Thanks everyone .. i just got confused and upset for sometime cause i thought omg its not fair .. we waited .. paid a lot of fees how everybody else .. and this ppl doing ilegal stuff trying to take advantage of uscis and others .. but its ok .. ppl will get what they are planting ... if you do right things in your life you will get good things ... but who always make bad choices will get problems ...

    Im wondering if its true that somebody came to usa with k1 visa .. and tryint to apply for AOS for free .. i was a member of some group on facebook .. and there was 2 girls trying to do this .. i didnt agree and i got mad and said thats illegal and bullsh%% ... they are trying to save this money .. and said we are stupid paying because they will get a way to no pay ... they will say they dont have the money .. but my hubby just said it doesnt make sense ... because if they dnt have money they should wait like other ones who have waited years to apply for aos .. cause money was shorty ... and also how they will apply for aos with no money if they need sponsor ... it just doesnt make any sense ... i dont know if she is lying .. and stressing who did the legal way and the right ... or if she is trying to do something under the the sheets ...

    Anybody knows if is that possible or just a lie and they will just deny their app ... i hope its just a rumor and not the right thing to do because after all this time and money we spent .. not fair ...

  3. I think you should not get a lawyer ... sometimes they do ridiculous mistakes like old forms .. wrong infos ... I already saw lots and lots of problems in a group of brazilians that americans laywers did ...

    you will pay so much for something u could do by yourself ... my fiance did everything by himself and the only help he needed he called USCIS to resolve some problems ... or I asked a local group .. in my case the brazilian one .. so you will receive the right answers .. cause every consul will be diferent ...

    like here we dont need the packet 3 anymore .. and we need to many proofs .. and we talks about experiences etc .. you should try to find a local group and try to get as most info u can before apply your k1 visa ...

    Not hard at all ... read some posts and good luck .. you will be fine ...

  4. Updating ... I got my visa .. with no questions about overstaying a j1 visa .. i guess i was honest on the forms .. and i had all the proofs leaving the country so i was a little nervous .. but they didnt request any doc ... or proof ..

    they just asked normal questions about k1 visa .. 3 ones ..

    Where did i meet my fiance?

    If i lived with him in California

    and when do we intend to marry ?

    I guess after you serve the ban you dont have any problems ... or maybe the agency never reported me to the immigration

  5. After all the doubts I got my visa approved .. they didnt ask me anything about ovestaying a J1 visa .. or anything else .. just asked 3 questions where did i meet my fiance ? If i lived with my fiance in California . .and when i intend to marry ...

    simple questions ...

    i dont know if the agency reported me or if i served the ban and there was no black list on the system .. i wrote on the forms the true infos about problems on visa .. and etc .. so i guess i was honest and they saw was no problems .. and gave the visa ...

    If you look my timeline u will notice that i needed to wait to long ..

    I waited for NOA2 5 months and 3 days

    so i thought oh maybe now it will be faster .. no way .. after that i had to wait from may7th till may 31st to have some good and bad news ... cause after many emails sent to NVCinquiry and NVCsearch i thought they lost my case .. cause some ppl happened that ... so i was freaking out .. so I told my fiance to call USCIS to ask whats going on one more time .. he had a good luck to talk to a supervisor that said the true .. well we sent your case on the may 29th to NVC .. when the lady said it .. he asked why ? why so long .. she said .. We dont send in the next day .. some oficials are more fast some more slow .. and keep the cases in some boxes before sending .. so they can send in a bulk ... probably what happened .. so that was a bad news of waiting and good news to know they didnt lose it .. after that took pretty fast .. on june 1st my fiance called NVC just to give a try ...lol maybe was impossible so fast to arrive ... oh well on june first arrived and they got our RDJ number from NVC .. so finally we had a number case .. and on june 4th they sent to consulate .. arrived in consulate on june 6th .. and I got a interview date just today ... after some days .. we tried by consulate .. but after so many tries .. he called DOS = Departament of state .. (tip of some vj guy ) so we got .. and after it received the email from the consulate stating my interview will be in July 17th ...

    be patient ... pretty sure ur case is waiting to be sent with other ones ..

    I am a USC and have filed IR5 for my parents. My mom overstayed in US from 1993 to 2002 (8 Years). Their immigrant visa was denied in 2003 (Category F4 filed by my mom's brother). I believe she triggered 10 Year ban for herself. Now currently I am a USC and its been just above 10 Years my mother is outside US and completed the 10 year ban. I have filed IR5 for them. Uptil now everything is going good. Petition is approved. Case is in NVC and we are in process of sending documents.

    I am wondering that, will we face same problem that we had faced earlier of denial due to overstay or the completion of 10 year ban will allow my parents to come to US.

    Or do I need to file I-601 Waiver, I am not sure if applying for waiver still applies to us as my mother has already completed 10 Years outside US.

    Please help.

    Let me know what happened cause i m on k1 visa and waiting for interview .. and i guess i had 3 years ban and I served it out of US and hope we wont have problems ...

  8. OMG is USCOS lying to me now!!!

    Those of us who got out NOA2 on or after MAY 14th 2012...GUESS what our appilcations are still sitting at CSC waiting for then to compile enough to sent to NVC in new hamshire!! Outrage!!!

    On May 14, 2012, my I-129F my PETITION FOR FIANCE was approved (so thats the good news!) BUT!!!!!!!!!

    I still havent got a case number yet from NVC, despite my daily calls to NVC...so today I called USCIS (as its been 3 weeks and more than 15 business days) and I spoke with a supervisor after waiting for 45 minutes and we found out its still sitting at USCIS CSC office as they only send out approved petitions from time to time and they are waiting to compile enough to send out to NVC...crazy or what!!!! Not fair!!! We all wait so long to be re-united with our loved ones and our packet is sitting around still!!! They said hopefully by the end of this week it will go out to NVC..grrrrrrrrrrrr!!!

    So i did a little research scrolling back on this posting and

    All the people who got approved just 5 days before us (like May 7.8.9,10,11)went to the NVC and got case numbers (and yes I have genuinely happy for all of you!!! :) ) around May 20-23rd exactly 2 weeks.

    But those of us who got out NOA2 on or after MAY 14th 2012...GUESS what our appilcations are sitting at CSC waiting for them to "get enough applications to send all at once"

    HAVENT WE WAITED LONG ENOUGH!!!!!!!!!!!!!!!!!!!!!!!!!!!!

    At least we have each other to vent!!!

    that happened to me ... My NOA2 got approved on May7th .. and guess when they sent it ... just on the May 29th ... but after it was so fast .. on the June 1st we received the NVC number ... ... Good luck ...

  9. Look what happened to us ... NOA2 from May 7th .. then yesterday after waiting 24 days and calling almost everyday .. We found out that our case was sent just on the May 29th ;/// My fiance had this info by calling Uscis and tallked to a supervisor .. so the woman said oh let me check here on the system .. so she said was shipped to NVC on 29th ... so I guess thats why some ppl wait so long .. because they approve but dont send it right away .. they keep to send in a bulk .. thats what the supervisor said ...

    So i understand now why NVC say give 15 business day .. cause this is some time they take to ship it then I guess it goes faster to put in the system at NVC ...

  10. hey everyone i am really fustrated with this and i need yall advice next week is gonna be 1 month and nvc still have not recieved my petition i keep calling and still nothing i dont know what to do at this point is it possible that my petition can be forwarded straight to my embassy cause i called last night and the rep ask me to read what was on my approval notice but i didnt have it with me please i need some comforting words at this moment i am really lost i feel hopeless and if there is anyone who had their petition at nvc for this long or longer please let me know thanks yall in advance :crying::crying::crying:

    Did you get your NVC number ???? let me know .. cause i m freaking out too .. My NOA2 is from May 7th ... ;/ no news yet ..

    "The above petition has been approved, and forwarded to the listed consulate. Please contact the consulate with any questions about visa issuance...."

    As previously mentioned, every case is different. I REALLY didn't need to call the NVC regarding the status of my file, but I did yesterday.

    I read the first sentence of the notice to the NVC lady, and she suggested contacting the consulate in Vancouver, 15 business days from the notice date. That call just gave my fiance (the USC) & I peace of mind until June 1st. (when the 15 business days are up).

    Really??? I think it happened to us ... we received the same thing to contact the consulate instead the NVC .. but I thouhgt it was weird .. cause every case goes to NVC first .. my fiance called and one person said to contact consulate .. then he called again and talked to another person .. more high position .. so this person said no .. it was a wrong information .. dont worry .. ur case it will arrive in NVC ... 16 days waiting .. still no ... what the hell ;/

  12. I checked DHL.com using the DHL trick and I found a package mailed out yesterday (5/15) to Brazil - This COULD BE yours Waybill: 9138670590 - Have you called today to check your status? call and ask to see if yours was mailed out if so this MIGHT BE it.

    Thank you .. I will check it out :) I`ll tell my fiance to call again today ... Do you think they can know that he calls everyday ?? lol im afraid they get mad and delay haha our process on purpose :P

  13. Well .. I`m very frustated .. my fiance keep calling NVC to see if they got our package out there .. but the answer is NO .. sir wait 15 days bla bla bla ..

    We received NOA2 on the 7th May .. and still no answer from NVC .. but what makes me upset I know a lot of ppl from Brazil who got their RDJ number in 6-10 days .. and I cant understand how they do it ??? Does anybody here know how USCIS send to NVC ??? They use DHL as well to send to NVC as they do to send to the consulates ???

    Also I`m wondering how they prepare to send to NVC ... all the packages aprroved in the same day ?? or they probably wait to get a lot and send 1-2 times per week ??? cause i cant believe a mail could take up to 15 days to be there .. even if u buy something online for free shipping it could arrive before that ...
