yahoo!!! My daughter received her green card in the mail today!!! I was starting to worry, even though we'd not received an RFE at all

I've done all my daughter's immigration paperwork. When they first started this journey I wasn't planning on doing anything with it. I directed her then fiance to the appropriate website where to find the list of required documentation and the forms for the fiance visa. He sent out the packet mid-August. Mid-jan, they received an RFE because he'd not included everything required and felt some stuff was "good enough"....... GRRRRRRRR
That is when I took over. Seriously!! Neither of them are stupid people (he has a business degree and she has a biology degree), but neither focus on the details, which you need to with this paperwork. It's not hard, but you have to just give USCIS what they ask for.
Anyways, everything else has gone smoothly. Over the last 2 years, I've mentioned for them to keep plane tickets, etc.... for documentation to send out with the ROC paperwork. In September I gave them a thorough list of what I wanted them to gather to be sent out in December. They come here for Christmas and why does it surprise me that stuff is missing?!?!?!?!
So, I did put together a good packet with enough documentation that shows they really are truly a couple........... I told them all they needed to do was add the chq and mail the packet with tracking.
Icing on the cake.............. she texts me yesterday to say she forgot to sign the cheque SERIOUSLY.......... I just want to scream!!! I know I should just let them handle it all themselves........ they are certainly old enough, but I just wanted it done right and over with. Anyways, she was in tears, I knew it was an accident, but it's just frustrating because while I know they understand how it's work they don't have to do and they appreciate it to an extent, I don't think they totally get it!anyways, she called USCIS and they said to just wait until it either goes through or they send the packet back.
Needless to say, I'll be VERY glad when this is all over with. They will be responsible for keeping her green card renewed because I'm done with this. She insists she will not become US citizen (even if it's only to make things easier). Not my problem anymore.
I'm thankful to be able to sound off here . Usually I'd just call my sister, but she's away on vacation, LOL! -

I don't know what's going to happen then... or if they changed the way they delivered it with the new passport, since they increased the fees so much. But, when I get mail that needs a signature (when I'm not home), I just have to go and pick up at the post office; it is not too complicated.
okay, thanks. I know that's how it works for us in Canada and just wondered if it were the same in the US. She's never had anything that requires a signature, since she's been there. Guess we'll find out. It's just a bummer that she has to have it sent to the US.
She's close to the border and we have a passport office in our city, but can't stay here in Canada once she applies for it, waiting for the new passport to come in. Anyone know if she applies within Canada, can she go back to the US and then come back into Canada to pick up her new passport?

They just left it in my (locked) mailbox - I had to renew my Canadian passport in December, delivery was this January (2013).
Hmmm......... they don't have a locked mailbox. Their mailbox is at the road, in between 2 others

question: In Canada when they deliver the passports, you have to sign for it from the mailperson. Does this happen when it's delivered in the US as well?? If so, what if the person isn't home? Do they send it to a local post office?
My daughter is just getting ready to renew her passport and was wondering -
The OP needs to be careful if they decide to do this. Even if it isn't made "legal" many times what looks like a wedding and smells like a wedding IS a wedding to USCIS. Many times we have seen people denied on these boards after having such ceremonies and parties, even if the marriage is not registered.
Hmmmm....... I was unaware of this. I've been registered on this board and have made daily visits for over a year and creeping it for a good 6 months before that. I've not heard of anyone who's been denied for this reason.
I certainly would not want to put the OP's visa at risk,
but like I said...... in our case, we called USCIS 2 different times to be very sure before proceeding and got the exact same answer..... that her K-1 would NOT be compromised in any way, as long there was no legal paperwork applied for,signed or registered before entering the US on her K-1.
She POE'd no problem, received her EAD and AP within 2.5 months of them receiving her application and was just interviewed and was approved on the spot, in less than half an hour.
Just another point of view for the OP. It's certainly up to them because either way, it looks like they are going to go ahead with the "wedding". I was just offering up the option of what we did, all within the legal parameters

If an expedite isn't ready, and the visa isn't approved, and all the arrangements are made and paid for and can't be changed, including family flights etc... One possibility would be to still have the party, but don't have a marriage ceremony. Cut cake, drink wine, dance, throw a bouquet... but don't marry. Then a few weeks later once the K-1 is received, do a justice of the peace wedding. You can certainly have a party on a VWP. Making the most of a bad situation, if the visa hasn't come through.

I agree with most of this!! If your K-1 has not arrived in time, go ahead and YES, you can have your "religious" ceremony, but by any means don't make it legal. Do not apply for a marriage licence, do not sign any legal documentation whatsoever until you have your K-1 in hand and have activated it at a POE. Why risk having to wait any longer by having to then change your application??
Having a ceremony and celebration first is perfectly fine and will not compromise your K-1. How can I be so sure???
Because this is exactly what we did, after calling USCIS on 2 different occasions. My daughter's FIL to be (at the time) called and documented dates, times, names and badge numbers when he called asking if we could have a strictly religious ceremony before my daughter emigrated. He asked specifically if it would endanger her K-1. Both times, after consulting with someone else, the reps came back and said as long as no legal documentation was filed or signed, there wouldn't be a problem with doing this.
Soooo, that's exactly what we did. We had a beautiful ceremony and celebration, then my daughter emigrated, then went and applied for the marriage licence, picked it up 3 days later and had a civil ceremony. Went on their honeymoon, they came back, we filed her AOS, EAD and AP and waited........... everything's been approved and we're just going to wait now until ROC.
Seriously, don't risk having to start over again........ it's not worth it! Wishing you all the best!

My daughter had her interview this morning and she was APPROVED on the spot! PRAISE GOD!!!
She said it was a very easy interview and the IO was very nice. The whole thing was less than 1/2 hour from their appt time to when she called me once they got back to their car.
She was just asked a few questions from the application (ie. are you involved in espionage, etc...) and basically that was it. She asked to look at their passports and nothing else. They'd brought a ton of documention of proof and pictures, but weren't asked to show any of it.
Whoohoo.......... now we have a bit of a reprieve from USCIS paperwork for a while
Hope the rest of you Nov filers, who have yet to be approved, have your cases move along quickly! We are very thankful!!!

I agree with the others........ apply for your AP card. It's just good to have, especially if your wait is long for the GC.
Hopefully you'll have some movement on your case soon

Wow......... I'm so sorry for those of you who've been waiting so long in this AOS stage. It's just crazy and wrong how new applications are being processed sooner than yours (our included).
Praying you'll get answers soon, as I can only imagine your frustration!

Yes, first year of double tax filing was confusing. I am stuck having to file double again this year because I did not close all my Canadian accounts and made interest, which I have to declare and file for as a non resident >.<
I guess I will now transfer most of it to the U.S. and keep a minimal amount of $ in Canada for when we visit.
Oh yikes! Yes, she kept an account still open in Canada, but there's not enough in it that she'll earn enough interest for it to be taxable for next year.
On a much more exciting note, she has her Green Card interview tomorrow morning, so we'll have a nice little break from all of this immigration paperwork for a while

If you get an answer, please come back and post your findings. I feel the same way... I'm no dummy. I got through the immigration paperwork just fine, but trying to find information from CRA is like reading a different language!

I spoke with an accountant who does US/Can tax returns, etc....
So apparently we would still click that she's a non-immigrant, but we may not be able to do her taxes with Turbo Tax. It's a fairly simplistic tax program for pretty basic returns. I've had no problems using it for the last 12 years for my home-based business (using unincorporated program) and our very basic personal returns.
The problem is that with her now being a non-resident, it doesn't give the option of still inputting her ON tax information which apparently must be calculated (even though she didn't make enough to owe anything). I'll have to calculate how many days she spent in Canada and pro-rate her ON taxes, etc....
Sooooooo, I'm going to the post office to pick up a paper packet of the return and see if I can figure it out from there, combined with what I'm seeing on Turbo Tax. Since she's a non-resident, we can't e-file anyway......... it has to be mailed.
Sure glad I'll only have to do this once, LOL!!

I've done all of this immigration paperwork for my daughter, right from the beginning of the process, so I'm not ignorant. I can't understand why it's so difficult to find just one simple answer online. Guess I'll be calling

Okay, I have one simple tax question, as I'm doing my daughter's final tax filing in Canada. Her father-in-law is doing her tax filing in the US, even though she had no earnings there as of Dec 31.
I'm doing it through Turbo Tax and of course, on the first page I've entered that as of Dec 31,2012 that she was a non-resident of Canada. Then on another page it asks about address, which we're keeping the mailing addy in Canada in care of myself, but that her place of residence in the US.
So here's where I'm not sure what to put.
It asks this:
I was a non-resident of Canada
I was a deemed non-resident of Canada
I was a deemed resident of Canada because I stayed for 183 days or more in 2012
I was a deemed resident of Canda for other reasons
For most of 2012 she was a resident. Do I just put non-resident or deemed resident and which one would apply??
Anyone who has filed already or done it last year......... what did you put?? I'm hoping to avoid calling again and waiting on the line.

Been a little quiet here with the Nov filers. We're just waiting for my daughter's interview on March 19.
She's been "home" since she received her EAD/AP and went through the border crossing (driving) with no problems.
Hope everything is moving along quickly for everyone else.

APPROVED!!!!!!!! Approved approved approved!!!! I'll tell ya'l about my experice when I get home, I'm typing on my iPhone and I hate doing that lol... But yay! AOS application approved, green card will be in the mail and I should received it by 8 weeks time!!!!r

My hubby and I have been on vacation for the past week and our daughter was back here in Canada staying at the house with her brother.
I've just been online today, catching up on everything and thought for the heck of it, I'd check the USCIS website and see if anything has changed with her AOS status.
SOOOOOOO excited to report that she has an interview booked for March 19
Things are moving along quite nicely, for sure!!!

I signed up for email notifications only, no texts. I only received an email with the receipt numbers right after sending my application. For all other status updates I had to check the website. I have no clue why my notifications don't seem to be working.
I suggest calling them too. I called them last week and after a couple of days I got approvals and my interview appointment. I received an I797C for my interview in the mail this afternoon.
My daughter signed up for both email and text notifications, 3 different forms attached to each of the applications. She has not received ANY notifications at all. Makes me wonder why we bothered with them. I check the website daily and that's how we keep up to date on what's happening.
