  1. Hi everyone,

    My wife and I have been going through a lot and finally got reaffirmed on December 5, 2012. The USCIS sent me a letter and said " your case has been sent back to the Department Of State(DOS)". Now, it has been one month and 2 weeks since the case was sent back. We still have not heard from the NVC or Consulate. Does anyone know how long will take for Consulate to receive the case? Is the NVC still going to inform us when they send the case back to the embassy? Prior to sending the case back to the consulate, is NVC going to request us again to submit paperwork (such as affidavit supports, I-864). Overall, at this point what should we do? because we do not know for how long we are waiting for NVC or embassy.

  3. My wife's visa was denied on Nov 7,2011 and our case was returned to USCIS On March 22, 2012. Now, it just passed 2 month since it came to USCIS. However, it is going be 8 month this June since it was denied at the US embassy. Then, I visited my wife, now, working with my Lawyer and congresswoman to help me with the case at the USCIS. I was told that usually it takes 6 month to one year or more before the USCIS will review the case. My lawyer asked USCIS two weeks ago for updates on case status and there was no updates. They did not even open the case after they sent a latter saying that they will review our case. Now, I am asking my congress to send them Congressional Inquiry. So, how much the use of Congressional Inquiry and my lawyer request going help us with USCIS start to review our case? My wife and I already suffered long enough and worrying for a period of time we will be waiting for the USCIS. Also, one of the major frustration is no specific deadline for our case getting reviewed. Please give us any advice on what I am doing now and will suppose to do to overcome this obstacle at the USCIS.

  4. Thanks for your advise. The Embassy did not tell my wife specific reason for the denial except on their note an email to my respond after i asked them for detail. They said they didn't find bona-fide relationship during the interview and the prove is always on the applicant. Despite the long time interview preparation and prove of evidence she has. As of right now, i am letting my lawyer handling my wife's case and I am hopping everything will work well.

    Read the reviews on the Nairobi Embassy, and read the Nairobi Embassy Thread as well. What are your possible red flags and what questions did they ask your wife? Were you fully prepared for the interview? The Nairobi Consulate is very tough, but they are fair when they believe everything to be just right. Something must have raised an issue with them. Being prepared and confident is key...they are NOT EASY. I hope everything works out for you. Please read over everything - it will help. This website is packed full of excellent advice. Good luck with everything and I wish you well.

  5. Thanks for your advise on this, yes i have only visited once but ill visit more. As far as the interview, she was well prepared for several months but wasn't lucky despite the evidence phone call records using pingo, rebtel and and some other VOIP. Also wedding pic, Videos and money wiring receipt.

    Withdrawing and re-filing is probably your best option, but first you need to fix the reason for denial- go over the interview experience in detail. Only visited once? Go visit again before re-filing, and a couple more times during the process. She couldn't answer questions about you at interview? Talk more, esp about eachother's background etc.

  6. My wife's RC1 visa was denied at US.Embassy Nairobi Kenya in Nov 7, 2011 and she was told that the case will be returned back to US because they think our marriage is not genuine . I have contacted both congress/senator but no success. while I am still waiting for a letter from USCIS, I am trying to find a good immigration lawyer but I am getting deferent advise from some lawyers. One lawyer told me that my option is to file IR1 from start and and they are going to deny me and I have zero chance for getting approval for CR1. Right now my decision is uncertain, need some more advice.
