  1. I Just had my N-400 Denied based on Three years marriage to USC. The reason for denial was that USCIS believes my wife and i am not living together for the complete three years( in 2009 tax year- my Wife filed Tax as Head of Household and she had listed her mom address as her residence, which we amended later after the interview and wrote the explanation letter about the situation about filing HOH and residence. Even though, we have provided so much of documents to prove the fact that our marriage is bonafide and we are still happily married and living together.

    I need to travel for about a month outside the US. Is there going to be any problem while coming back at POE?

    I need some serious suggestions please.

  2. 40 days and still nothing should i wait for 45 days them do info pass?....thanks in advance

    I had my interview back in 2nd week of January, was issued RFE to which i responded first week of February and still nothing. Status still says " request of evidence". It will be three month next week that i had my interview and yet no decision. I had my info pass on April 4th and i was told to wait 30 days from that date to have decision on my case.

    I guess we all just need to be patience and stay strong and let the faith decide.

I never thought I would have to wait this long to get decision on my case.It has already been 75 days after my interview and more then 2 months that i had sent my RFE response, yet no decision made. I tried calling Customer service couple of times. Every time i called i get different answers from different USCIS resources. While i asked "if i can make a service request for my case", i was told that my Local office is currently processing RFE cases from September.I am October filer and current processing time of my local office is 5 Months. How can they be working on the cases from September while current processing time is 5 month? so when they issue N-14 on you'r N-400, does your files goes to service center or stays at local office?

    How long do i really have to wait? what would be my next step, if i dont get any feedback?

  4. Mine still says: Your N400, APPLICATION FOR NATURALIZATION is now scheduled for interview. Nothing changed , my bad luck, i had a mean, unprofessional officer, the way he acted was weird and was rushing, he even didnt give me time to read what was in that N-14 and to ask about anything. He even kept asking what's in my wallet and if i have more IDs, like my drivers license, Green card and passport weren't enough for him. He was staring in my wallet when i opend it and kept asking what was this, what was that, he saw my bank card and wanted to check it.

    Hmm!! that's weird. Did your IO made you sign paperwork after interview? did he/she say something like " that is going to be on your naturalize certificate"? Did IO said, when next oath ceremony going to be? because mine IO asked me to go over the paperwork and she wanted me to make sure everything is correct on the form and made me signed and she further said " this is going to be on your naturalize cert". But then she wanted to see some additional documents to make a decision. She further said " oath ceremony for January is already filled. Her assuring words are only hopes on my case.

    Did your IO said stuffs like mine?

  5. Hi, at the end of my naturalization interview the officer asked me to send additional information by March 21. On March 6 i sent the documents and they were delivered on March 7. since then i've not heard anything from them. Do they usually send a notice saying they received what you sent? i didnt get anything and the status online didnt change.

    Ditto!! I had my interview back in January and was handed N-14, due to which i respond was mid- February and I submitted the response one week before the due date. Ever since no updates. Its has been over a month i submitted my RFE response and almost 2 months that i had my interview. No response nothing. It seems like my case is going in black hole. :crying:

    Has your status changed to "RFE received"? because mine has not even changed even after one month of RFE response. Mine status still says " on this date, we have sent you a request of evidence"

  6. Some times their web portal is not updated. Dont worry since you completed the interview you might receive a letter with oath date.

    Even if web portal is not updated, shouldn't customer service representative have more visibility than what is displayed on the web? When i called yesterday, he told exact word by word what was on the web.

    If they told you to wait 90 days after the interview, if it's me I'd wait for the 90 days.

    I would wait, but that would be 8 months time frame. 3 more months then a normal processing.Its very frustrating how USCIS operates. :innocent:

  7. I had N-400 interview on January 12th at Houston office.I was issued RFE (N-14) due date to response was feb 12th,Houston office received my RFE response on 8th feb (through fed-ex). It has been over three weeks, my status is still at "request of evidence" stage. I have read on many forum that status changes to "request of evidence received" after they receive the RFE response. Is it likely that, they haven't received my response? or have they lost my response letter? I am little worried as i am planning to travel mid- April.

    I even called the customer service and i was told to wait 90 days after the interview to make a decision on my case. :crying:

    It has been over 5 months since i have submitted my application, should i make an online inquiry on my case?

  8. Online status is still showing request for evidence, I had submitted my RFE response for over a week(fedex confirmed that) yet Online status has not changed ever since. Is that a normal process? i read that once they receive RFE, online statues changes to Request for evidence received and in process.

    Does anyone how long does it takes to change the status?

    How can YOU file "married filing separate" and your wife file "married filing jointly" Did you both amend your returns?

    You have done all that you can, you cannot change the past so go with what you have and hope for the best. No, no one here can tell you what USCIS will decide.

    Yes, We both amended our taxes and we are getting some refund back. The list of documents i sent are as fallow.

    1. Lease together from the past three years
    2. Recent joint bank statements
    3. Electricity bills on both our names
    4. Car Insurance showing both of our names
    5. she listed as beneficiary (100%) and dependent in the company i work for.
    6. She listed as spouse under health insurance from my company
    7. Her Medical bills under my name from my employer.
    8. 2008, 20009 tax transcript filed as married filing jointly
    9. 2010 tax NOW amended as "married filing jointly" and IRS Stamped showing as received.
    10. 2011 tax papers married "filling jointly" which we recently filed
    11. Apartment renter's insurance under both of our names
    12. And other more documents

    If i denied, Under what ground would i be denied, I didnt lie nor anything. never arrested nor criminal charges against me. I am really worried.

  10. If they refuse you, you just sit tight and wait another couple of years and file again on your own after you've had your green card for five years.

    I am not worried about denial, what i am worried is my lawyer, he said USCIS may charge me for Sham marriage. And by the way we been married for almost 4 years and we are still together. Its been really hard times for me. first, my wife health is really deteriorating, and second,medical bills piling up at the same time, i am going through this allegation.

  11. gmail.com - There are people more experienced in this forum and can answer your concern better. However, it looks like you did everything right from your side, including accepting the child that is not biologically yours. Btw, do you have children of your own through your wife?

    My hunch tell me that you might get approved. Do wait and keep your fingers crossed. Please update if your status changes or you get email/text from USCIS. Hang in there, you seem to be at the final stretch.

    We do not have children from our own. She is my only children that we have. I will sure update, once i get response from USCIS.

  12. I was married to USC on April 2008 and was granted a Conditional green card on November 2008. My USC wife got pregnant and we had a baby in May 2009. I found out the baby was not mine during the time of delivery and we had the biological father singed the paternity. After some emotions break down and guilt feelings we choose to live together and happily live thereafter. Later that year (2010) we decided to file for ROC and we listed the new born as our children. It got approved, though we didn't send our children Birth certificate. The documents we send were two years IRS tax transcript (2008, 2009), joint bank statement, lease, utility bills, and other stuff.

    Last year (2011 February) we had some financials issues and my wife choose to file her taxes on her own; she was misguided that if she filed head of household, she would get more return rather than filing Married filing separate. She at that time did not know who files the head of household and I never bothered to look at her tax papers. I however, filed married filing separate.

    I Filed N-400 based on three years of marriage to USC, which we are still living in a good marital union, so does my step children. I had my interview last week. I passed History and English test. When it came down to children part, I said we had children born out of our marriage. She made me sign my picture and form and asked if everything looks ok on the paper and also said this is going to be on your naturalization certificate and handed me a paper saying, decision could not be made yet and I passed history and English test.

    I got RFE two days ago, asking for Birth certificate of our children and my US Spouse last year Tax return transcript (head of household one). We amended her last year tax return to married filing Jointly from head of household last week ( we are getting tax refund and not due) and we filed our this year taxes for 2011 as well.

    So I already sent the response to the RFE, Birth certificate of our children ( Paternity not signed by me) and amended tax return 2010 (IRS stamped shown as received) as well this year tax showing Married filing jointly and send out her recent medical bills of $5000 under my name from my employer.

    Now I am wondering. What are the chances that my petition be approved? If it gets decline under what ground would it be decline and what’s my next step is going to be? IO was not very happy during the interview, however he said there is oath ceremony next month. Is that a good sign or it’s a normal procedure to let applicant know abt the oath?

    Sorry for the long question.

  13. USCIS can deny you. You being pregnant by another man gives them the idea that your relationship isn't genuine. If you apply for USC at the 3 year mark they could assume that he helped you only so he was doe with the I-864, and the relationship would end once you get citizenship. You would be better waiting until the 5 year mark and applying on your own. That way your relationship isn't a question.

    What if I-864 is signed by third person and not the USC?

    I am actually in the same boat.. three years ago, my USC wife had a child from her dead ex- BF(paternity signed by him on child Birth certificate). We worked out our relationship and happily living there after and filed ROC with the baby name on documents and got approved last year. I love her to death and we are still living in good marital relationship.

    I filed N-400 three months ago and had my interview recently where i was asked to present my daughter Birth cert (RFE). which i submitted last week and now i am waiting for the response. My wife health is deteriorating and i had under my health insurance of my company and had a medical bill of over $5000+ , which i had submitted alone with it and at the same time we had also filed our taxes ( 2011 ) married filing jointly and submitted that as well.

    I am just as worried as you are. lets see, how will this play out for me.
