written, assuming the your friend puts bady in his name, day of birth on certificate so on. The problem is your bother is still married and still has a bady with your friend. I think every one can see a clear picture what is happening and so the laws. It will caught up with him down the road. good luck.

    Congrats, i have been reading your post, you were under AP for long time. i hope after your wife submitting new doc, she will receive pink. this is really happy news. as i read your post, CO informed your wife in the blue slip saying that, your case required additional processing in our office. you do not need to submit further document. the reason they ask for medical exam again because it is expired or other issue. Thanks

    For those of you who contacted your senator or congress-person...how long did they take to get back to you? I contacted my senator (Kirsten Gillibrand - New York) about a month ago (03/19) and I am still waiting to hear back...I'm sure they are busy because it's a New York office and I'm sure the embassy also takes a while to respond to the inquiry...but I'm getting anxious...I talked to them over the phone a while ago and they had all of the info they needed...but how long should I expect to wait for a response? This whole process really tests your patience...

Hi everyone, as i said i need urgent advice it's bcoz that i am on AP Since 11 JUNE 2008 and it's about 4 years so now i came to realize that i need to go for MANDAMUS law suit as soon as possible,can anyone suggest or tell me if it's the right option for me or not.Actually till now i was unaware of mandamus and i thaught that this would be the usual or normal waiting time for visa or u can say that i was asleep.

    Interview date 11 june 2008.

    Spouse visa.

    every thing was fine in interview but i guess the region in which i live mattered for so long AP i.e Swat- Khyber pakhtonkhwa.

    but i think it's too much time so kindly guide me and also if someone know best immigration lawyer in Islamabad? or i shod process the case through US attorney?

The fact that they were already going to send it back IMO is the hurdle they have to get over... they will not respond any differently unless there is something that has changed.. they will send the same canned response... I wouldn't be surprised if they did to you guys what they did to seattlerain last week.. having his SO give them the email PW so they could check the correspondence... Age isn't a big deal and the length of time since divorces seems good.. the number of divorces could be an issue..

    Since you think number of divorces could be ann issue, there is/are ways to clearify this issue. Also you mentioned seatllerrain situation, his case is in the same boat as me. Thanks

  11. Its in AP and you should have your senator or congressman check the status for you but in the scheme of things it hasn't been in AP long... What do you think caused the AP? Red flags ? Recent divorce? Previous filing? Short relationship? Few visits? introduced by friend or relative? Most of the time there is little that can be done aside from wait.. extra docs will only help in some cases where docuemhtation may resolve an issue... it all depends on why they think something funny is going on...

    I am 58 yrs old petitioner usc and my wife (Vietnamese) is 47 yrs old, benificiary. I divorced 3 times, last time was 21 years ago. I married all us citizens women. I went to Vietnam 5 times. My wife she divorced her ex-husband 10 yrs ago. Do you see any red flags here?

    A few things could be red flags: common language. I speak english and do not speak vietnamese, my wife speaks english little. But we can communicate okey. Also her first interview with consulate, 11/2008, the case was sent back to US and intent to revolk, because the common language.

    secondly, OC might still believed that my wife and ex-husband in contact with each other. The truth is she has not seen in the divorce court. Anything that you might think of to clarify this issue? Also Can lawyer there have her ex-husband (behalfs himself) write an affidavit and sign it and submit to the consulate? Advice please

    lastly, it could be my age too, but i have seen people little older than me, they have no trouble at all.

    Regarding, senator. I went to her office, she mailed to the consulate, got the response back: saying that the consulate officer interviewed my on 12/15/2011. Submitted additional documents on 1/15/2012. The case was reviewed on 1/18/2012. However the case was required further review. Due to large number of applicants need to be reviewed, can not view out of sequence.

    My lawyer just got a response from consute 4/6/2012 again. It basecly said the same thing as first response. Please give me ideas what could red flags thanks.

  12. Embassy Delhi India sent me petition to USCIS to either re-affirm or revoke, GOT NOID (notice of intent to revoke) from USCIS.

    I have end of month to respond.

    I have all the quesiton answered, which was in NOID.... with supporting documents. It was mistake on our part not to submit all together... long story..

    Now, I am ready and gathering evidence and I have almost 6 inch thick papers that are arranged professionally and with reference to each other.

    I have response to NOID...... Document list with reference defined, checked, double checked.....

    1. Please advise for any thing..... PLEASE, I need your help.

    2. How long does USCIS take to look at the response to NOID? What am I going to expect now? Please explain in details.

    Thanks in advance for all the responses/comments/suggestions.

    I was waiting for 3 months before i received package from USCIS and resubmitted documents, wait other 2 months for approved. There is no matter how thick or large the documents, their must be answered correctly, what the OC is looking for on the slip. Good luck

  13. Since I was in AP at HCMC for quite some time, I submitted extra evidence one time. I would submit anything that could potentially address the issue they have. It will not be a quick fix, but it can help. It is said the additional docs can cause additional delay... How long have you been in AP? have they done the middle of the night phone call Q&A yet? any investigators come to the SO's house checking out the relationship?

    What did they ask for in the first blue slip?

    since then we received 2 emails from consulate said the same things. the beneficiary's file is pending review by a consulate officer. due to large number of cases to be reviewed and the need to be fair applicants, we do not review cases out of sequence except when there is an urgent need to do so. by us law and regulations.

    our office will nofify the benficiary by mail once the review is completed.

  15. The lawyer called me today, he told me that in order to contact us consulate office, you have included case number and passport number of the petitioner. Anyone has an update with this precedural.
