  1. I have read through to understand the differences between the two visas to see which one would be the better route for my fiancé and I. However, I have a slightly complicated situation. I was married once previously to an American citizen, went through the whole residence process to bring him into Canada. We got married in the US, moved up to Canada, had a child together and then divorced. The divorce should be final here in the next couple of weeks. I know I cannot start the k-1 process until I have my official divorce certificate etc. My ex is possibly going to be moving back down to Florida where he is from (he is still an American citizen). I have full parental rights to our daughter. My fiancé, is from Texas. The plan is for my 3 yr old daughter and I to be moving there. My ex has already consented to the move and has authorized for me to take her down to the states whenever necessary. I was just wondering if there is any special process for my daughter since her biological father is still a US citizen. I know with the k-1 it also sponsors children that will be travelling/moving with you. I have heard mixed things as far as it being better to get married first and going the k-3 route, or simply doing the K-1. IF anyone can shed some light on my situation that would be helpful.

    i have been trying to figure out how to approach my situation. My boyfriend (american, wanting to be fiance) is wanting to go to university in Canada where i am. originally we were going to go the k-1 visa route but he decided he wants to move up here to Canada now. he wants to get a student visa but i am wondering if he then would have to wait until he finishes his studies with his student visa to marry me? and if so would it then make it easier to get a marriage visa? we really want to get married, but i am overwhelmed with information and confused where to look. if someone could help me that would help me out so much!

  3. Hey everyone, thanks for taking the time to read my question. I was wondering when my fiance and I submit our petition forms for the K1 visa, do all the forms have to be the originals? In other words for my part of the package filling out the biographic information, providing the passport type photo etc. do I have to send my fiance the originals or can I just scan them? I keep finding answers that said yes you could scan them and then some people would said no they had to be originals. If someone could give me a definite answer on this that would be great!

  4. Thank you! That's what I figured would be the case. The last couple times that I have crossed the border to visit my fiance they did give me a bit of a harder time. A few months ago my dad went into the United States Border patrol office right close to here to ask him a couple questions and his best advice was to not give more information than needed. Of course if they ask you if you are visitng a boyfriend you MUST tell the truth and say that you are. It is never a good idea to lie. But you can save yourself a lot of trouble if you say simply visiting friends.

    I am a Canadian citizen in BC just starting the long process of the K-1 visa to be able to marry my fiance who is an American citizen in the US navy, stationed in California. I have a specific question that I cannot seem to find the answer for anywhere, so I would really appreciate it if someone could help me out:) After my fiance submits the petition, am I allowed to enter into the United States and visit while we are awaiting for approval or am I only allowed to enter into the United States once I receive the fiance visa? I live right on the border so I go into the states weekly and also attend church actually just across the border into Washington. I understand that once I have my visa and enter into the United States I am not allowed re-entry into the USA until my AOS is approved unless I have applied for "parole" ahead of time. Again, I just want to know if I am allowed to go into the states while I am waiting for approval for my visa. Thank you!
