  1. So after continuously calling the Deferred Inspection Site at Tampa airport and getting stuck with the same completely unhelpful telephone operator, I managed to speak to her supervisor who put me through to CBP, Strait away the officer took my details and told me to come in today at 11 am...

    When i arrived at the airport there were three other people who had also had the same issue, and not fount it until they had wasted journeys at the SSA... 20 minutes later I was out of the airport with my I-94 in hand, on route to the SSA.

    Now at the end of the day I have my I-94, my Social Security Number on its way in the mail and a cold beer in hand!

  2. Okay, so you need to go back to the airport or a deferred inspection point. http://www.cbp.gov/xp/cgov/toolbox/contacts/deferred_inspection/

    Having a valid ESTA does not preclude a person from entering on a K-1 visa. You should have been processed on your K-1 visa (what does your stamp say in your passport?)

    So you need to figure out if you were processed as a K-1 or on your ESTA (this is actually the Visa waiver program), and get processed on the K-1 visa and get a I-94. You need I-94. It will not cost because it is their error. You cannot use ESTA or anything like that for a SSN, and you need to be processed on your K-1 to move forward in immigration.

    What stamps do you have?

    Just spoken with the Tampa deferred inspection team who said I can use the ESTA, My K1 has been proceed as it has been stamped, I just need to provide my ESTA approval print out to apply for my SSN

  3. Ok, so I arrived in the USA three weeks ago, wet through customs, they took my brown envelope, processed it, gave me my passport back and sent me on my way to my new life in the US...

    Yesterday I went to get my Social security number as directed by the process work flow on this site, when I got there the woman behind the counter said I need a valid I94...

    Not actually knowing what this was (I thought it was the bit stuck in my passport by the embassy) Turns out its not, that is my K1 that has been stamped at POE but not my I94, so after a lot of hassle, a trip to the airport to visit Customs and Border Control, It seems that I was admitted on my previous ESTA... Customs told me I wouldn't have received an I94 because I was previously registered on the ESTA program...

    She told me if I want an I94 I will have to pay $320 for it!!

    So now I am at a loss and don't know what to do? Am I now here illegally? How do I apply for my SS number without an i94? Can i use my ESTA details instead of the i94?

    Can anybody help me?

  4. Finally heard back for our interview date, but I was extremely suprised to find that it was scheduled for November 15th considering we submitted packet 3 in late August. We had already planned a wedding for November 23 and family have bought plane tickets assuming that this process would be long over by then. We never thought that the interview could be scheduled almost 3 months after we submitted the last of our materials to the embassy considering what others have experienced on this website. Does anyone have any experience/success moving up their interview date? Thanks!

    I had not received an interview date up until last week, I spoke with the embassy who gave me an email address (not the usual one, and not one you need a code for) to let them know I was available for a cancellation appointment or last minute interview appointment. I sent the email on Thursday evening around 10pm, by lunch time on Friday they had replied and assigned me a date for the following Friday (tomorrow). It may be worth calling to try to bring it forward.

Called DOS again today (and yesterday and the day before) still awaiting an interview date (The guy on the phone yesterday confirmed that my application had been processed and I was eligible for interview)... Why cant they just assign me one, I don't care how far in the future it is I just want a date so I can start making some plans!!!

    Just a note from my experience, if you call in the morning (ie 1400 UK time), the call centre operators are grumpy as hell, if you call around 1900 they seem to be a lot more helpful!!

  6. Ive called them nearly every day since, I called today and again still no interview date! :angry:

    If it's been over a week since you last called, you should try calling again this week. When I called to confirm they received the DS forms, I was given the "eligible for an interview" line as well. Then, I called back the next week and they had the interview date/time.

  7. My apologies I just need to rant for a moment!

    Im getting really frustrated... its been six weeks now since I submitted my packet 3, the embassy confirmed receipt of it two weeks ago, then when I called over a week ago said I was eligible for an interview but say they are waiting to assign me an interview date...

    Other people who submitted their packets after me have been assigned interview dates, should I be concerned?

  8. Yeah i put my email address on it. I dont think they will email first though. I keep up with a few more DCF people on another site (there seem to be very few over here!)and they all seem to have received just letters.

    Just out of interest, what site are you talking about here?

  9. It seems to be taking around 4 weeks just to log packet 3's at the moment, then you have to wait for them to issue an interview date. I can only guess it is because of the Olympics and a backlog of non immigrant visas (as DOS told me they stop processing non-immigrant visas during July and August).

    I'm confused about one thing and need your support ASAP. My interview is on 21/09/2012, I've submitted all the documents at the VFS and ready for an interview. We've already paid $350 visa fee while filing the petition back in Jan, 2012. I'm so worried please help me out with this, I just want to know wehther I've to pay $240 as a visa fee again at the US consulate, Mumbai on the interview day or not?

    Yes you do, the $350 is to process the petition (I-129F) and the $240 is to actually get the K1 Visa.

  11. I sent mine on the 18th Aug (But not recorded) and nothing yet, called DOS who said nothing has been logged, got a little worried at the start of the week and resubmitted it (This time recorded delivery) all with a cover note, hopefully this shouldn't affect my visa!

  12. Correct. The I 864 for AOS has to be filled in by her, even if she has no income. You can use a joint sponsor if needed. That's a second I-864 from them. Your wife will need to send a US tax return with the I864. If she was not aware that she should be filing from out of the country, get a 2011 tax returned filed now so you won't be delayed sending AOS. Or if your AOS won't be mailed until after 15 April 2013, then it's the 2012 return.

    Yeah we found out she need to file her Tax return, She tarted working in the UK at 16 (never had a job in the US) so didn't realize until we started the K! process that she should have been doing tax return all along!

    Ok thanks for that, makes the form filling simpler (for us at leas).

    So we don't need to show any evidence of my fiancees income? no taxes nothing, will just have to do this at AOS (hopefully she will have some kind of job by then)).

I am in the process of filling out the I-134 Affidavit of support forms in anticipation of my interview, as both myself and my fiancee will be moving to the US to get married (We currently live together in the UK but want to get married in the US - We went through the different options available to us (K3, DCF etc...) and the K-1 visa suited our situation best).

    My fiancees parents have agreed to be co-sponsor for the visa requirements as neither of us will have jobs upon entering the US. So do we fill out the I-134 forms with this in mind, as my fiancee is the petitioner, she will have be the primary sponsor with a $0 income (even though she has a job in the UK that she will have to give up when we move), then the co-sponsor will then also file an I-134 with their supporting documentation, is this correct?

    I hope this makes sense as its a little confusing as our situation is obviously different from the majority.

Ok, so as the title says we need some advice per the re-establishing domicile requirement, My fiancee is a US citizen who moved to the UK when she was 16, has lived and worked here for 10 years (five of which we have been together). We are now applying for a K-1 to get married in the US mainly because she wants her family to be at the wedding.

    We are not really sure how we can prove we intend to live in in the US as she cant really get a job offer before we move to the US, I have tried to apply for jobs but without a greencard nobody will even entertain me! We have handed in notice on or rented flat which we can show, she is also going to register to vote in FL, get a library card, and we are going to get a letter from her parents to say we intend to initially live with them whist we get ourselves sorted out.

    Se no longer has a bank account in the US and don't think she can open one from the UK? I may be wrong? But she does have US Bonds in her name? would these be any use of proof?

    Has anybody got any other experience of this whilst applying for the K-1 rather than DCF?
