  1. My boyfriend works remotely and his PERM process was started while living here in NY state.

    The company's immigration attorney is saying that he cannot move states, and that doing so will cause the entire Green Card process to have to start over. It is his understanding that this is due to the Prevailing Wage determination being location-specific, but there could be another reason we are unaware of. They are saying we have to stay in our county in NY state.

    His current L-1B visa runs out at the end of 2017 so he cannot afford to start over at this point but we are frustrated over these restrictions of having to stay in our County. Yes COUNTY, not Country! :wow:

    We were hoping to move to Boston this June.

    Are you familiar with this rule? I have never heard of this rule. It was my understanding that one could move states, but not leave the country for an extended period of time.

    We are having some complications here...

    We filed the K1 in June and got our NOA1 on June 22.

    Meanwhile, my boyfriend was offered a position this week with the US office of his company in the Atlanta area. They said they would sponsor him for the L1 visa and want him here in two months. Not sure if that is exactly feasible but that's what they said.

    We are not sure what to do because we really hoped to move out West or the Southwest. Also I have been unemployed since December and am kind of close to getting a job in other cities - not Atlanta though. It would be great for him to have a job but we just don't see ourselves in Atlanta but it could be a good opportunity for him and income.

    How long has it taken your fiance/e to obtain work when all was said and done. I heard the adjustment of status takes about 5 months? The market is tough though and I worry it will be harder for him to find work as a new foreigner in the states. (although he works in software). Did your partner struggle to find work? What did they do while they waited for all the paperwork to clear?

    We could just do the L1 visa instead and live in different cities but then that is not ideal and it just drags on the whole visa process.

    Really hard decision to make.

    My boyfriend may be getting a job transfer to his company's US headquarters.

    We filed for a fiance visa in june, so this is sort of unexpected news to get but good so we may end up cancelling the fiance visa petition.

    If he goes the L1 visa route the disadvantage is we are tied to one city, where we both don't want to live in necessarily and at the moment I can't find work there. If he arrives though sponsored by the company, and we get married 3 months down the line, how long does it take for us the change his visa for a spousal visa so he can get a green card. Must he stay with his L1 visa for a certain amount of time?

    Hope this makes sense?!

    Once your fiance/fiancee gets the K1 visa, enters the US etc. when can he/she return back to their home country to visit? Must they wait until they get issued their green card?

    We actually want to have our big celebration in his country, but will do a very simple service here in the US first (within the 90 days), then do the formal wedding probably a year after being in the US.

  5. Sent the I-129F package certified mail this afternoon!

    It's pretty organized but I relaxed towards the end about putting the thing together. Used Paper clips, binder clips, post it notes and arrow tabs. Didn't do the 2 hole punch and just placed the papers in a big white envelope that is unbendable.

    The evidence will speak for itself, I hope!

    Two-hole punching the top of the material for easy placement in the file is appreciated. Exception: Petitions filed at the Chicago lockbox should use paperclips when attaching supporting personal documents to forms instead of “ACCO” fasteners; staples are acceptable when attaching fees.

    Also what on earth is an A-number?

The following items will not typically show proof of having met in the last two years however will show proof of an ongoing relationship: Copies of land line and cell phone bills, appropriate letters and emails, stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

  8. For this fiance letter of intent, must the date be handwritten in ink or can it be typed? We have the signature and printed name in blue ink and I have the date typed at the top of the letter. I read somewhere that the date should be handwritten at the bottom of your signed/printed name?

    Also is it okay to put post it notes on papers, explaining what things are?

    He doesn't need to sign his full name a certain, specific way. In fact, if this is his normal signature then that is exactly what he should do, especially if he signed it the same way on his passport...shouldn't that match too?

    I am not sure how his passport looks and how it is signed. Must it match? I guess we will just leave it as is.

    Just received my boyfriend's signed fiance letter of intent and G325A. He signed the forms using only his first initial and last name! For example Chris Van Der Berg he wrote it as C Berg..in some sort of scribble...

    This doesn't seem right to me and I would kick his butt right now if he wasn't in a different continent!

    Please any advice?

  11. I included a copy of my certified birth certificate and a copy all of the pages of my passport (as stated in the I-129F instructions) in my original I-129F petition. I would seriously doubt that you need to mark, tamper, or do anything to the passport stamps. As a matter of fact, it may be prudent to let the evidence stand as it is. After all, this is the same government department (DHS) that checks your passport upon reentry into the US (different branches, but same department) and they have likely seen a few passports in their day.... :unsure:

    okay do you think my fiance should do this too because he is showing his stamp from when we went on holiday together, his is a South African passport.

  12. I was planning on using a birth certificate to prove citizenship but I also want to include my passport stamps to prove we have met in the last 2 years.

    Should I just include my bio page + the stamps or just photo copy the whole thing to be safe?

    Also, how did you indicate the stamp, just draw and arrow and write, entry into blah blah...?

  13. I was thinking to add a few letters to our I-129F petition

    - My boyfriend's parents own the building that he lives in so the technically are the landlords. I lived there from Dec - April. He doesn't have a lease so I wasn't added to the lease but I thought a letter from them saying I was there and they allowed me live there would be good? Should it be notarized?

    - I had a friend from the US visit us in December, perhaps a letter from her? Including her E-ticket itinerary, copy of her passport ID page (showing her picture) and a picture of the 3 of us us together? Am I getting to carried away here?

    I would also love to show some how our intent to marry. However, I am not sure how to do that? I think by the time he gets here we will just do a small ceremony, us and 2 witness type of thing.

  14. Okay, I have addressed our letters to the Dallas location as that's the address the letter templates had.

    Many people said they addressed them to the Vermont Service Center.

    Someone addressed them to this address?

  15. Is one Service Center better than the other - or is it hit or miss?

    I live in NY now but could be moving to Charlotte, NC or Portland, Oregon probably mid June. I was thinking of just sending from NY and then having the correspondence sent to me by my parents. I hear that changing addresses can slow things down. OR I could just wait to see where I end up and use my new address there.

    Have a questions as I work through these forms, please bear with me and thank you in advance for you help. It's great to have this and your experiences as a resource.

    Form 325A -

    Question 1 - I have had many addresses the past five years, can I add an attachment as I did for the employment section?

    Question 2 - For periods of unemployment I put down my volunteer work and the organization but specified I was a volunteer/unemployed. Is that okay?

    Question 3 - For the question "Applicant's address outside the US for more than one year" Although I have lived abroad for 2 years, I didn't reside in one place for a year exactly, but close to one year. Should I just put that address down? Or just put "None"

    Form I-129F

    For question 10, "Citizenship was acquired through..." I have a birth certificate. Do I put the number down or is that only for Naturalization certificates. That's what the guide says but sounds weird.

  17. HI all, Is this okay for my summary of how we met within the past two years. I am filing the first week in June I hope!

    For documents I have the following -

    - 2 E ticket itineraries of my trips to the USA and back to SA

    - Our E ticket itineraries for our Zanzibar trip

    - Passport Stamps

    - Copies of bank statements showing proof of purchased tickets

    - 5 Photos of us - the guide says no more than 5. is that still true?

    Unfortunately I don't have my boarding passes. Should I throw in some emails and stuff too? but that doesn't show we met really.

    On May 10th, 2010 I arrived in Cape Town South Africa on a six-month visa for the purpose of long-term volunteering projects, travel and attending the 2010 World Cup Soccer Tournament. My visa was extended three times which allowed me stay in South Africa until April 18th, 2012. Throughout this time I visited the USA twice and then returned to South Africa.

    Willem and I met through friends in October 2010 in Stellenbosch, South Africa. Initially we were first friends and then began dating in March 2011. At the time I was living in Stellenbosch, Willem’s hometown, and a quick 45-minute drive to Cape Town, where he currently resides.

    In December 2nd, 2011, I moved into his apartment in Cape Town and on February 14th, 2012 we took a long awaited trip together to Zanzibar Tanzania.

    Our relationship was completely in person for one year and a one-month while I was living in South Africa. Since I have returned to the USA, we have been communicating daily through E-mail, Phone and Skype.

  18. True. I assumed, possibly incorrectly, that OP lives with the parents.

    But in fact it has not been stated anywhere in this thread, so I may be wrong and stand corrected.

    I do currently live with my parents as I just moved back from South Africa. I should be moved out by 1 month 1 1/2 months. However, when I send the petition I may not have my new address yet so will have to use my parents. I am moving out of New York.

  19. No, it's not necessary that you work full time, but ff you make less than required 125% poverty line amount, you will need a co-sponsor who does (for their houshold size + you and your fiance).

    Okay thanks. But I read in terms of filing the petition it's OK that I am unemployed and do not need to present a sponsor, financial information yet. That will need to be presented during the interview process?
