The section I put in bold is not a correct statement because if a petitioner were to list an Embassy or Consulate that does not conduct K visa interviews, the NVC will not send the petition to that Embassy or Consulate, they will send it to the proper Embassy or Consulate. An example of this would be if a beneficiary lives in China and the petitioner wrote Beijing or Shanghai on the form. Since K visa interviews are only done in Guangzhou, the NVC would send the file to Guangzhou, even if the petitioner wrote another location.

    "Approve the visa" is an incorrect statement. The NVC does not approve visas, they function as intake of documentation prior to the file being sent to the Embassy or Consulate for the interview. The decision on whether or not the visa application will be approved is made by a Consular Official at the Embassy or Consulate.

    Your suppose to know if the Embassy you select on your form can do a K visa process/interview before you file it.

    NVC assigns, qualifies you, reserves, any way you want to put it, a visa, The Embassy is the final approval. The Embassy has the final say. National VISA Center makes available a visa in your case and the Embassy interview approves it.

    Musashii you can post here, or anywhere. You all should try to understand this person. I agree tone down the language. But also, try to understand someone else's frustration and let them come here among friends and fellow petitioners and let them vent a little. They filed their forms in December. Musashii just take this whole thing 1 day at a time. Its all you can do for now. Just think of it this way. Everyday that goes by is 1 day closer to the end. When you wake up the next day say to yourself "ok i'm 1 day closer to my approval".

  3. Expedite request ? I seen people get expedites approved but most of the time they deny them. And seems like some of the requests that sound like total BS get approved LOL. This 1 girl in Philippines got a expedite request approved. This was her reason. She was married to a USC and he lived in California. Her aunt also lived in California and I guess was a USC also and her aunt had kids like under 10 years old kids. Anyway she said she needed expedite because her aunt had joined the army and was being deployed to Iraq and her aunt needed her to help take care of the kids who would remain in California. USCIS asked to see the deployment letter from the army and she sent them a copy,she was approved. To me this sounds like BS but it worked for her. But you know an expedite only really saves you a few months at best, you still go thru the same NVC process and Embassy process.

  4. Sometimes people get NOA2's faster , depends where the beneficiary lives. Also I noticed people who are married for a while get NOA2's much faster. For example, this Nikkita person has been married since 2007 . When people are married that long already they get a faster process. I been thru all of this 3 times in my life, this whole process from petition to green card. This is my experience. If you keep calling USCIS your going to end up taking much much longer to get processed. If you think this phase sucks now, wait til you get to NVC process. The NVC can have you pulling out your hair if you call them. They will tell you they never received your papers you sent in, dont have your file, need more evidence, and all along they have it and its being processed or its even approved already. LOL everytime you call you will get a completely different story.

  5. Big question!do i have to wait for the packet with instructions from the cconsular?or i can just straight up apply?because if it is so im dumb because ive had our MNL case number for a month now.

    and also how many days do we have to wait after her medical to be able to get an interview?can we do it a day after the medical?

    you dont have to wait for packet, u can print it from the us embassy website, there is a link there.

    I heard St Lukes wants at least a week to send everything to Embassy if she passes the medical. I think they publish 2 weeks waiting time. Call them and ask if possible.

    sorry again for this questions but im starting to worry again.On feb 22,2012 i received a letter saying that "within a week the petition will be forwarded to the appropriate vissa-issuing post". My question is what is next because until now we havnt received any word from them. Should i call them?

    i also have a planned vacation going back to the pilippines for 3wks thats when im gonna pick her up April 25- May 16. Do you guys think thats a feasible time that we would be able to get her visa and be able to bring her here in the US?what do you guys think?

    She can use a copy of that letter with your MNL number on it to go and take her medical at St Lukes. Eventually Embassy in Manila will have you in the system, takes a few weeks sometimes, then you call their appointment line and make your appointment for K-1 Visa interview.

  7. Hi Guys Just a Quick Question... For the Interview, Does my wife have to go with me? Or Do i go by myself?

    Ask the Embassy, it varies from Embassy to Embassy. In Philippines both can attend the interview, some other countries say no, some say yes. I guess depends on factors such as room(size of the embassy)

    My wife said there was a protest at the US Embassy in Manila few days ago and people where even throwing rocks at the gates. People are mad that the embassy and US Govt are taking too long to process visas and also many complain that the embassy does not approve visas for good people yet they approve visas for undesirables and criminals.

  8. hmm interesting. Typically any funding from government takes too long to make a real effect on government department after some time. But I hope it makes a quick impact on USCIS.

    They said USCIS stopped getting money like back in July2011. In Feb 2012 they started getting money again. This is what they said.

    I think many people where really complaining. I been thru this whole process before and it never took more then 7 months from start to finish, visa/greencard in hand. Now I see people waiting 7 months for NAO2. its crazy!!!!!

  9. I am not aware of any fund increase to USCIS. Can you share the link for this info?

    i heard on news last month that the reason for 6 months of backlog at USCIS is because the US has been operating on NO budget so they weren't getting any money causing the backlog. Last week I heard on news that the Senate approved something so that USCIS and some other agencies would get some money to start working 100% again.

    They said USCIS stopped getting money like back in July2011. In Feb 2012 they started getting money again. This is what they said.

The one we sent first was a page with nothing write there as "divorce decree" one thing is sure it was not the divorce decree, it had no stamp, no signature, no seal, a paper saying that the divorce will be pronounced after the presentation of some document. and the one we found now is a final divorce decree, 4 pages, with signature of the judge, but still has no stamp and no seal.

    If it was a simple divorce like no kids or joint property etc etc , its possible to only be 2 or 3 or 4 pages. Many States or at least courts don't always require a Marital Settlement Agreement. The official decree will have a recorded info area written on it saying what page/file info which is the Vital Stat info. Usually it says in large letters "FILED" then gives some location info. file number page number etc. Also will have a stamp on last page from the clerk certifying it and may also have a raised stamp/seal.

The I-864A gets attached to your I-864.Every sponsor has to file a I864 no matter where they live. You and any co-sponsors must file an I864. I864 A is an additional form you file if the co-sponsor and you are related and live in the same house or if he claims you on his taxes as an dependent .

    Also, it does say I-864A is optional in your case. If it was me I would just file the I-864A even if its not required just to play it safe. Cant hurt right?

  12. I was under the assumption that both my father and I file I-864, however after reading the I-864A instruction I got confused because I thought it applies to my situation perfectly. I was reading other threads similar to this and found some people saying that if we're living in the same house we can complete the application with me filing I-864 and my father doing I-864A. This is what my wife thought after reading the official instruction as well. Can someone clarify this?

    Tell him to file for Bankruptcy protection. It will wipe out what he owes, wipe out the court liens and help him settle the IRS tax situation. Chapter 7 or 13

  14. Yeah MC Hammer LOL but I think his situation was different. Snipes and nelson simply refused to file a tax return, challenging the US Government if they actually have the power to compel people to file. They learned the hard way. MC Hammer just owed tons of cash but spent it all on everything but his bills and taxes lol. With him I think the IRS just put a lien on his life and took everything he owned, sold it off and kept what money he owed them.

  15. I just started to fill out form I-864. I recently graduated from college and am studying for graduate school right now. I've never been employed so I've never filed tax return either. With this situation we're sending in two I-864 forms (1 from me & 1 from my father) and a I-864A form. There are something I'm confused about on the form I-864.

    my wife has had 3 F-1 visa numbers. Should I list all of them with an attachment paper?

    I don't really know what my household number is. Me and my wife and that's 2, but since I have no income I need to include my parents, grandmother(parents are supporting her financially), and sister (over 21, full time student with a part time job) as well? That would be 6. If so, both my father and I put '6' on item 21 of our I-864?

    It's like since I was born, but should I put my 15th birthday?

    If she has a current a-number list it, if none write in "none". It would be listed on the most recent letter from USCIS if she has one yet. They go by how many dependants your dad claims on his 1040 tax return. If your living with him but he isn't claiming you then you still need to include yourself. So sounds like 6 is the magic number. For yourself just write unemployed. Add a letter if you want explaining what you said here and this is the reason your using your dad as a co-sponsor.

  16. Wow!!! A lot of bad info here at the begining of the thread. Anybody can be a co-sponsor and they would need to fill up the I-134 , not the other since its a K-1 visa.

    She asked also if the fact that her fiance owes money. Probably not.

    She asked if he needs to file his taxes for the past few years. Probably not, if he has a co-sponsor who qualifies to be a co-sponsor. BUT they might ask all these questions at the interview and its not going to look good if he didn't file his taxes the past few years. It's illegal not to file if you owe money. A lot of people dont know that. But the IRS can actually file criminal charges on you and you can do jail time for not filing your income tax if you owe money. Ask actor Wesley Snipes or Willy Nelson if you dont believe me. LOL

My wife had her medical in Jamaica but they only did an X-ray which they noted as negative, we thought she was missing a round of vaccines so i got her another medical stateside where the doctor asked if she had the TB skin test in which she answered no; so he administered one and it ended up being positive. He told her she didnt need another chest X-ray as the last one was fairly recent within 6 months so he filled out the I-693 where on page 2 he checked the box for (No class A or Class B TB) for the X-ray; but put Positive for the skin test that he did.

    I guess my question is will the positive skin result have an effect on her AOS??

    NO , it will be ok. Positive skin test only means 1 of 3 things, 1. she had a TB Vaccination sometime in her life, 2. She was exposed to TB at one point in her life, or 3. She had TB onetime in her life. When the TB Skin test is positive then an X-ray is ordered to rule out if she currently has TB or not. Since she already had a recent x-ray and it was negative then they go by that. You can always get another x-ray to double check if your worried for personal reasons, but you should be good to go as to the AOS.
