Correct, and you are welcome. Good luck!
Hello again! We are filling the I864 of my wife and we don't have the return tax of 2010, so we don't know the income. What can we do?
-
As I said before, both fill out an I-864. Your wife has no income. The I-864 is for a household member to combine incomes with the sponsor. There is no income of the sponsor to combine incomes with. Much better and easier to keep household count correct by having her father fill out his own I-864. There is no requirement to use the I-864A simply because you live in the same house. If he is married and files taxes jointly with his wife, then make sure you list only his individual income on the I-864 and include a complete copy of their joint tax return with all forms, schedules and W-2s. If his wife's income was needed to combine with his, then his wife would fill out an I-864A to combine her income with her husband's. If he has enough income on his own for his household size plus you, then no need for his wife to fill out the I-864A either. He just needs to make sure his individual income is listed and shown clearly as I stated above. No one will be combining income with your wife, since she has no income to combine with. Read through the I-864 and I-864A instructions.
OOOKEI, now everything is clear. In the form I864 my wife is the option A petitioner and my father in law is D joint sponsor, and they both need to fill it out and the tax return.
Perfect I will work on it tonight and send it tomorrow. Thank you so so much for your help again

Ok, now im so lost. My wife has to fill out the I864 because she is my sponsor. She is not working right now and we are living in her parents house. Her father is gonna be my joint sponsor, which form has to complete? The I864 as a Joint Sponsor or the I864 as householder?
-
Oh, this change everything. So, again, I just need to send the I864 from my wife with her tax return? and do I have to send my father in law I864 again and his taxes?

Hello again!
Im sorry to write all the time about my answers buuuut i just got this:
Form I-864 Affidavit of Support was submitted; However, it was not from the petitioner/sponsor
Please submit a completed and signed Form I.864 for the petitioner/sponsor listed on Form I130 or Form I129F. Even if a joint sponsor will be used, the petitionet/sponsor must submit Form I.864. Also provide copies of the petitioner/sponsor's most recent Federal Income tax returns.
I think I misunderstood all the Affidavit. As I'm reading now, the I864 has to be completed by my wife even if she is unemployed. And my father in law, who fill out the first I864 has to do the I864A. Am I right?
I just wanna make sure and finish all this papers without an RFE again.
Thank you very much.

I will try again when i get my approval. Right now im waiting for the biometrics and then the interview date. Maybe i should try when i get my work permit, we'll see.

Hello! Im in the process for my AOS and my Work Permit, my biometrics appointment is in less than 2 weeks, and I tried to get my driver's license and they tell me that I can't until I have my approval. Does that mean that they need the approval for the GC or just the Work Permit? Because the GC can take more than 3 or 4 months.
Thankyou!
-
I can't remember. But maybe because I was filling and signing everything so I could forget one. We'll see. The good news are that my AOS is accepted so if this is the only problem, im happy haha.
-
Ok, after my 35 minutes waiting, they said that the I-485 and the Work Permit (I dont remember the form number) are accepted, but the I-131 is rejected because the fee or I didnt sign it. So, the second one it is, I have to send them again the I-131 with the copy of the I-485 NOA when I get it and that's it.

Hello again! A few days ago I started a new topic here: http://www.visajourney.com/forums/topic/408700-problem-with-aos/
So, after that, today I received a Rejection Notice with this: The check amount is incorrect, os has not been provided. Please review the form instructions for fee information. Please resubmit the application/petition package with the appropiate fees to the adress listed on the bottom of this page.
Does that mean that they rejected everything the AOS or just the 131? And I dont understand why they rejected because I sent the check with $1070 as they said on the instructions.
Im calling USCIS right now but there's 30 minutes of wait. FML.
Any ideas to help me?

There were 2 holidays since you mailed it, so I think it is to be expected for it to be a little slow.
Yeah, that was i thought, but i read more people who send it at the same time and they have their NOAs, that's why. Anyways, i called them and they said that i can call after 30 days, and i dont have to be worried for mi i-94 because i send it so anytime soon they'll cash the check and send me the NOAs. So, i have to wait.
-
My buddy just got his letter from a mailing about the same time, look for your check clearing. I believe he got a text or email first..
I still have the money, so they didnt cash it. Im gonna try to call them because im starting to be so worried :S

Hello guys! I sent my aos package to chicago on December 24 and they received it on the 29th and I'm still waiting on a notification by email or through a letter OR them to cash the check. Is it normal that they are taking more than 10 days to notify me of anything? Because I'm worried now thank you!
Also is there a number I can call and maybe ask if it isn't normal?
-
Do you know the phone number to call them to know where my package is? Because I'm still waiting for everything and I'm seeing more people who send it after me and they have the notification. And my i-94 is gonna expire in 5 days.
-
Aaargh! Still waiting for them to cash out the money of the check and to notice me!
-
Did you verify if your check has been cashed???
I just did and I still have the money, pfff.
-
Hello!
Well we sent it on late december and they have it now, but im still waiting for the email, do you know how long does it take? because they supposed to receive everything on the 29th, so i hope they send the email or the NOA1 soon.
