  1. Hello,

    My husband and i just had our AOS GC interview. AWESOME we got approved. This is what happened...

    Arrived , Cherry Hill USCIS @ 07:30 - A full hour early they dont open till 08:00

    Went in @ 08:00

    Dropped interview letter in the window and sat down

    Got called by 08:30 went through to the back and took the Oath.

    Officer asked:

    When we met

    When we Got married

    NON USC social number

    Went through the questions (a you a communist etc)

    Documents officer asked for (and Kept):

    Marriage certificate - COPY

    Copies of bills in both names (only had phone, savings account) -COPIES

    I129F Approval NOA - ORIGINAL

    I94 from NON USC passport

    Documents officer asked for (and handed back):

    NON USC passport and Drivers licence

    USC Drivers licence

    NON USC passport - STAMPED WITH USDHS permanent residency for ONE and Work Authorisation!! and the letters hand written (CF1)

    She then said "ill see if you will be approved" , she punched some stuff into the computer and handed me a letter saying...

    Pursuant to section 216 of the immigration and nationality act you have been granted conditional permanent residemce........ You and your spouse must file a joint petition (I751) to have the conditional basis of your status removed. The petition must be filed within the 90-day period immeadiatley preceding the second anniversary of the date you were granted permanent residence status..........

    That was it , we spent most of the rest of the time talkin about local restaurants!!!

    We did NOT have to show any other proof a relationship , no photos , wedding cards - NOTHING , we did however have all that stuff with us , WOW ...

    It all took about 20 minutes (10 minutes of that were talking about local restaurants!!)

    VJ'ers out there , you guys are the best - it is possible to do this without a lawyer - but not without VJ , you guys are amazing, we thank you all from the bottom of our herts.

    i was just reading a checklist on the forum, i appear to have everything listed but i noticed that i never recived an NOA for my EAD , i have the EAD card and the extension mailer - should i have a I797C (NOA) for the EAD card? The USCIS website says that one was posted out to me 08/28/06 - strangley enough thats the day i got my EAD card in the mail. Has this happended to anyone else ? do i need the NOA EAD which i didnt get??

    I (NON USC) and my wife (USC) have our greencard intervoew on August 30th (nervous!), my wife is my primary sponsor (we have a second one too).

    My question is if my wife decides to quit her job and possibly go to college AFTER my GC is awarded what happens to the I864 Affidavit of support from her . Do we have to tell them, do we have to re-file , does it matter ,whats the story??

    Any help would be greatly appreciated.

    OK we tried the information line they said.

    1) you do not need to file the whole I864 again - just end in the paystubs.

    2) as my tax returns for the last 3 years DO NOT show 125% of the poverty line then you should consider a co-sponsor. They are trying establish a "normal" level of income even though you only have to "currently" make it.

    3) When you send in the paystubs IF you use a cosponsor, send a letter saying : if needed please use the co-sponsor I864 ....(or words to that effect). IF it all goes through and the co-sponsor is NOT needed this will be discussed at interview.

    so - i guess im gonna send in the paystubs (fingers crossed) and send them a co-sponsor I864.

    NOTE: the lady at USCIS (Ruthanne) also said get a reply sent ASAP.

    OK im going to try the information line (hope they can help), just one other question. I have changed my(USC) name to my husbands , the original I864 (I485 etc) had my maiden name - if i have to refile the I864 should i use my new married name or will this confuse things??

  6. I don't think pay stubs are expilicitly mentioned in the I-864 instructions. I think most send them as supplemental information to the employer letter.

    We also got the same RFE letter and concluded that the only thing they could be asking for was my 2005 tax return. Which years did you already send?

    Hi, nope pay stubbs are not mentioned in the RFE either - ????? we got the 2005 taxes done real early and sent those in too, it appears that a few people have had 2005 tax issues. Would they you what is missing if we scheduled an info pass appointment??

    I posted a few days ago about the RFE we received, well its finally got here now! so they sent the one that says.

    F. (11) we are unable to determine if your household income meets or exceeds the 125% of the federal poverty line.......

    -now i make enough as the USC , my husband has proof of assets in the USA (well in excess of the 5x the difference as they ask for), so i was wondering why the RFE? i checked the opack we sent in and we forgot/neglected/stupdily missed out (take your pick) any paystubs - everything else W2's/letter from employer/ IRS statements was in the pack. Would they really RFE for forgetting the paystubs when everything else is there? The thing is i only just started making enough this tax year and as such my previous 3 years tax stuff doesn't show enough. Has this happened to anyone else.

    Should I:-

    1) resubmitt the whole I 864 and get a co sponsor(another I864): to be on the safe side?

    2) just submit the paystubs?

    3) resubmit the I864 just by ourselves (with no co sponsor AND the pay stubs) ?

    :unsure:

    I feel a little better about this now as at least i know what is wrong - the wait for the RFE was terrible - not knowing what to do etc...

    any advice anyone.

  8. Since your eligibility for the EAD is dependent on your adjustment status, the EAD will not be issued while USCIS is waiting for the missing evidence for your I-485. Additionally, as you will see on the RFE letter when it arrives, rather than being eligible now for an interim EAD after 90 days of receipt of the EAD application, you will not be eligible until 90 days after the USCIS receives your RFE response.

    We're in the same situation. :(

    It's been almost two months since biometrics and not even a touch on the EAD...

    Hey, im sorry to hear your in the same boat as us - i wish they could make this a little less confusing/aggaravting/depressing (take your pick). Take a look at the post from paul and melanie in this thread - they seem to think it shouldn' matter.

    my hubby just got an email from USCIS saying that and RFE was sent out on the 27th april for his AOS , we have not received the RFE so we dont know what they want. He is also applying for an EAD. Firstly:

    1) will the RFE for the AOS slow down the EAD?

    2) The last paper communication from USCIS was to schedule his Biometrics - bio done on 04/20/06, should we have had any NOA's saying the case has been transferred to the local office - or is it still in missouri??

    we are confused , can anyone please help - im not sure we are getting the right info from USCIS. Below are the current online case status's.

    yep we sent in the I864 with the AOS - we thought we had the package nailed you know!

  11. I am in the same situation. They don't care about the USC's name for biometrics. Your name matters for the affidavit of support. I haven't actually told them yet that I changed my name to his, but we are about to move so I'll do both at that time.

    I know that when you move you have to tell USCIS using the AR-11 form , do you know if there is a form for telling them that my name has changed to his? The affidavit of support and everything else has already gone to USCIS and the checks cashed , does anyone know if telling them this now will cause any problems.

    this is our first post on VJ , up till now everything has gone really well (I129F K1 etc). The question i have is :

    Does it matter that my old (umarried) name is on all the AOS paperwork that we have submitted, but i have now changed my name to my husbands? I am the USC , will this cause any problems at the interview. My Husband has his boimetrics (for EAD and AOS) appt in Philly tomorrow.

    Any info please - im a bit worried.
