Well I haven't ask for a supervisor yet but had the info pass on Tuesday of this week. All they told us was that they didnt have the file in front of them and to wait for a reply for more evidence or a denile letter. I could tell the person behind the glass didnt want to show us any customer service skills. He seems to be more irritated as I tried to explain our situation. This whole process is broken, it embarrasses and insults me as an American Citizen.

Oh I have contacted the 800 customer service number many times. It seems like the person on the other line is reading off the computer screen and that is the only information they can give out. The notice on the web site has Oct 18th information about receiving my reply but I feel it's dead in the water. Funny thing is that USCIS and the VISA center accepted my wifes certified copy when I filed her I-129F, and when I file a I-130 for her daughter in 2008 and her 2nd daughter in 2010 and also it was used when she gained her Naturalization in July of 2010. Go figure......but you can fight "City Hall". I am about ready to give up.

My wife is a naturalized U.S. Citizen and filed an I-130 for her Mother in August of 2011. Around Oct 7th we received a request for more evidence from the Vermont Service Center. The reason was "The birth certificate submitted on behalf of (your wife) shows that the birth was registed on September XX, 2006, 29 years after the actual event occured. The document submitted as evidence of relationship was executed so long after the actual event in question that it has insufficient reliability and weight, alone, upon which to grant this VISA petition. Therefor you must submit additional documentary evidence"

A couple thing are confusing me. In the directions for completing the I-130 it says that in this case my wife only need to supply a COPY of her birth certificate. She supplied a CERTIFIED COPY from her Governments General Registrar with a Government Seal. She obtained this certified copy back when I was filing the I-129F for her in 2006.

On this Certified Copy it states the my Wifes birth was REGISTERED on September XX, 1977 and at the bottom of the document it shows the date it was EXTRACTED from the government record on Sept XX, 2006

Am I the only one confused by USCIS's wording? They say the document was registered 29 years after the actual event, NO it was Extracted 29 years after the actual event. Of course it's after the actual event.......it's a certified copy not the original. It's what they requested in the directions. To make matters even worse my wife is from a small republic in the South Pacific and when someone is born on those islands there is nothing more that information written into a log book thus there is never an original birth certificate like we are used to in the U.S. It is alway a certified copy with an extracted date on it.

I called the U.S. Embassy in Suvi Fiji for clarification and they tell me the USCIS in Vermont is mistake with their decision and understanding of this certified copy. They have emailed the Vermont Service Center with their verbal input two months ago but we have heard nothing back yet.

Can anyone help us with this?
