  1. Hey Everyone,

    Yesterday we received an email and text notification regarding our AOS status being updated:

    On August 23, 2012, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before receiving your card, please call our customer service center at 1-800-375-5283.

    During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision.

    For now the current status says "Decision" so we're still waiting on the Card Production notifications to eventually come through. I'm glad this part is over, because stressing over this is not healthy for my pregnancy. I'll update soon about the Interview experience we had back in July once I get the chance. Thanks to everyone who offered their support and well wishes to my Husband and I!

  2. As odd as it might seem, it puts the ball back in your hands- you're somehow back in control instead of being in limbo. Gather the required evidence and force them to make a decision. Good luck

    Certainly very unusual but sadly not unheard of.

    It might have been for something your IO forgot. Did they take your I-94? Did you have a long-form birth certificate to show them?

    She got the I-94. The officer said she would check up on his Medical, which she was sure there was no issue and she would go ahead and approve it. I'm guessing that's what the problem is. The only other thing that we lingered on during the interview was our rental lease. I'm just ready to get this over-with already.

  3. Hey everyone,

    Sorry I've been M.I.A, but I'm getting through this first trimester of my pregnancy, plus working full-time, and school. It is whooping my tail!

    We had our AOS interview today, but no got no immediate decision. There seemed to be some issues with our rental receipts (our landlord signed them with only her 1st initial and last name, but signed the lease with her full name)... I'll be able to give a more descriptive experience later on but as for now, we staying prayerful. Good luck to everyone else!

  4. I received the paper copy of my interview notice in the mail today.

    I was slightly concerned by the second page which gives instructions to bring court-certified copies of any arrests, convictions, etc. until I figured that it was probably just a standard enclosure and not specific to me (I have never been arrested, detained, charged or convicted of anything, anywhere; not even a parking ticket).

    Ours came with that same notice. I hope its standard; I just never heard anyone else mention it before when receiving their Interview Letters.

  5. Yay, we finally received the text notifying us that hubby's RFE was received by the USCIS.

    On May 23, 2012, we received your response to our request for evidence. This case is being processed at our NATIONAL BENEFITS CENTER location.

    Things are back in action.. Hope we get that interview letter REAL soon! *Crosses fingers*

  6. I was able to put our RFE response in the mail on Saturday morning, and it arrived yesterday. The P.O. confirmed that the USCIS picked up the package, so now I'm just waiting for their official notifications and update to the website. I PRAY that things get back on the quick roll that they were before. We're hoping to have hubby's EAD before our family reunion out of state in July.

  7. Got an RFE yesterday :( For ID that was in the original package numerous times including with the I-131. Pulled the copies out of the safe just to make sure it wasnt missed. Was going to argue or cancel the application but decided to just resend it tomorrow. Frustrating but already working so better us than one of you waiting to start jobs. Just can't wait to not be worried about losing income due to layoff!

    We've been praying that I make it through layoffs. My job (a hospital) is getting ready to do their annual layoffs & cutting hours, and I'm hoping to still be here for at least another year or so. I hope everything goes well!

    On another note: I was able to get my RFE response package in the mail this morning. I was an hour late to work, but hey, at least its done! The postal service says that it should arrive by Monday.

  8. Congrats to those who have received those interview letters :star:.... I was able to get all my information, as well as my Mother to sponsor my Husband, so we will be mailing off his RFE on Monday. I made an attempt to mail it off today, but the post office was already closed :angry:. Won't be able to do it tomorrow because I'll be at work, so we'll just have to wait. I hope that once we mail it off everything continues to move at a fast rate. I would love for Hubby to be able to drive us out of state for our Family Reunion in July lol :D

  9. [x] Based on the documents submitted with Form I-864, Affidavit of Support, for the petitioner/sponsor, the income did not meet 125% (100% if military) of the federal poverty line for the petitioner/sponsor’s household size.

    Submit evidence of assets that meet the standards listed below or obtain joint sponsor. Assets standards must equal the stated difference between the sponsor's household income 125% (100% if military) of the federal poverty line.

    • Assets must equal the difference for applicant's filing as orphans or a spouse or child of an active duty military member.
    • Assets must equal three times the difference for a spouse or child of a United States Citizen.
    • Assets must equal five times the difference for all others.

    Such evidence of assets includes:

    • Bank statements covering the last 12 months, or a statement from an officer of the bank or other financial institution in which the sponsor has deposits, including deposit/withdrawal history for the last 12 months, and current balance;
    • Evidence of ownership and value of stocks, bonds, and certificates of deposit;
    • Evidence of ownership and value/equity of other personal property and dates acquired;
    • Evidence of ownership, a recent licensed appraisal or county tax assessment and any mortgage/lien or lien release of any real estate.

    If you decide to obtain a joint sponsor, they will need to file Form I-864, provide copies of the most recent Federal Income tax returns, all supporting documents (W-2s, 1099s, and tax schedules) and evidence of their status as a United States citizen, United States National, or Lawful Permanent Resident.

    I was asking about the assets just so we can be sure that if you are using them that they are calculated correctly.

    Thanks for your assistance. Honestly, we wouldn't have gotten this far without Visa Journey. I've learned so much by reading other's posts and advice, so any help that I can get I'm willing to listen :star:

  11. Just to clarify - what exactly is the minimum income? We stated $19,000 - according to my calculations that was enough?

    I found another error I made since my last post in this thread and made another post about it in the main forum. I actually would only be $100 short of the poverty line due to my new current income. Silly me used my 2011 income shown on my tax returns :blush:. The 125% poverty line is at $18,912 for a family of 2 though. You can find more information here though: http://www.uscis.gov/files/form/i-864p.pdf

  12. Did you include a full tax return for 2011 with it? Cause you did not mention that.

    What are you considering assets that you can use?

    Did you include pay stubs, cause you also didn't mention that.

    I left out the tax return, and pay stubs, so that's another reason why I was RFE'd. The assets I'm using are from our bank accounts.

  13. I am a little unclear about what you are trying to say...

    What exactly did you include with it the first time, because that is more likely the cause for an RFE.

    As far as your income you put what you are currently making...I doubt that is why you would have got an RFE.

    The first time I input my income from 2011, which was what is stated on the W-2. I also included a letter which gave reason as to why I did have have to files taxes from the previous years, because I was a full-time student, and dependent of my parents. I have only been working for a year now, and I am still a student.

    I'm confused by what you're asking too.

    There's a line on the I-864 for your current income. If you don't know your annual salary, the easiest way to get it is to multiply your current hourly rate X 2080 (Assuming you work 40 hrs/week)

    There's a different line for your 2011 income based on taxes.

    Yes, I used my 2011 income as my current income. I wasn't thinking about the fact that my income had changed since November 2011.

    The RFE that we received stated that based on the document submitted with the Form I-864, my income did not meet 125% of the poverty line. It asked that we submit evidence of assets that meet the standards or obtain a joint sponsor (which is circled and underlined in red ink btw). I was wondering if I could avoid getting a joint sponsor if I were to show proof of my updated income. I would only be short about $100 of the 125% poverty line, and I have enough assets to cover that. Sorry to confuse anyone, I'm confused myself. Thanks for your input

    Current income is your annualized income. If you make $100 per week, your income is $5200 annually. If you earn $200 per week your income is $10,400 per year.

  14. Hey Everyone,

    My husband and I submitted his AOS package in the beginning of April, and everything had been going good up until now. We received a notice of an RFE being mailed just a few hours after he completed his Biometrics appointment. I received the hard-copy of the RFE today and I figured that maybe we didn't include enough evidence along with our income and assets, but now that I am looking at it, I don't think I added our CURRENT income correctly :blush:.

    I originally started working on his AOS paperwork in the beginning of the year, so when we completed the 2011 income taxes, I just simply added what we had on our gross amounts on the 2011 W-2s to the I-864. I received a promotion from part-time to full-time in November 2011, so for the majority of the year, only my part-time wages make up what was shown on the 2011 W-2. Could someone help me to understand if I supposed to be using my most recent taxes, because I think I may need to go back and complete the I-864 all over again with the updated income, and submit my update with the RFE? I'm obviously not good at this! :wacko:

  15. hmm. sounds like they made the decision for you. did they recommend you prove assets or more money in the bank, etc as alternative for joint sponsor?

    They recommended proving assets and other proofs or having a joint sponsor, but to be safe I think we'll do both. We were about $1,000 short income-wise, but we had at least $3000 in assets. Better safe than sorry, right?

  16. We are also looking into purchasing a house within the next few months. I have an interview with someone tomorrow afternoon as a matter of a fact. When speaking with a different lender, the guy told me that since my husband we wouldn't count him on the mortgage, but he would be on the rest of the information. Overall, there shouldn't be a problem getting a home if at least one of you has good credit. We'll see how this appointment goes tomorrow though :thumbs:
