I'm gathering my information for my fiances K-1 Visa.
He's from a poor Lao family, and so there aren't too many documents for him. For example, he has no birth certificate. He actually doesn't even have a last name.
His family lost all of the documents they did have before, and recently had to make them again. So earlier this month, he used these new documents to get a new ID and passport. However, his name was misspelled on the document and he has been using this new name since then.
All of the things that I have written to him have his original name (the one that isn't on any of his documents).
For the I-129F they ask for legal proof of name change, of which there isn't. And I mentioned it on the forms where they ask if there are any other names used.
I was thinking about just adding a page explaining this.
Suggestions? Thoughts?

Your best luck is to change his ID and family registry book again with his correct name. I know Laos doesn't have any legal documents supporting name changes. Your would also have to get his birth certificate by buying a form from the local printshop and have the village chief, mukng and the police chidf sign it.

If his name is Shoua Yang, then I would have to say no because it is the same guy I talked to. If you really wanted someone to talk to that can run the paperwork from Laos. I would personally go with Lor Pao Lee, he is well known but his price is high. He wanted 3k just to run the paperwork from his end.

It's just a really long waiting game, if you have all your ducks in a row, then all you can do is wait. The lawyer can't speed it up any faster than you can. Most Hmong Lawyers here in Minnesota is full of bull, you can smell it when they begin talking. I asked around like you, I had a offer from one guy here in Minnesota, he insisted I go back and to Laos and get married and file an Spousal Visa. From his mouth "Fiance Visa aren't possible anymore" so I asked him the name of the Visa...he couldn't even respond. I say if your documents are right and everything is squared, just wait.

well we see things from different perspective, you having your NOA2 in your pocket and being what? a month, maybe 2 max from getting your case number and me being X months away from it

I am not talking about you, just in general... I am sure there is tens or hundreds of us here seeing people complaining about how NVC is slow ad thinking to themselves that they would actually happily switch with them
And just to be clear, I am really discouraged seeing other people from my service center being approved before me, even though they filed days/weeks or months after me...
No, I wouldn't switch with them. I am content with either center as the time are pretty much dead even now. Everyone has their own opinion, we will just have to wait and see. Don't want anyone to get discourage or think I come here just to put people down. Just wanted to see what I thought was happening as everyone tends to think Process time has changed for VSC. To me, it never changed, still there with the NVC lingering CSC Approvals behind 20 plus days. But yes for me generally, I would like my NVC process within a weeks time like VSC petitioners history, so I have no feeling or thinking its stuck in AP Mode.
However GL with your process Sabi, you are getting closer to that NoA2.

well I disagree as I would prefer to know where my petition is and be approved a month ago and wait another month for NVC to process it, knowing that my petition is out there safe and sound, than having to wait 6 months being kept in the dark and not knowing when and what to expect.. 2 different scenarios as I see it!
You are always in the dark in this process, each step of the way. Having an approved petition sitting around doesn't get you know where. You might think you know where it is, but not even the service center that approved your petition knows where it is. All they would and will tell you its been approved and enroute to NVC, while you contact NVC and they have no record of recieving it. It's when it is in the hands of the Consulate that I will have a hope of light. What I am trying to say is people get discouraged easily, when they see other couples from the other service center get their NoA2 and not theirs. All I am saying is both service centers are dead even now with NoA1 to NVC stage. Don't believe me? You will see more and more people posts about CSC to NVC here pretty soon. While the VSC approved Jan filers get their Case number within a weeks time, we CSC Feb filers will be waiting till mid July to early August to get ours. Different scenarios, yes, same time span, yes, give a take a couple of days.

Think you have a year for a K2 VISA to follow through. Why, if the ex and the child won't sign or go with it, are you going the extra mile? Even if you get everything done and ready, if he doesn't want to follow your fiance into the US, it would just be wasted effort. Maybe i just read it wrong. Good luck though.

Since VSC is going to take forever
and the London Embassy will tack on a another 2+ months
and I refuse to let them put a damper on my life...
I think Julian is just going to come on over for a visit and stay until his interview, or rather, if he comes now, he'd have to go back in time to complete his medical so it can be sent to the Embassy in time for the interview.
Before we seriously consider just doing it this way, can anyone think of a reason this would be a bad idea? The only thing that comes to mind is an RFE, so we might wait until our approval or RFE in case they need something from over on his side of the pond and then fly him over.
other than that... both of us are just ready for a date to look forward to and since that's taking for *$#$&@$ ever...
Why is everyone thinking VSC is slower? To have your NoA2 and get it to NVC and out with in a week is...its pretty much the same as it was. CSC you get your NoA2 wait for them to have enough to send to NVC and then wait for 20-25 days is just crazy talk. I will still be content with VSC processing time with the NVC included pretty much evens out.

Somehow, after only a 43 day wait following my NOA1 (and I don't qualify for any expediting processes), my I-129F was approved last night!
Keep up your spirits because CSC seems to be moving really fast these days!

The weirdest thing is my fiance (petitioner) still get no text or email notification from USCIS, though he included the notification form along with our application. Luckily I have account on USCIS and marked option for send me alert on my email. That is where I found out we are approved.
Must be a budget cut CSC probably letting it stack up till they fill a truck up before sending them. Its cheaper for them.

I am single and retired with a lifetime pension income that exceeds the 125% required but also work and that income also also exceeds the 125%
I plan on submitting a letter from my current employer along with 2-3 months of my latest pay stubs
Also I will include Past 3 years of IRS transcripts which will reflect gross income to include retirement.
I also own my home free and clear
Should I send my real estate tax receipts or do I need to also send a copy of my deed?
Will this surfice in meeting the Affidavit of Support requirements for the Manila Embassy?
It's been a VERY long road and just want to meet requirements without going overboard.

I think just showing your current stubs with your 3 recent tax transcript will suffice cause you already met the requirement with one. I don't really think you have to put all your assets and retirement funds down. The more you put down the more evidence you will have to present which means more papers. Keep it simple as you said " It's been a VERY long road..." make it a short one, wouldn't hurt.

she didnt recieve any mail from uscis but i input my timeline due to error because i didnt know how this site works then when i just joined,i will tell her to confirm the 340usd charge from her also honestly this have caused somuch arguments even between me and my fiance but i just need a good informations from you guys please
Two senario I am guessing,
One your fiance didn't send the correct amount and the package was returned and lost. So you would have to resend all the information and the correct amount back as if you are starting over again.
Two your fiance did send the correct amount and they lost your packet, which they will want you to send proof of the original payment along with the new package. However if they lost your original packet you can request it to be expedited due to their administrative error.
Not much can be done until your fiance can confirm how much she paid for the intial process. But Good Luck to the both you and hope all ends well!

my fiance summitted our k1 applications and couldnt hear anything since then,after series of calls and emails a friend to me to tell her to call uscis and promt as if he wants a change of adress and then told them she wants to speak with the most superior she eventualy got through to her, her name is Debra O'conner that what she told me her name was,she listened to her complain but she said they couldnt find our file in the system and even at their office i mean n trace so my fiance is told resend all the documents and the receipt of the previous 395usd they deducted from her account and then shes asked to pay another 395usd now when sending the new documents that the previous 395usd will be returnd to her and that she herself will monitor the file and hasten it....im so confused right now guys please advice me on what to do......does this mean 5months is wasted now????? my fiance is ready to send another tommorrow but i told her to let me get back to her from what i hear from you guys....thanks mates
If your fiance paid 395 USD, more than likely it was returned for a correct amount. Maybe he might of missed the package or threw it away with the rest of the junk mails? But 129F is 350 USD not a penny more or a penny less or else get sent back. Anyways check his bank statements if it was ever cleared should have your WAC or EAC number on the back of the check image. 5 months and no word would mean it was returned more than likely.

Definitely CSC is working OT on these K1s. VSC slowed down quite a bit but they are progressing. We all might get approved but we also have to deal with the NVC stage too...not too many kind words about NVC this past month either. However GL to everyone that is approved and the rest praying for a approval after the 4th for all of you!

Congrads! However I have to disagree with you on the "helping" part. Some people can not spend over a month
in Laos and do this all on his own. I also highly doubt you did not received help from the local relatives unless you were fluent in Lao writing and reading. Anyway just wanted to point out that make sure the person helping you can be trusted.
You don't have to spend a month in Laos to get it done, we got my S/O Passport and ID within a week the slowest. People had done it in 3 days, relatives are helpful on where the places are but the process as you and I know most of these people have no ID nor Passport so they wouldn't know how the process starts or end. But if you had to pay someone 200 USD to get it done at least it got done. I spent 30 USD on both and that was by me yes, by me, but mostly because my S/O was there translating as they speak their native language. But I see where you are coming from.

NoA approved got text and email both today at 9:30 Central Time. Dated yesterday 6/27/2012 though. On to the next step!

After being redirected to different departments within the USCIS, I was finally instructed to contact the embassy where the interview will take place with my question about tax transcripts. I simply wanted to know if I should supply my own tax transcripts since I have never filed before (full-time student) and if I should provide my mother's, since every year she has claimed me. They basically told me that with form I-134, I do not need to provide any extra documents???? I thought they treated this as form I-864; as an affidavit of support. I have a co-sponsor and everything for this form and now they tell me otherwise, regardless of the instructions.
Here is my original email:
"I filed form I-129F in February 2012 as a petition for a K-1 fiance(e) visa. I am currently gathering the required documents for my fiancee's interview, which will be in Madrid. My question is about form I-134, the affidavit of support. My fiancee and I have a co-sponsor for the K-1 visa, but I am aware that I need to provide supporting documents as well - I was wondering if I need to provide a tax transcript with this form if I have not filed taxes. My situation is that I have been a full-time college student and my mother (who is not the cosponsor) has been claiming me on her taxes. If so, shall I submit my own or my mother's tax transcript?"
Here is their reply:
"If you are going to present your own I-134 you do not need to attach any extra document, with that form is enough, and we won´t need your mother´s I-134, as after you get married with your fiancé you will have to file a form I-864 and there is where you will have to proof you have income, or present a co-sponsor, but for the K1 your I-134 is enough."
I would imagine you will have to get the embassy in contact first if they allow co-sponsors. If so you would need your Mothers Tax transcript and a letter stating why you can't sponsor as you are a full time student. She how ever needs to make enough to cover herself, you, and or family members plus the immigrant sponsoring. I would say amost don't trust them on the I-134 as everything will be needed during the interview. You will need tax transcript, letter of employment status, and/or current paystubs if they allow co-sponsoring. Good Luck to you.

Patience guys its just all a waiting game. I feel the frustration. Too but al least we are always getting close. Cant believe its been 3 months already though. VSC is probably just waiting for the snail (CSC) to catch up, don't want to make the other side look bad now right?

I am a mid january filer. so i hope to have our petition approved by mid june and today is the 1st of June, so I need to start getting ready for what we need when the NOA2 arrives and I've been looking for it and today I found that you posted about it...My fiance and I had discussed it two days back but we didn't know what we needed but now I am going to tell him to get ready everything ready because we now have a few days to go...about 40 days slightly more or less...Thank you...As the days get closer I am both excited and scared at the same time but I pray for God's blessing in all this...
Joining this site was the best thing for this long and tiresome journey..this is what everyone going through this process needs, God and a support system like this one...and even after I am approved, I will still remain here.. to help others who come here because this is really good.
I don't know but today is the 1st of May for me, another month will have to go by first for me.

I wouldn't think there would be a problem as its income but I would check with the Embassy first as they take your Aff of Support. Canadian Money and US Money are just as strong 1 USD = 0.98 CA, maybe even more.

Yup, this wait is ridiculous. Filed ours back in March, got State Rep involved but still same answer as Notice which could take up to 8-12 months.
