  1. I see. Thus far, i have gathered a rental agreement, 401k statement showing my wife as a beneficiary, car insurance with both of our names, roth ira statement showing my wife as a beneficiary, joint bank checking account statement, 2012 and 2013 tax returns, health and dental insurance with her as my dependant under the plan. I just wanted to be safe and provide the affidavits but I am guessing what I just listed is more than enough. I just want to make sure nothing goes wrong. Her conditional green card expires on 8/31/14 and just want to get get all this stuff done within the time frame without a hitch. Could someone tell me if everything I listed should be sufficient?

    One last question: Do i write the filing fee and biometric fee on one check instead of two separate checks?

  2. Thank you everybody for your advice and opinion. We are going to go to the LA office tomorrow morning and try and get the I-551 stamp. If that does not work, we have decided to take our risk with it. She is leaving for Korea tomorrow and it is kind of late to cancel the ticket. Furthermore, she will be gone for 2 months. If I was to Fedex her GC to her and it was to get lost or delayed, I believe we would still have time to get it replaced. Plus, we decided if it comes down to it, I am willing to take a vacation to go to Korea and give her the GC in person. I have been needing one anyways. Thank you everyone.

  3. First of all.. Congrats!

    You said your wife was going to Korea this Tues though. She will not have her green card by then. Technically the AP is no longer valid once the green card is approved. I do not know if CBP would let her back in with the AP without problems. I have read about cases where the green card is approved while the person is already out of the country and are allowed to use the AP to re-enter, but your wife got her approval before she is scheduled to leave. You may want to push back the date of the trip until she has her green card. It usually only takes 7-10 days to receive it instead of the 30. You could also make an infopass appointment to get a temporary stamp in her passport since she was approved and needs to travel. However, it is a holiday tomorrow and she is supposed to leave Tues. Again, you might want to push back her departure date by a week or 2 if possible.

    Couldn't I just mail her green card to her parent's place in Korea when I receive it here in America? Would that be an option?

  4. If her AOS is denied while she is out of the country, then no, she won't be allowed back in. The AP she has is based off of the I-485, and if the I-485 is denied, the AP and EAD are cancelled.

    If her AOS is denied while she is in Korea, what are her options of coming back in? I was told by the USCIS rep on the phone to call the US Consular in Korea? Any suggestions just in case of the worst scenario?

  5. My wife had her i-485 interview today at 8:45 AM on 8/31. We had everything prepared and the case rep told us that we had insufficient evidence so we had to go back and get more stuff and get it to her office by 2 PM.

    Initially, we brought our joint savings account, photos, my life insurance with her as the primary beneficiary, joint car insurance. The case rep said she needed more and requested us to bring our separate checking accounts for 6 months, more photos, and anything else. So we gathered more photos, my past 6 months checking account that I have had for 10+ years with my parent's address and my wife's checking account with our current address, our LA Fitness membership printouts with our current addresses. Any bills such as car payments, water and power, and etc with my name on it but paid out of my wife's account. Our case rep said that she would get an answer to us within a week.

    Our issue is my wife is scheduled to go to Korea next Tuesday, 9/4. She does have her advanced parole card so we want to know if she is ok to leave and go to Korea before a decision is made regarding her interview. Now, if she is out of the country and she has been denied, will she able to come back into the US? How likely is it she will approved? Our thought is she will be approved so she can leave next Tuesday and hopefully be approved while she is out of the US. Can anyone give us their opinions? Thank you.

    I was wondering if someone can help me. My wife has her I-485 interview this Friday, 8/31/12. One of the documents to bring is the birth certificate. Unfortunately, we sent in her original birth certificate with our initial application in the beginning. We have asked her mother to order another original copy of the birth certificate. We are able to have scanned copies of it to take to the interview but will not have originals. Will the interview person have our entire application file with them including the original birth certificate we sent in along with? Will the scanned copies be ok? We are very worried...hope someone can help us...

  7. Hello everyone! I wanted to know if someone can answer my question.

    My wife had received her dual employment and travel card in early July. She has been scheduled for her an interview on August 31st. If all goes well and she is approved at her interview, will she be able to travel to Korea after her interview without any problems? She is planning on traveling to Korea the first week of September. Thanks!

  8. My wife and I got married and we submitted our application for her to adjust her status. We had submitted all the required paperwork in April. Regarding her I-485, we had got a RFE letter saying they needed more documents so we submitted that in mid to late may. Last update of our I-485 was on June 4, saying they had received it. We still have not heard any updates yet....but we did receive my wife's new dual employment and travel card in the mail. Should we be worried?

    Also, my wife is planning on going to Korea to visit her family for a month or two, should she go? She does have her travel card but since no decision on her i-485 application, will there be problems if she did travel?

    I really appreciate anyone's comments and advice. Thank you.

  9. i sent mine to the first address by USPS like the instructions stated.. why didn't you? it explains clearly in the instructions, why make things more complicated then they are.. either way, good luck.

    Only reason why I did not was because it stated express mail...and i read that if i send USPS express mail to a PO Box Address and since mine would be delivered on a Saturday, it would not be received by anyone in person..Should I go back and get my mail?

    I have another question:

    The instructions state that for USPS deliveries, send to USCIS - PO BOX 805887 - Chicago, IL 60680-4120 and to send all express mail and courier deliveries to USCIS - Attn: FBAS - 131 South Dearborn - 3rd Floor - Chicago, IL 60603.

    I used USPS Express Mail and sent it to the second address. Is this going be ok? Please help. Thank you.

  11. If your current income is above the 125% poverty level, and you have a pay stubs and a letter from your employer to prove it, then there should be no problem. They want to know that you can currently support your household size. If you want to add on your assets, you can. I am not sure you need to though.

    Thank you. I have another question. I have not filed my 2011 taxes but have my 2010 taxes. Should I file my 2011 as soon as possible or will just providing my 2010 taxes be sufficient enough?

  12. I am a US Citizen with my new wife looking to adjust her status who needs help.

    On the form I-864, my current annual income is well above the poverty line. I have last 6 months paystubs and employment & salary verification letter as well. But on the section asking about my most recent and other tax returns, 2011 was just a little below the poverty line because I was unemployed. In this case, should I add assets in order to supplement my income or not? I am not sure what to do in this case. Please help.
