  1. We got RFE was for birth certificate. Basically, it's not availiable since the applicant was never registered. The country we're from could not issue non-availiability certificate.

    i need some help or opinions from you guys, the information i got from the US Embassy in regards to unobtainable birth certificate is as follow:

    "Applicants who cannot obtain a birth record should request a certified statement from the appropriate government authority stating the reason why the birth record is not available. Applicants may then submit this certified statement along with secondary evidence of their birth. For applicants who reside in Hong Kong, the Certificate of Registered Particulars issued by the Hong Kong Immigrant Department, is accepted in lieu of an unobtainable birth certificate. A similar document can be obtained from the Macau Direcção dos Serviços de Identificação."

    In response to the RFE, we only submitted the "Certificate of Registered Particulars", you guys think that's sufficient enough? or we'll need "certified statement from government authority" or any "secondary evidence, e.g. affidavits"? We worry INS will issue RFE again at interview.

    Any thoughts?

  2. Thanks ClassyBee replying for me, yes... our RFE was for birth certificate. They received our response on 6/4/12, it's back to the waiting game again.

  3. I would say call uscis it wouldn't hurt... Since u sent it by certified mail I'm assuming u have some kinda of tracking number or order number where u can also call USPS and find out..

    Yes, USPS tracking already showed delivered on 5/29/12. Usually with the e-notification setup with USCIS, they'll email and text sms when the case is touched. It's been over a week, so i'm getting worried, especially te deadline to respond has passed.

    Called the USCIS this morning already, they said they wouldn't search for case unless it's over 30 days.

    Any other opinions?

  4. Glad to see lots of progress on interviews and approvals, and sorry about Mike's bad experience.

    We're a little late for the March filers, just submit the RFE response 2 weeks ago. USPS says it's delivered on 5/29/12 (it's sent by certified mail). So far, haven't received any email or sms confirming the receipt. Case status check from USCIS website still showing no activity?

    For those of you responsed RFE, what's your experience on turn around time?

    I'm just worry it went to the black hole or the case might got denied because they didn't received what we sent. The deadline to response is 6/3/12 (which it's already passed).

    What should we do now?

  5. I'm sorry wiiwin for the seemingly difficult situation. I would suggest you post in more general forum or perhaps where you have more Chinese Filers, They might be able to proffer solution(s)

    Btw, the RFE gave us 87 days to response. Not sure from the date of the letter or the date it's received. To be on the safe side, i'll go with the letter date. Wish us luck!!

  6. Hi wiiwin,

    I did not have birth certificates either, so I submitted two sworn affidavits from people who were present at the time of my birth along with a document from my home country which said we(the death/birth department) don't have any documentary proof of his birth. See attached sample files.

    P.S: This Affidavit is from a father's prospective, but you can use an aunt or uncle or even a neighbor :thumbs:

    Thank you so much for providing the sample letters, i've seen them before from my research. The affidavit part, i can try to find someone to do that. The main issue now is the first edvidence, i don't know where to start getting the "no record certificate". Hong Kong is unable to provide that statement since it's out of their jurisdiction because my dad is not born there. As for China, we don't know anyone there and i don't think they have any record in their system neither. Dad left the country when he was a kid and back then, no documents or ID was required. I'm suprised how can this happened but i guess it's pretty common in the old days. :blink:

  7. got RFE for foreign birth certificate :crying:

    My dad was born in China and never had registered as it's not required back then (in the 40's). He's been living in Hong Kong for like 40 years. Both parent passed away long time ago like over 30 years ago. We submitted a self-affidavit along with passport and other documents showing his birthplace and parents name...etc. Obviously, that didn't work.

    I've done tons of research on this, lots of resources from Indian applicants, very informative but not quite applicable to our case. E.g. certificate from embassy on BC not available (went to China Embassy, not helping at all, they just kicked me out basically), affidavit from parents (passed away for ages)......

    Not sure what to do now!! very frustrating......

    Any help are appreciated, encouragement is needed as well.... :help:

  8. hello all February filers,

    Its a great day for me today!!! when i came home today, i saw a letter from uscis and i was praying that its not an RFE...

    when i open it, it was surprising to see that it is my INTERVIEW LETTER!!!! without any sign or email update prior.

    the interview date is for April 17th at 8:40am at my local phoenix office.

    but still no update on I-130 or I-765 yet tho..
