  1. Been calling USCIS many times in the past few weeks about my wife's GC and finally got to a lady who actually been able to help me out. She answered many of my questions that I had. Finally today I sent out my GC back to USCIS in Dallas TX. We will see how long it will take to get the correct card back.

The lady @ USCIS told me that there were many GCs sent out between July and August with errors. She even told me I don't need to fill out I-90 form because of that (but I did sent out form I-90, just in case they need it). USCIS is aware of the errors that they made during the month of July and August.

I WOULD RECOMMEND EVERYONE TO CHECK FOR ERROS ON THEIR GC WHO RECIEVED THEIRS IN JULY AND AUGUST!!!!!!!! The dead line to send the Green Cards back to USICS is September 20th of this year.

  2. Check my GC today for the category and it is in Category IR0. Looked to see what that means and it means "Parent of a U.S. citizen". We don't have kids yet but am pregnant and we are expecting our baby mid September of this year (another couple weeks to go).

I came here on K1 visa last year in September and we got married same month (which is under 2 years).

Do you guys think that is the reason USCIS sent us a 10 year GC of our baby that should be here in the few weeks??

  3. Hello everyone,

After a few weeks of research I still not sure what to do with my wifes 10 year GC. I called USCIS and been on hold for 90 minutes and got no answer from them. We should of received a 2 year conditional GC since we are only married 11 month and she came here on K1 visa.

Should I go ahead and fill out I-90 and send my wifes GC back to National Benefits Center (NBC - since our case starts with MSC) or make an infopass via USCIS and go see our local office here in Chicago???? Hope to hear something from somebody.

    Thanks in advance.

DOES ANYONE HAVE AN ANSWER TO ABOVE QUESTION?

  5. You need to change your card. You can get in a lot of trouble, like cancelled LPR status for not removing conditions. Your card is a 2-year card, just that the date is wrong. Everything else in USCIS knows it is a 2-year card. Send it back for the correct card. There is at least one thread on here about the nightmare someone endured for not letting anyone know of the error.

As usual some people don't know what they are talking about and just stir up trouble.

I bet many people don't know and they just keep the green card it was sent to them not letting USCIS know that they made a mistake and later they found out that they are in trouble for someone elses mistake. This is just not fair.

  6. You got married 2012-09-21 and received your GC 2013-08-05. You only waited 9 months. Meaning, your GC should only be 2 years not 10. But you are lucky. But then, you can check USCIS why did you get a 10 years since you have been married for only 9 months now.

    Here's my case:

    Enter US as k1

    Married June 1999

Received Green Card July 2001= Took 2 years for them to send my GC but I got a 2 years. Supposedly, I should have got the 10 years.

To make it short, bcuz i didnt check with USCIS, I ended up hiring an attorney which drained my pocket for $6 grand and EVEN got denied.

I had to contact Senator to have my status straighten out.

I do not know if calling Senator did help but sure I got my corrected GC in the mail just 6 days after contacting senator and 7 days after the denial.

Anyways, my point is you are not married for more than 2 years yet and your GC should be 2 years not 10 but then again maybe you are one of the lucky ones.

will check with USCIS this monday. Thanks

  7. Because you have the wrong green card.

You are supposed to have the 2 year one and remove conditions in 2 years - you could get yourself in trouble if you dont fix that even if it was their fault.

I will call USCIS on Monday and see what they say. I hope they did not make a mistake (I do know that I was supposed to get a green card for 2 years). Oh well.

What Peter_Pan said.... You were supposed to have the 2 year conditional GC, a mistake was made and you got one stating 10yr. If you do nothing and assume, because it was someone else's fault, it will come down to the fact that you should have seen the error and done something about it. By doing nothing, I would imagine that can be constituted as fraud, and thereby if you apply for citizenship, you would be denied and possibly deported and banned for it. As I stated previously, this has happened several times recently, and the consensus is to contact the government to have it straightened out. Besides, you are due to ROC in 2 years, so they will find out, either if you don't file or when you turn your current card in during ROC. You can be honest or lie by omission. That's your decision, but be prepared for the consequences/

Will be calling USCIS on Monday.

  8. If you have been married for MORE THAN two years when the Green Card is issued, it will be a 10 year card. Congratulations, by waiting you avoided the Removal of Conditions.

    wrong.

they have been married more than two years, she gets a 10 year card.

Actually we got married last year in September. So this is still under a year. Maybe USCIS found out that we are expecting a baby mid September. dancin5hr.gif

Now the date in s2kroma's timeline shows 2012-09-21. s2kroma, when did you get married? Did you get married within the last 2 years? If so you should have received a 2 year green card and should contact the USCIS about your green card. If you got married over 2 years ago then the green card is correct. Hopefully you can clear up the confusion here.

That's correct, we got married last year September 21st.

Your timeline says you were married in 2008. You are fine. Ignorant people responded to your thread and did not check your timeline. You are good to go and do not need to contact anyone.

Three years from the issue date of this card you can apply for citizenship. This is why we have public forums so wrong people can be corrected. You will not need to remove conditions.

    Congratulations

The only downside is that you could have been a citizen by now. Oh, well.

I think my timeline says September 21st 2012 which is under a year.

  9. I'm thinking (and hoping) that this theory seems to be true, everyone but UK K1's are getting interview's. I've heard nothing and I filed at the end of October.

Oh well, back to waiting

No worries there. I am also on K1 visa (which already expired long time ago) and I am not from UK. I submitted my AOS back on October 30th, had my bio done at the end of November. Didn't hear back from USCIS since then. I submitted my AOS to Chicago IL but looks like my paperwork were transferred to MO for some reason, don't ask me why. Maybe someone here on VJ knows why they transfer the papers to different field office?
