  1. you can apply for both, but during the time of interview it will come up that you have K1 in process or already granted. At this point it would be upto CO to grant L1 or not, best thing would be talk to your company let them know your K1 is in process only down side to this is you will not be able to work for your company immdiately after you move.

    you will have to wait until your AOS process is complete.

    Say your L1 is granted, you can enter US with L1 and then get married to your fiance and file for AOS - in that case the down side is you will have to start all over again and whatever money you have spent on k1 is lost.

    I am in the same situation as Storm 555, except that I did not get married at all. I and my fiance are in the process of a k1 visa and my company might transfers me also through a L1 visa. I would like to confirm with you the following : is is possible to turn up at the port of entry with two visas a k1 a l1 ?

    If anyone had an RFE from the beneficiary's consulate, please share your experience about what you did after the RFE.

    My fiance, who is a Canadian resident in Montreal(french nationality) was issued an RFE for proof of residency. Also, keep in mind, DOS told us that packet 3 was sent out a few weeks ago (haven't received it).

    We sent his proof of residency today, but we're not sure if we should wait for any kind of response before sending packet 3. So we're planning to wait a few days and send out our packet 3 at the end of the week.

    I'm curious to know if anyone did the same thing? Or perhaps we should wait to send packet 3 until DOS records our RFE response?

    It's just strange because according to DOS, packet 3 was sent a few weeks before the RFE. I thought it would be reversed.

    Any advice is greatly appreciated.

  5. I called DOS a few times and as soon as they told me that packet 3 had been sent out, I went to the Montreal web site, double-checked the information I had gathered, and sent it off to Montreal. I sent packet 3 over a week ago. You don't need to wait to receive it. You just have to confirm that it has been sent out to you.

    I'll be calling DOS again tomorrow to see if P3 has been received and Packet 4 sent out. As far as I understand, once they say P4 is sent, you can schedule the interview. And, again as far as I understand, you need to have an interview date before you can schedule the medical exam.

  6. I sent in my Packet 3 last week. They have very recently updated the Montreal web site and it seems the documents are a bit different now. Since the new "appointment checklist" is what they offer now, that's what I printed and sent in with my package. There's no place to sign or date it or anything. I just printed it and put it in with the rest of my documents to show that I had read it (and kept a copy for myself for reference, of course). All the items on it are the same as the old checklist, by the way.

    Thanks CA-Dreamer, that's greatly appreciated. Did you wait for receiving packet 3 before sending all the documents they required at this stage ? Do we need a letter to book an appointment in order to perform the medical examination ?

  7. packet 3 was sent to me on the 20th, so i'm preparing all my forms to send on monday. not waiting for packet 3 since who knows how long it will take.

    since it's on the montreal.uconsulate.gov website, i'm going to assume that this checklist http://montreal.usconsulate.gov/content/visas/pdfs/visa_checklist.pdf is pretty much exactly what i'll be receiving in the mail, correct?

    i'm wondering whether i have to check off the things that apply to me, or just leave the form blank and fill out the bottom part, which will show them that i've gathered what's required. if i DO have to check things off, would i leave something like the appointment letter and medical unchecked, since i don't have them yet? or do i check them off to show that i know i will need them?

    Thanks for all these tips, it is really helpful. We have just received the NOA 2 and our case was received by Montreal consulate. Packet 3 was not sent to us yet. We have started to prepare it anyway. All the required documents seem to be on their website. However, we can't find the PDF checlist you made reference to in your post. At the moment, the only thing we can find is what they call an appointment checklist and this is not in pdf. I was wondering if someone can post this checklist in PDF, if they still have it. Indeed, I don't think sending the whole package with this checklist :http://montreal.usconsulate.gov/visas/visas/fianc-k-1-visas/appointment-checklist.html would be necessary for just packet 3. Any help is greatly appreciated.
