  1. Hello everyone, long time no see here. My dad wants to come to the US to visit us for the Holidays but his visa is in his expired Peruvian passport. He is now naturalized Mexican and that Mexican passport is still valid. The visa expires Nov 2025, so it is still valid (yet in his expired Peruvian passport). No one can tell us for certain if he would have problems getting inside the country. He is 79 years old I would hate for him to have trouble.

     

    We thought about trying an emergency visa renovation and while filling out the forms we realized he had already traveled with this complex situation with one small difference, when he traveled in 2019  his visa was in a expired Peruvian passport, BUT he had a valid peruvian passport, AND his new mexican passport. I assume he entered as a Mexican citizen becuase the stamps for that trip are in the Mexican passport.

     

    Wat do you think? Does he need a new visa? Did he get in without problem because the immigration person was kind? we have no idea what to do... and renovating/getting a new visa at this point seem impossible.

  2. Have you discussed this with the Company Immigration Lawyer?

    I presume the TN requires you to submit information about the sponsoring company.

    No, I haven't talked to any lawyers. When I applied for the TN-Visa the only thing the company (a fairly small company) gave me a letter of intent to hire, which included the position I would be filling, the requirements and the compensation. Aside from that I paid myself for the fees, submitted the forms required, which I had to fill myself, got many recommendations from previous employers, all my diplomas and awards and that was pretty much it.

    The company was owned by a friend of a friend who knew me fairly well, I believe if he had ahd to jump through hoops with paper work and such he would have told me.

    As far as I know TN Visas are a fairly easy deal since there is the NAFTA treaty between Mexico, USA and Canada.

  3. Hi my brother is in Florida on his wife's F-1 visa. He is an exceptional professional but quit his job to move to FL, for his wife to pursue her PhD. He really wants to come back to the work force, but it has been really difficult for him to find employers willing to sponsor him for a work visa. We're both Mexican and are elegible to apply for a TN visa (I have done it myself, without any problems). His realm of work is systems, programming and developing and already has many potential contract projects, just missing the darn visa to be able to work.

    My husband (all aper work in his name) and I work with him (i'm not on a payroll, or anything) and we actually would benefit from my brother's knowledge as we do design work and many times are asked to do website development work.

    My question is if there would be any potential problems if my husband, through his company (LLC) sponsors the 1-year TN visa for my brother. Could my husband get in trouble for it? We've been thinking to add to our staff and what better to hire someone we know and trust.

    Just for info, my brother went to college here in the states, graduated with honors and then went to hold a G visa when he worked for an international organization.

    Any feedback will be much appreciated!

  4. Hi, I wanted to share my interview experience with all of you.

    I guess in my signature you will see our timeline. We sent our papers April 10 and our interview was yesterday June 24th at 1:30 pm. I'm the Beneficiary and my husband (USC) the petitioner. We arrived at the Fairfax office around 1:10pm. Went through security and then arrived at the waiting room. The lady at the front desk took our interview notice paper and asked us to sit down while we waited. We grabbed some magazines and talked, about stuff, just like any normal day. There were about 4-5 couples there when we arrived. Around 1:50 a happy-looking officer came outside and talked to the lady at the front desk and then he said "well I have one paper left here and only one couple left. so that must be you!" and I raised my hands, as if I had wone a prize. He asked us to come inside to his office. He gave us a really good vibe and I was thankful he seemed to be in a very good mood.

    He came inside his office and we proceeded with the "I solemnly swear.." to what he said, I believe him but you young lady? Very jokingly and then he laughed. So then he had our file in front of him, he asked us for our IDs, my husband's drivers license and I gave my newly arrived work authorization and passport. He took the I-94 and kept it by the way. He then ratified our names and address and the fact that Im from Mexico. He said I was a rarety (and said that my husband of course already knew how rare I was), because in that office they see more people from south America but not many form Mexico at all and that he used to live in Chicago and that in that office they see more people from Mexico and then we talked about tacos and we commented how much we wanted tacos at our wedding and how difficult it was to find an original taco caterer in the area and what not.

    He continued checking things through the paperwork, asked me of course that list about being arrested before, being a communist, terrorist, etc. Then asked me if I had ever tortured someone.. I said no... and then laughed and said ok maybe my husband and my parents. And he said, yeah I bet they must be worried about you right now. We chuckled. Somewhere along the way he asked us how we met. My husband answered and told him our story and how we started dating. I had a copy of all the docs I had sent, and of course he saw it and asked if I had anything new, I said well just updated back accounts and our insurance policy, etc. He said ok I don't need those.

    He then got to the taxes part and ratified my husbands income. My husband said yes, I will make XX amount of dollars this year. By the way, last year (2012) he only worked half the year, but still made enough for the income requirement. He started his own company as a photographer and designer. But since it was just half the year, for this year's income he doubled that amount as an estimate. So when the officer asked about the amount for this year my husband said, yes it will XX for this year, I have already made X amount so far and with the contracts I have my estimated income is XX for 2013. The officer said ok, sounds good (we actually brought papers to prove this, but the officer didn't ask for them). Then he said oh so you are photographer and you are a jewelry designer (to me) and we said yes. And then asked me, so you have a shop? And I answered no, not really. I went to grad school to get my masters in jewelry design and worked at the jewelry store where I met my husband during my OPT.

    And then he said thats sounded like fun and a good match of interests and professions. By then anything he said let us understand we were approved. He said things like, well when you get your greencard in a few weeks you'll be done for the next two years. I'll explain to you how it all works after that, just let me finish some stuff here in the computer. He then proceeded to explain the removal of conditions in two years and citizenship in 3. He gave us recommendations about what kind of papers and information to keep from now on but that it should be a breeze, really.

    He then gave us a paper, that is titled, Notice of Interview Results. There are 5 paragraphs with boxes and he cheked off the first one that says " Your case is being held for review. At this time, USCIS does not require any further information or documents from you. Should further information or documents be required, you will receive a notice in the mail. We may also schedule you for another interview at some point. Otherwise, a final decision will be mailed once your case complete." When he handed us this paper he said, I give this to every couple even if they are already accepted like you. I have no further questions and I have no reason to not approve your case. I only have to finish a final check here and you should recieve your greencard in a few weeks. We said thank you and smiled, of course. He then said, I have no more questions for you, you seem like a really nice couple, he is a very lucky guy and you are too.

    And that was pretty much it. He was extremely nice and in a great mood.

    When I got home I checked the USCIS website and cheked my cases.

    The I-485 case is in Decision and says: On June 24, 2013, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later.

    The I-130 is still in Initial Review but says: On June 24, 2013, we mailed you a notice that we certified our approval of this case and sent it to the appropriate appellate body for review. They will notify you directly when they make a final decision. If you move while this case is pending, follow the instructions provided in the notice and use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

    So, we are very happy and could not have asked for a nicer officer.

  5. Hi! Alexandria, VA here. I sent my packet April 10 got there April 12. Ckeck my timeline. Anyways, my interview is this coming monday. Once the status changed on the USCIS website to Testing and Interviewing it probably took about 10 days for me to get the actual letter.

    Oh and for example it also took about 10 days from the time the work authorization part changed to "card production" to the day (yesterday) that I got my card.

    Have you gone to the uscis website and checked on your cases? Along with the indicators of which step you are in, there's a few paragraphs underneath that give more info, whether the letter has been sent or even the actual date your interview is scheduled

    My guess is that you'll get your letter any day now!

  6. I sent in my docs April 10, arrived on the 12 of this year. Got my biometrics done early - originally scheduled for May 22 but succesfully walked in April 24.

    We got our interview notice a couple days ago - for June 24th.

    Haven't gotten any RFE or anything. And the processing for my 765 seems stalled. when I go to the USCIS website to check on the cases there's nothing new besides "Initial Review" Same for 130, it says Initial Review. Only the 485 now says Testing and Interview.

    I thought the 765 would go faster or show some signs of actvity before we even got our interview, but now even the interview is scheduled.

    Is this normal?

  7. how long did it take u to get a letter for ur bio metrics from the first day u submitted your form

    I sent all my papers April 10, they got them April 12. I received the Biometrics letter April 27.

    lol I was checking your timeline it's very similar to mine, I sent mine like April 11 last year, and it went very quick in Fairfax, I wish you the same, take a look at my signature .

    Oh wow. It would be amazing if I could get my GC in less than 90 days. Happy you had such good luck!

  8. Hi I have a few questions

    My husband is SELF-EMPLOYED and his income this year will be approx. $45,000 (he has made $25,000 as of today)

    Our household size is 2, so the poverty line amount needed is $18,912.

    He only started his business during the last 5 months of 2012 and his income tax number for 2012 was only $18,472 (originally it was $19,972 but had to declare a -1500 loss from selling his stocks last year at a loss)

    Since the 2012 number is $18,472 and the required is $18,912 that leaves us around 500 dollars short. My question is what are the immigration peeps going to look at? the $45,000 income for this year OR the income made in 2012?

    If they are going to look at 2012 taxes I guess we could use his assets to supplement? He has around $11,000 right now in the Bank and I know that the amount should be x3 the difference, so $11,000 is more than plenty. But anyways, do we need to include those assets or just leave it as is and only send 2012 taxes and wait to see if they ask us for further proof of income/assets?

  9. He can send his tax return for 2012. I don't see why he needs to explain the 1500.

    He should include a letter from employer (if possible) verifying his current income, or pay stubs from the last few months. This will support his claimed current income.

    Hi, he doesn't have an employer, he owns and runs his own business. However the only thing we can prove is that he has made about 15,00 this year already. But how do we prove it? bank accounts?

  10. Hi, we were completing the Affidavit part of my forms. My husband is the USC and I'm from Mexico and came here on a TN-1 visa. We got married over a year ago.

    He is self-employed and his Annual income is likely to be $45,000 this year

    (he has already made 26,000 so far in 2013, which is above the requirements for a two person household.)

    in question 25 of form I-864 they ask his income for the last 3 years and it looks like this:

    Tax Year Total Income

    2012 18,472 (he actually made $19,972 however he had to declare a loss of -1500 from 2011 in his 2012 taxes,

    the loss was from selling his stocks at a loss)

    2011 -1,444 (my husband didn't work during 2011, he had savings and stocks which he sold, however,

    the -1,444 appears because he sold his stocks at a loss)

    2010 16,214

    So the question is, should we only send photocopies from 2012 explaining the -1,500 loss (carried form 2011), or should we include photocopies from 2011 with the explanation of the selling of the stocks at a loss and that's the reason for the -1,444 income, and in the form it says that if I send copies from the 2nd year I have to send also for the 3rd... so do i have to send both? Could I just send the 2nd?

    Also, should we send proof that he has made $26,000 so far this year? if so, what kind of proof?

  11. My husband (USC) and I will need a joint sponsor to complete my change of status, etc.

    We've decided to ask his parents (or one of them) to be my other sponsor. Both my in-laws are retired, my mother in law from being a nurse and my father in law from the Coast Guard. Will their pensions work for us? And if so, would we have to pick one of them? or both as a couple? And how much money would they need to prove in the affidavit? in their household it's just them two. And in ours just us two. Would the joint co-sponsor need to prove funds for all 4? or just for the other person in their household and me, so 3 people? I'm confused.

    Thanks for any help you can provide.

  12. Out of status will not affect your AOS application,but you need to start the process ASAP before you get picked up by ICE because being in removal proceesings is a headache and some.

    We haven't started the process because my husband (the USC) doesn't have a job... so the affidavit is the problem... and we really don;t want to get a co-sponsor... what if I apply with a bad affidavit? I'm assuming they ask for more information, but then what... do you just move to a stand-by pile (while we get the necessary stuff for a good affidavit)?

  13. You will be fine. The overstay is explicitly forgiven for people adjusting status based on marriage to a US citizen. You haven't yet reached the 6-months-of-overstay mark where leaving the country will get you a ban, but it would still be prudent to remain in the US until you have your green card in hand.

  14. Hi. I've been in the US for over 11 years, always with students visas or G-4, and lastly a TN-1 visa which was ending last April 5th(2012). My husband (USC) and I got married on March (2012,too) after knowing each other for little over a year. It's been six months since then and for a couple reasons we haven't filed yet. How will this time of being of of status hurt our application? Are they gonna give me a hard time when we finally apply?

  15. I had to read a couple times. Well We've been married since March 10, 2012, and living together since mid April. By the time we apply we will be more than 6 months married and living together. I have a few cash assets, mainly $10,000.

    Now, I've been here for over 11 years, with students visas, G-4 and recently a TN-1 visa which I have now overstayed since april. And like I said this international organization wants to hire me once I get my papers... so I guess that doesnt count for immigration?
