  1. Bio letters are typically mailed out within 30 days after USCIS receives ur application. You should have called them to inquire about it if it's been over 30 days and you haven't received the letter. I went through the same thing, I was told my bio letter was mailed but I never received it and it wasn't return to USCIS as undeliverable so I think often times USCIS do make mistakes they just don't want to accept responsibility. If it has been over 2 months and they say it's already been mailed then you may already missed ur appointment. I would schedule an info pass at ur local office and tell them ur situation or call customer service and request to speak to a tier 2 rep. I don't think they can email you a bio letter I think you actually need the hard copy to bring with you to the appointment. I had to start over again all because I didn't received the bio letter so it's frustrating when it happens so I can sympathize with ur situation.

  2. Go to USCIS.gov and download form I-90 or apply online. Pay the $450 fee. Submit a copy of ur grandpas GC with the application. Once USCIS receives ur application they will send you a NOA receipt a week or two after you submit the application. Within 30 days they will send a letter for him to to appear at an ASC for biometrics capture. After bio you basically wait for USCIS to process ur case which can take between 3.5-6 months to receive a new GC so be sure to apply well in advance before his GC expire.

  3. You mean your appointment is for 05/08/2012 right? As in May 8th 2012?? I went in for an early bio walk in last month and had no problem although I live in CA. It's worth a shot, the worst they can do is make you go on your appointment date. In my case I went in on a Thursday afternoon and was the only one there so if they're not busy they should take you.

  4. When you file for ROC next year you'll need a copy of the front and back of the GC but since you only have the front then you don't really have much of a choice but to file for a replacement. It's an expensive lesson but ultimately it's wise to have a valid GC in ur possession just in case you need to travel, verify for work etc. You shouldn't carry ur GC with you unless you absolutely need to. A state ID or DL is sufficient enough and it's less time consuming and much less expensive replacing a state ID card or DL than a GC.

  5. Why would he even let his GC expire in the first place? He should have applied for a renewal several months prior to the expiration date. Just because he served in the military doesn't give him special privileges he still needs to prove his LPR status upon re-entry. You mention he did not take his expired GC with him to Germany so what did he use to enter the US? If and when he gets back into the country he can apply for form I90 to renew his expired GC which could take up to 6 months.

  6. Yeah, I agree...I think I just gotta wait it out, but as I said I'm desperate to get that EAD! Speaking of EAD and of course the biometrics which kicks off the EAD processing as they need your fingerprints and picture for the card, should I call them again and get a case request created for not having recieved biometrics appt letter. I mean, I don't even know if that letter that got sent back to the USCIS by the post office was actually the biometrics request letter, it could have been something else, right now the reqeust that was created through the phone Customer service rep. was to re-send whatever couldn't be delivered by the post office coz of the address typo!

I mean it could be one of those situations where it's just a delay on their part and the letter hasn't even been sent out yet?

In that case, I'm eligible to hear more as to why there's a delay speacially becuase it's been 43 days since the case was filed and they normally tell you that they try to send out the biometrics letter within 30 days? What do you guys think?

    Thanks,

    Dave

When you called customer service today did you tell them that its been 43 days since you file ur case but have not receive the bio letter? You can ask them if the bio letter was generated and mailed out. Since its been over 30 days they should be able to tell you if it has or hasn't. When I called USCIS they were able to tell me when it was mail and when my appointment is. I'm not sure what the infopass will accomplish because all the questions you have can be answered by calling customer service and requesting to speak to a tier 2 rep. My file my case on January 25, 2012 and got my bio letter about 3wks later so its unusual if you haven't received urs after 43 days unless there is a backlog in processing EAD cases at ur service center.

  7. USCIS typically sends out biometrics letter within 30 days of receiving your application. You should call USCIS customer service and request to speak to a tier 2 IO. He will be able to tell you the date the letter was sent out and when your appointment will be. I had to learn it the hard way because I never follow up on my biometrics letter and thus my case was considered ABANDONED and DENIED so now I have to start the application process all over again including service fee.

  8. I file for I-90 July of last year and never received my biometrics notice in the mail and as a result my application was denied. USCIS claimed it was mailed but I don't think they did because I have never had issues with USPS with undelivered mail. Don't even bother calling their customer service hotline cause its useless and if they transfer you to an IO he'll just tell you to refile I-90 and pay the $450 unless you can prove that it was USCIS fault but you'll have to file a motion to reopen with evidence and pay a rediculous fee which will cost more than $450. In my case I just refile I-90 paid another $450 for a new GC, finally got my biometrics done last week. I suggest refilling I-90 pay the $450 because it's impossible to win with USCIS and just know it could take up to six months to receive the GC. It's unfair because we believe they're at fault but they don't want to be accountable for it do we end up hurting our pockets. If and when I receive my new GC I'd have spent $900 for a replacement not to mention waiting almost a year for it.

  9. Hello,

I am a US citizen and in a process of getting a permanent resident card for my wife whom I married last year. We just got biometric scheduled, but do not know when the interview will be. As I prepare the tax return for 2011 filing jointly, I am preparing to submit W-7 form to obtain ITIN. The best supporting documentation for form W-7 is her passport. But I am hesitant to send her passport to IRS because we may need to bring her passport to the interview with USCIS.

Does anyone know if we need to bring her passport to the interview? Her friend told her that passport is not needed for the interview, but I want to be 100% certain before I send her passport to IRS.

    Thank you.

When you get an interview letter from USCIS it will specify the time, date, place, and what you need to bring to the interview. When I had my AOS interview almost 3yrs ago I had to bring my passport but all she did was look through it. You'll know what you need to bring when the appointment letter comes for the interview. I hope this helps.

  10. I just sent in an application as well. My received date is January 23, 2012 and on USCIS's website it says The acceptance step is typically completed within 2 business days of when the application is received so unless ur case is "touched" it will remain at the acceptance stage. My case is still at the acceptance stage even though it has been 9 days. If you haven't already done so sign up for case status updates to receive updates via email or text. USCIS will notify you about ur case when they make a decision or if they need something from you. Good luck.

  11. Hi, we just received a letter to our old address(fortunately a relative's home) to submit a petition to remove the conditional status. It mentioned submitting a change of address form.

We moved into our apartment over a year ago and never submitted a change of address. Anyone have any experiences with the outcome of this?

Kinda nervous right now, sorry for the grammar.

I didn't submit a change of address until 8 or 9 months after I moved because I didn't know I had to until I found out its required. Just go to USCIS's website and submit a change of address as soon as possible and you should be fine. You didn't intentionally not update your address because you either forgot or like me didn't know you had to so they won't penalize you. Good luck with the outcome.

  12. Sorry for your situation but it seems apparent that you have no other option but to start the process all over again. Very expansive lesson learned here. I was wondering do we have to renew our work visa, I still have one more year before having to renew my temp green card, whew! But than again this entire situation has been one expansive ride and a never ending money pit!

If you have to renew your temp green card within a year I suggest you renew it 6mths before it expires to avoid any delays. I learn a very expensive lesson. Today USCIS sent me a confirmation email that my application has been received and routed to the NSC for processing and within 7-10 days I will receive my official receipt Notice with my receipt number. I wish they would notify me by email like they do now everytime my case is being "touch". Had they sent me an email informing me that my biometrics letter was sent out I would probably not be in this sitation like I am now. The check for $450 was also cashed today. I hope i'm on the right path this time without any incidents.

  13. Its very frustrating because I submitted my i-90 application since July of 2011 and for them to tell me to file again and pay the fee is just outrageous. I submitted a new application last week and paid a new fee of another $450 so thats a total of $900 for a new Green Card not to mention how long it will take to process the application. Does USCIS think we have disposable income lying around. Its easy for them to say file a new application but what they don't realize is its costly and time consuming or maybe they don't care they just care about the money. This whole ordeal has caused me so much stress. I just hope this whole process will be over soon.

  14. Yes it was my fault for not following up on my case. I just figured they would send me a status update online when they mail out my biometrics as I am register with USCIS for case update. I guess I have no choice but to start over. I just don't understand why they don't just send out a new biometrics notice. USCIS makes everything so complicated and costly.

  15. Hello everyone, my name is Aaron and i'm new to this forum. I've been dealing with a very frustration immigration situation during the last couple of weeks and need ur advice would be greatly appreciated. On July 11, 2011 I submitted application form I-90 to replace my permanent resident card. USCIS cashed my check and sent me a notice of receipt with a case number informing me the application has been received and in process and the next step is to attend a biometrics appointment. On December 27, 2011 I receive a status update online notifying me that my case has been denied for failure to attend biometrics capture. I was horrify because I had never receive a letter in the mail nor a status update online that a biometrics letter was sent out. The following day I called customer service hotline spoke with an immigration officer and told him that I had never received a biometrics appointment letter in the mail. He told me he would put in a request for my case to be reopen and a new biometrics appointment. On January 12, 2012 I received a denial letter stating my case cannot be reopen unless I submit form M-188 (Motion to Reopen) with fee of $685. I called customer service again the following day and spoke with another immigration officer and he told me the only thing I can do is submit a new I-90 and fee because I cannot submit a motion to reopen without any evidence and I have no proof that USCIS failed to send out my biometrics letter and according to the officer it was sent out on August 2, 2011 with an appointment for August 22, 2011. For whatever reason I never receive the letter which is very frustrating and i've never had a problem with the post office for failing to deliver my mail. USCIS has no record of the letter being return as undeliverable and they are blaming the postman for the mistake. I don't know who is at fault but I am the one being penalize for their mistake because I have to submit a new I-90 form with the fee of $450 that I do not want to spend. Has anyone been through similar experience that you can share or have advice you can give me. Thank you.
