  1. the people in the walgreens know what there doing they take passport photos all the time. your photos should be o.k if you dont it ask for your money back. and go some place else. cvs or some photo shop.or another walgreens.

    I understand, but she said this is the first time she deals with immigration photos and that it's a little different than the standard U.S passport size... but i'm sending them in regardless and hopefully i won't get RFE, thank you for your replies :)

  2. So i went to Walgreens to have my passport-style photos taken for AOS, and i told the lady that i need the followings:

    Photo must be 2 inches by 2 inches

    The height of the head (top of hair to bottom of chin) should measure 1 inch to 1 3/8 inches (25 mm - 35 mm)

    Make sure the eye height is between 1 1/8 inches to 1 3/8 inches (28 mm – 35 mm) from the bottom of the photo

    so i took the photos and went home, and later on i decided to measure the photos using a ruler, and then i found out that the eye height is barely 1 inch(25mm) instead of 1 1/8 or 1 3/8 , so i went back to walgreens and told the lady and she took her time and did it again and then she said now it should be ok so i took the photos and went home and then i was measuring them again to double check and ..... guess what.............. YES it's still the same, the eye height is barely 1 inch!!!!

    my question is how picky is USCIS ?? are they gonna send me a RFE for that ?

My vaccinations wasn't completed by the time i had my k-1 visa interview, after the interview i completed all my vaccinations. and when i came to the U.S i went to a civil surgeon and they have my updated vaccinations record transcribed on form I-693 and they sealed it, my question is do i still have to send the old incomplete DS:3025 along with the sealed I-693 to the USCIS or i don't have to send form DS:3025 ?

  5. I am from FL too. The certified marriage certificate is basically just a copy of your license reprinted with the official court header and stamps on it. At the bottom is a stamp in red from the clerk of courts and the signature of the deputy clerk to verify it is indeed a certified copy from the court. You only need to send a copy of that. I did not send a copy of the back, as it is blank. I made a color copy though, so the stamp at the bottom still appeared in red. Keep the original you received from the court, and bring it with you to the interview, if you have one.

Hello, i entered the U.S on k-1 visa, we got married and I'm sending my AOS package soon(I-485, I-131, I-765) and i was reading that i have to send a certified copy of the front and the back of the marriage certificate, but i checked ours and there's nothing at all on the back of the paper!!!! our marriage took a place in Florida, is that normal ? and we received 2 certified copies when we got married. do i need to send both of them? because i was reading on VJ about people getting RFE for marriage certificate although they send their original certified copy!!! can anyone clarify that please?? i entered the U.S on k-1 visa

    any help please...

  7. hi everybody, i have a question regarding I-864

    Bank letter states the followings:

    your total draft balance: $29,000

    your total share balance: $00,000

    your total certificates balance: $11,000

    so on form I-864

    .26- your assets

    a- Enter the balance of all savings and checking accounts $------------

    b- Enter the net cash value of real-estate holdings. (Net means current assessed value minus mortgage debt) $--------------

    c- Enter the net cash value of all stocks, bonds, certificates of deposit, and any other assets not already included in lines 26(a) or (b). $--------------

    shall i add up draft balance + share balance + certificates balance and put the amount next to a- ( 29,000 + 11,000 = 40,000)

    or shall i put $29,000 next to a- and 11,000 next to c- ???

    i know it's not an easy question but hopefully someone will be able to help me

  8. Hello, I'm about to send off AOS package and i have some questions,

    1- do i need to send a copy of my wife(USC) birth certificate ?

    2- do i need to send 3 certfied copies of marriage certificate? one for I-485 , one for EAD and one for AP ?

    3- do i need to send 3 copies of my passport pages and 3 copies of my visa and I-94 of just one copy each ?

    4- do i have to send original copies of anything?

    5- do i have to notarize any documents?

    6- can i send the payment as money order or is it better to send a check? and the amount is $1070 right?

    7- do i have to send 3 cover letters? one for I-485, one for EAD and one for AP?

    8- on the form G-325a question where it says "this form is submitted in connection with an application for: shall i tick - STATUS AS PERMANENT RESIDENT or tick other and type - ADJUSTMENT OF STATUS? since i should be granted 2 years green card and i won't become a permanent resident right away ?

    9- am i able to apply for a us driver license before Green card is received?

    10-do i have to send proof or marriage(relation) pictures etc.... or it's not required to be sent with AOS package?

    any help is highly appreciated

  9. Yes, the amount is before taxes.

    She can get the letter from the bank stating when she opened the account and what the balance of her savings is, if that is all the bank is willing give her. It is better than no letter from them. She could also include copies of her last 6 months of statements from her savings account that will show the activity on it, and they can know she did not JUST put the $30k in there all at once recently.

  10. She must list the incomes from her last 3 years of taxes on the form and provide a tax transcript for 2011, but that is not her current income. She is not self-employed, so you would not base her current income off of what she made in the past last year.

    You would estimate her current annual income by taking her hourly pay and multiplying that by how many hours a week she works. Then multiply that by 52. Or you can multiply what she makes in a month by 12. That is the current income to list on #23 and 24 of the I-864. That is the amount that needs to be at least 125% of the poverty level for your household size of 2. She needs to be currently making at least $18,912 this year. Have her get a letter from her employer stating her position and salary. She can also list what she has in savings and provide bank statements to show how much she has in her account since her income seems to be borderline. $30k in savings more than covers 3 times the amount she is short. Even she is only making on the low end of what you stated ($550 bi-weekly), she would only need $15k in savings to have at least 3 times the shortcoming in her income. Having double that amount in savings is a good thing. Her savings should allow you to not need a joint sponsor. She can also write a statement explaining that her income was so low in 2011 because she was out of the country and not working for half of the year.

    so if she makes $9.80 an hour and she works 38.75 hours per week then that should be enough i think, 9.80 * 38.75 * 52 = $19,747

    i believe this amount will be before tax, or shall she makes 18,912 after tax ?

    is it enough to get a letter from the bank stating when the account was opened and how much she actually has in it? or should she get detailed bank statement that shows all deposits and transactions ? if so what exactly should she ask for when she goes to her bank, because i remember when we were going through the I-134 they didn't know what letter to give at the bank.

  11. Is she self-employed? Is that why you are basing it off what she made in 2011? What is her current income this year?

    If the rest of the money was already in her account, adding just the $1000 now should not be much of an issue. She can provide a bank statement showing how much she has in savings. If she wishes, she can ask the bank for a letter stating when she opened the account, plus her average and current balance.

    she barely met the poverty guidline for 2010 and for she made about 9k 2011 because she was living with me in the uk for 6 months, ( she took leave of absence from work)and she still has the same job,

    she makes around $550 to $750 every 2 weeks, so she makes around 18k per year. but she also been off work since i came here (2 months) as we got married and getting our papers ready. she is going back to work in 3 weeks.

    she already has $29,300 and gonna deposit a 1,000 tomorrow.

    and the difference is $18,912- $9,228 = $9,684

    the I-864 instructions say if you are a u.s citizen and sponsoring your spouse then the total value of your assets must only be equal to at least three times the difference, so based on that: the difference which is $9,684 * 3 = $ 29,052

    she already has $ 29,000 in her account and willing to deposit 1 more 1,000 tomorrow so the total in her account will be $30,000

    it will be a little over 29,052, my question is that gonna be enough? or it's better to find a co-sponsor? and do you know if anyone had a similar situation and if it turned out to be a problem ?

    and is it going to be suspicious that she just added a 1,000 to her account? and can you please tell me what kind of letter from the bank she has to get?

    is it a simple letter that says how much she has total ? or a different type of bank statments?

  15. It is a catch-22, isn't it? You would have to put an amount high enough to meet the income requirements for the I-864 expected for the current year, and find a job for the spouse between the time he/she receives the EAD and you are interviewed for AOS. Or, the USC spouse could take a second job in the meantime, before filing for AOS.

    Even if the USC got a second job for now then what difference will it make since her income for 2011 was below the poverty level ? is it enough if she has a good job at the moment but her 2011 income wasn't enough?? the reason she didn't meet the requirement is she took leave of absence for 6 months last year.
