  1. My girlfriend and I have been students, and my girlfriend (the petitioner)has only started doing taxes last year. Before that she didn't make enough to file taxes. I (the beneficiary) have a joint sponsor, but my girlfriend also has to file I-864, so what should we write for question 25 where it asks if she has filed taxes for each of the three recent tax years. Leave it blank?

  2. I need some advise guys. I got married in October to a USC, arranged marriage deal, big wedding, parents came from India and stuff. I got my Green card at the end of January. Now we were having problems since the beginning of the marriage. I was supposed to go live in NYC after the wedding since they claimed she was graduating with her bachelors in education and was gonna get a job soon and we both will work together. Long story short turns out she hadn't been to college in 1.5 years and wasnt even half way to finishing up her degree and said she didnt wanna work.. So i told them I am moving back to Ohio because she wasn't going to work. She moved to Ohio with me in December. It was a rough start but we were trying to make it work. But it all went downhill since then. On Feb. 1 it was her birthday, took her out to dinner, bought her diamond earrings. At night i was getting a condom from the drawer and the wrapper felt funny so I turned on the light to check it, there were three condoms left in the drawer with holes in all three of them. It was just a downward spiral from there. Last week she threatened me that she was going to get my green card cancelled and file harassment claims against me. False of course. Yesterday had a big argument in the car. She tried to jump out of the moving car and started creating a scene on the road, I called the cops. Long story short she went back to New York today.

    What should I do. Should I file for a divorce or let her file it from there. What about the bank accounts? Should I close them because I believe she will try to take everything out just to trouble me.

    I need some urgent advise please. I know I can file for removal of conditions myself, but I dont know whats going to happen.

    I assume you are posting to this forum because divorcing her might jeopardize your stay in the states. Contact an immigration lawyer, and see if he/she can do anything for your case. This obviously is not a healthy relationship.

  3. My wife and I are just starting out, and so she's under the poverty line. My family friend is going to be our joint-sponsor so everything is good, but I have a question regarding I-864.

    When my wife fills out the I-864 form, it says that if one does not meet the poverty line, she must fill in part 7 in which she must list her assets (savings, property, etc). The small print says that her assets must be 3 times the gap between her income in the poverty line, which hers will not.

    Is part 7 of I-864 optional if she's under the poverty line but we have a joint sponsor whose income will over us?

  4. You are missing:

    1) Evidence of a bona-fide relationship: joint bank accounts, joint lease/mortgage-- even a joint gym membership. Sign affidavits from people stating such, photos, family vacations place tickets etc etc. This is needed for the I-130.

    2) You are missing a G-325A from your I-485

    - Do I not send all the forms together in one packet? Even then I still need separate G-325's?

    - I was told that the evidence should be presented during the interview. I mean I can send plenty of photos, but we are moving in together right after getting married so we wouldn't have any bills or joint bank accounts until after we file.

  5. Basically I'm marrying my girlfriend whom I've known for 9 years. I'm a bit overwhelmed about all the paperwork. I was wondering if I could get some guidance.

    I came into the county at the age of 13 with a B-2 visa with my parents, so I would be applying to adjustment of status. Can someone tell me if I got everything straight.

    We are going to get married in early April and file the paperwork soon after. I met with a legal assistant friend of my father who works at at a law firm, and she said that given that I have entered the US as a child, then I would probably be given a permanent greencard after the interview, which I do not believe since it's my understanding that I should get a 2 year green card which should be renewed 90 before it expires.

    Is my list right? am I missing something? is the legal assistant right? (she's not a lawyer mind you). Also, my joint sponsor is a family friend who is retired yet still fairly wealthy. Would that be a problem?
