Yes he can petition for your child. My husband petition for my children 7 and 13 in November 2013. Yes file 864 and 693 too. They di biometrics in December. Now waiting............

We were lining together with his mom. Bills and lease was in her name. I send in court documents showing that we went to court re the abuse, affidavits from his sister and friends but they claime the affdavits vague.
