  1. Me and my Fiance met 15yrs ago thru our church we have in Ensenada, Mexico (its 45min frm the border to San Diego). I live in San Diego, CA and my Fiance lives in Tijuana, Mexico. It literally takes me about 7 minutes from my house to drive & cross the border by car to Mexico. I cross the border quite frequently during the week, so its quite natural to come & go often. That's how I get to see my fiance during the week as well. Its easier for me because I have the "Sentri" pass (with it you cross the border much faster than going thru the normal line). Anyways, I got a RFE...they are asking for the "primary evidence" which is airline ticket stubs, passport admission stamps, receipts, etc. I dont travel by air or train to go see my fiance. So how the heck can I prove the requirement of meeting him within the last two years? I have some film dated pictures within the last two years, but in the letter its considered as "secondary" evidence, and so they're looking for the primary evidence. How the heck am I supposed to do this?!!! I tried calling the USCIS but the wait time is kinda long, so I'd wanted to see what the suggestions are here first. Help!! :) Thanks!

  2. for some reasons i'm seeing you're filing for F-1 Visa on your profile. Anyway we got RFE for that too. When we first filed, both wrote pretty much a five paragraphs letter of how we're in a relationship and would like to get married as soon as our visa's approved blah blah blah.. But never stated the specific date of getting married w/in 90 days. When we replied the RFEs we both used the sample letter from VJ fiace(e) letter of intent. http://www.visajourney.com/content/examples Hope that helps. Good luck.

    YEAH I USED THE SAME EXACT ONE!! THAT'S WHAT KINDA CONFUSED ME STILL!! I'M NOT SURE WHY THEY'RE ASKING FOR THIS AGAIN :/

    Type written should be okay. Did you use the names in the content of the letter? Such as I -------- plan to marry -------- within 90 days of arrival.

    I sure did make sure to use the example you stated! So that's what prompted me to think that maybe it should have been hand-written instead?? Oyy!

  3. I got an RFE stating we both have to submit a "letter of intent", an original statement (signed & dated) indicating that we plan to marry within 90 days of my fiance's entry to the US. The thing is that initially I type-wrote two letters of intent, one from me and the other for him, and I signed mine as he did his. I'm not sure if USCIS wants the letters to not be worded the same?? Cause they were each definitely signed by me & him. Any suggestions?? Also, can he hand-write them or does it have to be by computer only?? Thanks...

  4. Anything older than 2 years is meaningless to the adjudicator. They don't care about any of that, and probably won't even look at it. You need proof of meeting WITHIN the last 2 years, if you didn't submit the proof, than that is probably why you have an RFE.

    Did you actually see each other within the last 2 years and do you have proof of that?

    Yeah we've definitely seen each other during the last two years, a couple of times during the week. I live right by the san diego border so I tend to cross the border to tijuana quite a lot. The only thing is that we've never really saved receipts & stuff, or have had anything with both our names on it. We've definitely done stuff together, but all I really have are pictures. I do have more recent emails that I can use to show ongoing relationship & that I will use.

  5. What did the RFE say exactly?

    I havent gotten the paper notification yet, only by email, which states "we mailed a notice requesting additional evidence or information in this case I129F". It also says "a request for evidence is made when an application is lacking required documentation/evidence (additional evidence) to determine an applicants eligibility for the benefits sought".

  6. Pictures is secondary evidence. They don't care about your emails from 8-10 years ago. What USCIS cares about that you've seen each other within 2 year time frame prior to applying. This could be anything like passport stemps, boarding passes, hotel reciepts, credit card reciepts. And remember pictures are NOT primary evidence. If the response satisfy the adjudicator the RFE usually getting processed within few weeks, and hopefully you will get approval after that.

    What if the receipts dont have my fiance's name on it? Can I still go ahead and add that?

  7. I have already included pictures from when we met more than 10yrs ago and recent pictures too. I provided with a copy of the receipt from the venue we will marry, emails from 2004, 2005, 2006, and of course pictures. I dont have receipt of engament ring and I dont have copies of receipts of when we had traveled some time ago. This sucks!! Will it take another 5months to process the RFE???

  8. Thanks soooo much for the reply guys! Its very helpful. I am so annoyed I didnt realize this sooner. Ok, so I'm now fully aware that he would not be able to leave the US (unless he'd get approved an AP of course). So here's the thing, I got my first NOA1 dated 2/24/12 and still waiting for my NOA2. Based on the date of NOA1, do you guys think we'll get my fiancee's Adjustment of status done in time for December 2012??

  9. Okay, so it just dawned on me this question. My fiance is from Tijuana, Mexico. We were hoping he'd get his interview for his Visa by this coming October so that he can be in the US at least by November for us to get married legally. The thing is that our wedding is in December 2012 but IN Tijuana mexico! I guess in the back of my head I figured he'd be able to cross the border back to Tijuana since he'd already have his K1 Visa still unexpired. So, does that mean he wont be able to cross the border AT ALL until he gets his status changed to permanent resident??????!! (would that mean that we couldnt have our wedding in December in Tijuana??) :/ I read he can apply for an "advance parole"...but from what I read is that it would take months for that to get reviewed!.....HELP!! I need some clarification/advise!
