  1. we are waiting for my husbands 751 to be processed.

    This is a general question - I understand that the Vermont processing center takes 12+ months. I also understand that my husband will need to go to a uscis office and have his passport stamped to extend his stay again after his 1 year extension is up.
    Vermont is currently processing applications from OCTOBER and its not november

    Could somebody please direct me towards a more concrete explanation of this wheather a thread or a guide or whatnot?

    How soon should we go in to talk to USCIS? We received his extension letter on January 18th 2016 - I understand that the appointments can get backed up at uscis and that you must make an appointment. Is now too soon? do i need to wait until December?

    anybody have experience with this and can direct me to the appropriate forum and guide. I know i read this somewhere on here but I can't for the life of me remember where I read it.

  4. One more question. When they stamped his passport after arriving in USA they mark what class it is? I believe it says ' tourist' but he is not a tourist. They scrawled something that I cannot make out... Looks like 'Arg'he came from Argentina.... I would assume that green card trumps all right?

    They detained him for an hour just to ask some questions and stamp his passport. What did your stamp look like?

  5. thank you again. Its just emotionally helpful to talk to an actual person. I have seen that document that you referenced in the URL link and yes his extension letter does state that this extends his stay for work and travel for the span of one year. I was just concerned about some United Airlines rep not recognizing the extension letter....

    and you are right, USCIS's website is frustrating.

    I keep checking the status of my husbands case and it stops with the biometrics but I assume that is normal because the VERMONT service center seems to have such a long processing time. We sent the application in January and got our NOA in february along with biometrics. vermont is averaging 270 days for processing.... As far as I can understand the processing times table. Its just disconcerting to not have any information. I've done all this myself and I've been a trooper (no fear) through the entire thing but its wearing on me. (starting to panic for no reason)

  6. I am an overcompensator but I am asking to set my mind at ease. :) My husband has his expired green card and his one year extension letter. His passport is Argentine and we are traveling via United Airlines.

    Questions:

    He travels on his ARGENTINE passport correct?
    Do we need to take the ORIGINAL 751 Doc or can we take a copy (the original doc is like sacred to me)
    Has anybody had any issues with United Airlines and these documents and this process?

    Where can I find the source for these answers? Its frustrating that I cannot find the answer laid out on USCIS's website or CPB's website. United Airlines is somewhat vague but they do reference a 're-entry' permit.

    Does anybody have any experience traveling to Argentina on their 751 extension letter?

  7. Don't make yourself nuts. I did NOT have my phone number on my check. I also had very very old checks as in... my bank was purchased by another bank and the checks still read the old bank... The routing number and account number were the same.

    I did this with both the i-129 and the i-485 and i had no problems in either case. you will be fine. i'm sure they dont care WHO pays them as long as they get their money.

  8. You can try to call the embassy but I would just relax and let nature do its course and consider NOT purchasing an airline ticket until you know when you are approved. The embassy will contact you with the list of everything that you need including medical exam and which doctors are qualified for it. You will most likely need police records and a certified copy of your birth certificate. Just relax and PLEASE dont buy the ticket yet, this isnt something that can be pushed along and you will only frustrate yourself more.

    im so confused and overwhelmed by this AOS process... I dont know the time limitations and all that stuff... We were married October 12 and then went on a honeymoon for a week and i'm just starting to sort through the whole process... what is the DEADLINE for submitting the paperwork for the adjustment of status???? Im going to the social security office to get my name changed on monday and i'm waiting on that to change the lease into his name and so on.... I am getting so many conflicting responses from what i hear online... responses anywhere from one year after marriage to before the visa expires.... can somebody please point me in the right direction so i know how much time i have.. the answere of as soon as possible does not help me.. i need to know times...

    there is also the i-94 that people keep talking about... and that expiration date.

    please... i dont know what i'm doing here...

  10. she should change that, and opt IN for tips shown on her paystub. Otherwise there is no other way legally to show that she has made enough money. you need a paper trail. otherwise yes, try to line up a co sponsor.

    I am a hair stylist and I am in the same place with tips. my boss does not report my tips, however i have taken this into consideration in the past 3 years as i have been preparing for the k-1 visa and considering the income requirements I have purposely reported basially all my tips to the best of my knowledge. I did not want there to be a shadow of doubt on my ability to be a sponsor.

    i also forgot to say that i used my income tax documents.

    So our case is now with the Embassy in Argentina and everything is progressing well enough. The only thing is that I am moving here in the USA. I went to do my change of address on the USCIS website and was informed that I can only do that if i have a pending petition which i do not.

    Then I was reading about the form i-865 but that is for persons who are now leagal residents and he is not yet in the united states. how should I deal with this? I pasted below the directions i was given... however like it says its for someone who has become a permanent resident...

    I just want to do this correctly...

    U.S. Citizens who do not have an application or petition pending with USCIS are only legally required to notify USCIS of a change of address if they have previously submitted a Form I-864 on behalf of someone who has become a permanent resident. If you have previously submitted a Form I-864 for someone who immigrated to the U.S., you must complete a Form I-865 within ten days of the completion of your move.

  12. So my fiance is pretty much ready to submit his packet to the embasy for the k-1 application. Our question is this; does he need a cover letter or an index page indicating the order of the pages or is the bulleted list that the embassy provides enough for the order?

    If that did not make full sense please ask me for clarification

  13. So I'm a little confused about when the affidavit of support gets filed. I am the sponsor and my fiance is the beneficiary. Do i file the forms myself or do i send the forms and the supporting documents to my fiance for the consulate to look over there?

    can somebody please post a link to the information, I am sure it is found somewhere on this website but I am hard pressed to find it.

  14. thank you for your responses. He cannot change his money in Argentina, his country is becoming increasingly restrictive with the american dollar and they will not exchange money... the last time i went to Argentina they would not exchange my money.

    It will have to be cash and it will be less than 6,000

    I do remember remember that from the customs form being 10,000.

    It will not matter. The most important thing is that it states you are legally able and willing to marry and will do so within 90 days of entering the US with a K-1 visa, and has an original signature. The address on the letter is not even a requirement, so do not stress so much over it.
