  1. Another note, print off emails etc that you may have exchanged, if you have phone records that might help too. Any pictures you may have taken during visits and flight stubs if you keep them all go to show your ongoing relationship. The fact that she is pregnant is neither here nor there at this moment. Far as immigration is concerned until they see the birth cert with both your names on it, it's irrelevant.

  2. Good Morning Everyone,

    I am new here so bare with me somewhat

    I came to the United States too visit my girlfriend for 2 months during my visit here we found out that my girlfriend is pregnant with my baby were extremely happy about this and on the spur of the moment 2 weeks ago we got married not what we really had in mind thought it would take alot longer but i guess we were excited and happy with what is happening I have some questions needless too say i now wish too stay with my wife and baby and i have been told that if i was too return to the UK it could take a long time to apply etc for the visa process and my girlfriends expectant in 8 months so i believe our option is AOS if i am right in thinking.....

    i have a number of questions....

    1) a lawyer as told us that i can stay here and apply for AOS status immediately and if its not back before 90 days is up i can still live with my wife while the process is going through but i must not depart the USA or i will be refused re-entry

    2) My wife lives in a housing scheme where shes not allowed a non-us citizen too live at the home unless there us citizen will the immigration service check too see who owns the house and contact them or will they just be interested that i live there and thats enough information for them

    3) I am assuming im not allowed too work at all if i stay here and apply for AOS

    4) We don't have no documents in our joint names at all because we only just got married the only thing we will have is my name on the birth certificate of our baby when she/he is born

    Any help would be so welcomed

    last thing i want too do is walk away from my wife and child they will need me here

    1. Your lawyer is right

    2. Immigration isn't interested in the local ins and outs of your housing scheme. They will want to see that you live there. It might be worth checking with your housing scheme if there are any proviso's regarding married couples. You don't want to find yourself evicted while your wife is pregnant.

    3. Your assumption is right, until you get your EAD (Employment Authorization Document) it is illegal for you to work in the US. So when you file, ensure you apply for it, it doesn't cost extra.

    4. Now that you have made the decision to be with your wife, between you, you can put together your package.

    • Your wife can add you to her bank account.
    • I'm assuming if she's in a housing scheme, she is on a low wage, does she have medical insurance? if so, she can put you on that.
    • You may choose to open a life insurance policy for both of you. God forbid anything should happen to either of you, but having a cushion for finances would be of great help.
    • You are able to get a temporary drivers licence as a visitor, it will last as long as your visa, once you are out of status you will have to wait for your Notification of Application (NOA) to show you are in the process of adjusting before they will renew it, then they will give you a licence for a year. That will show your address and act as ID and your wife can put you on her car insurance if she has any.

    These things take time to accumulate, so while you are doing your research into Adjustment of Status (AOS) you can be getting on with those. Do ensure you read up on the documents needed for each thing. If you do not have your birth certificate, you will need to get someone to send it to you. If you came to the US under the Visa Waiver program, make sure you have the number they gave you. The chances are you won't have an I-94, if you do, keep it safe!!!! you will need it.

I used to be a go-getter.Being out of status did not stop me from reaching certain goals a few years ago.Before I even graduated High school,I began taking class at the community college that I graduated from in 2008.I even started working towards my Bachelors while I was pregnant.I had to stop pursuing my goals not because I became a mom but because of a lack of resources.Without a greencard or legal status,there's no way someone could reach their fullest potential.I just got granted some "freedom" last December when I was granted temporary protected status( long story for those who dont already know) .I finally found a job at a retail store after 4 momths of getting my work permit and I already want to quit.I miss being home all day.I did go out though,dont get me wrong..But I miss being spoiled and taken care of by my husband and mother .I never worked a day in my life and im 25.Having to stay home for 4 years and take a break from pursuing my goal made me lazy ! i also didnt have enough contact with the outside world and feel uncomfortable being so out there.I love to talk to people and meet new people,but its overwhelming.I also feel like I didnt develop my personality and didnt grow much.I still feel like im in High school :wacko: Im doing things now I should have done as a teenager if I had my green card sooner in my life..things like applying for 1 st job,driving,etc.Should I quit my job and do what im used to ?? its a partime..working for 2 days and today is my second day.I miss being home with my baby ! I know I should grow up,but spending my whole life without a legal status and not being able to live freely has really stunt my growth.Put yourself in my shoes for a minute.I need advice.

    Yup, that's the sentence. If you can't handle 2 days a week, what's to say you are going to handle 5 days a week? If you think working with people who are happy and in control of their lives is hard, go into the health field and work with people who are scared and suspicious. Are you going to 'quit' every time you come up against something scary, disappointing, not what you're used to? And how is that going to look on a resume? quitting after 3 days! If you don't put it on your resume, which is employer is going to give you a challenging job without some background on you?

    I may sound harsh, but you need a dose of reality! Your husband has been looking after his family and in this economy, I'm pretty sure it's not been plain sailing. You have a support network... keep your job, make the best of it and look for something else in the mean time. This is the real world... the time has come for you to step up to the plate and start swinging, it may be uncomfortable but once you get your second wind, you'll be fine.

    I already have a SSN (long story) so all I had to do was have the information updated with my married name, address and employment authorization, but because I have the EAD I can go ahead and what needs doing. I got to SSO this morning, didn't bother yesterday as Mondays are always a pain with federal offices. 8.35 in, and 8.55 out! New card in the mail.

  6. Hey everyone ... On Friday May 11,2012.. I got 2 emails one states that Uscis mailed my ead card out and a second email states that USPS pick up my new card for delivery.... And just - few moments ago I got a tracking number and tracked my ead mail and it shows that it is in my local post office , out for delivery... Expected delivery is today May 14,2012... Yahhhh I'm happy I'm getting my card today... Definitely going too social security office tomorrow :-)

    Caramel, tell your friend to file I-130 and I-485 along with EAD and AP... He's already out of status... I'm no expert these guys seem to have all the knowledge, but I'm assuming there are certain visa's you can't adjust from, but in his case, he entered legally, went out of status... now he's adjusting from 'Out of Status' not a visa. I could be wrong... but that's my take on it.

I'm not able to file the I-485 because I'm under deportation proceedings, I can't file this until the judge cancels the deportation order, which he will most likely to do if the I-130 is approved before my master hearing in a month. I know why they took me into custody, like I said in the first msg I wasn't able to apply to adjust my status until my husband became a citizen which came through just after I was detained.

    This is where you fell down... Permanent residents CAN file for adjustment, it takes longer but you can do it. Once the citizenship is done you just send them a copy of the certificate with the existing application number and they update it.

    I agree with the person who said, get yourself a good lawyer!

  9. Hi all,

    A big day for us. We had a night at the beach (20 miles from the office) last night and woke up with a slight hangover. Got to the office 15 minutes early and weren't called for another 45 minutes. We did start to worry as literally everybody in there had a lawyer with them and we didn't!

    The interview was very pleasant and we had prepared a very extensive file (papers, photographs etc) and were able to answer all questions. She announced that she was recommending our case for approval. Just got home and had email confirming they have approved our application! Happy days! A big thanks to all here for the support and help in doing this!
