    A common misconception is "if it isn't paid, it's not a job, and thus not illegal." Logically, US immigration law does not exist to prevent foreigners from getting money. It exists (in part) to protect American workers. A babysitter is an American worker. The issue is - If you bring in a relative to babysit, paid or not, an American who could have otherwise been paid to do the job, lost out.

    There is a fine line between a visiting relative "hanging out with the kids for a day" and a visiting relative "taking care of the kids for a month." Legally, the lines are blurred. Be cautious.

  2. I'll share something from my personal experience. I was going to travel to the usa to help look after my bf's daughter while his grandmother was sick. This was seen as a job that could be done by an American despite the fact that I'm not being paid. That's why I say be careful.

    Thank you for all your responses. I appreciate that so much. Anyhow, I think the previous denial was because she and her son both applied for tourist visa and that she is a single mother even if she has properties in PH it didnt really establish her ties with the home country.

    This second attempt would just be with her dad, she wont be bringing her son along because son is still studying. Also she is taking up make up artistry in the Philippines, so she is not like professional Make up artist yet.

    so mainly what she needs to do is establish that she will be coming back to the Philippines.

    Hope all is doing great. I do have a question for a friend of mine who wants to visit the US. Her dad, a senior citizen, wants her to accompany her to the US to visit her brother also to have a short vacation. Also I'd like her to be my make up artist for my pre wedding pictorial. Her Parents have a B2 Visa. She tried applying for B2 visa last year but unfortunately got denied.

    What are her chances of getting a tourist visa? what are the chances of getting an approval for someone who is accompanying a senior citizen? Is getting denied the first time have a weight on her 2nd attempt of applying for B2 visa?

  5. I think these Consuls just wants a brief answer. When my parents were asked the purpose of their visit they just said we are visiting our daughter. thats it no beating around the bush. i think when you talk and explain too much you open a can of worms and would make them even more suspicious even if you have true intentions or being truthful. No one really knows the answer to how someone gets approved.

    Its been a while since I last updated my status here in VJ. Anyway, I arrived here in the US last June 2013 on a K1 Visa, Got married August 2013 and then we're just about to file our AOS for my green card. I know right it took us a looonnngggg time to file.

    So the question is, for the affidavit of support do we need all docs like W2, receipts from paying fed taxes and certificate of employment or can it be either one.

    Super thanks for all the responses. So i went to Japan airlines yesterday to ask or maybe try to rebook the flight and make it Narita to SFO, the lady said i dont need a transit visa, when i get to Narita I will ask for a shore pass so I can go out of Narita and to Haneda. japan airlines doesnt have any direct flights from Narita to SFO, all flights are being directed to Haneda to SFO. She said transit visa is only applicable if I will be staying for 24hrs and more.

    You don't need a transit visa as long as you are on a confirmed ticket and not a standby ticket. The airline takes care of everything. If for some reason the flight is cancelled and they would need to put you up in a hotel, tbey would arrange for your visa. This is an agreement between Japan and major airlines. Best to call the airline so you get the answer yourself if you're worried about it.

    If your flying standby, meaning you have a buddy pass or a cheap standby ticket from an employee at the airline, you absolutely need a transit visa..

    I just wish I wont have any problems when I get there.

    Hope everyone is having a good day. I have a question and hope I can get right answers here. My fiance booked me a flight thru Japan airlines for June 15, its says Manila to Narita and then a 4-hr lay over and then Haneda- SFO. Since I will be transferring airports, do I need to file a transit visa? Is this something I need to file now while Im here in PH or will that be available in Narita.

    Did anyone here had that kind of experience. Please share and help me. Im kinda nervous because I will travelling alone.

    I saw this topic. My boyfriend had me booked for a Jal flight Manila-Narita-Haneda-Sanfo for June 15, Please help me understand, do i need a transit visa? is this something i need to file here or is it available in narita airport? I am travelling alone so I wanted to make sure my travel would be as smooth and worry free as possible.

    Also, on the japan embassy in manila website, why do i need a bank certificate if im just transferring airports?

    has anyone here had this kind of experience.

    thats very helpful information.

    State ID and DLs are very, very state specific. Some will allow you to use the I-94 and issue you an ID or DL and others will do nothing until you have the GC (Green Card) in hand. I would recommend that you get your SSC (Social Security Card) after waiting about 2 weeks after arrival. You will need that number for all kinds of things here in the US and as a K-1 visa holder you are eligible to receive one while the I-94 is valid (up to two weeks before it expires). You have until the I-94 expires to get married and after getting married you need to file for AOS (adjustment of status) which costs $1070. The sooner you file AOS the sooner you can work and travel internationally. It is recommended that you also file EAD (Employment Authorization Document) and AP (Advance Parole) as they are free when you file for AOS and usually arrive sooner than the GC.

  11. I believe the visa will expire 6 months after your medical exam. And you have to leave your country before the said date in the visa, which is July 10. Upon arrival in US you're given 90 days to marry your fiancé.

    Thank you so much for your responses. The thing is, when I had my CFO seminar last Friday I asked my co K1 applicants the same question and they said I need to leave soon and that I need to get married before July 10. Given that information, my stress level went up. Im glad and thankful for Visa journey at least everything is crystal clear. Thank you for responding so quickly.... group huggggsssss

  13. I'm sure someone will correct me if I'm wrong, but ... I am pretty sure you need to ENTER THE USA before July 10. Upon entering the USA, your K-1 visa is "used up" and no longer applies. You then have 90 days to marry your fiance (starting from whichever day you enter the USA).

    I am puzzled because that seems like a short validity (only 3 months?). Usually K-1 is valid for 6 months, I thought. Did you have your medical exam quite a long time ago? I believe the K-1 is valid for 6 months after the medical, so that may be the reason why yours seems shorter than most?

    Yes, i had my medical exam January 2013, I was scheduled for interview same month but there was a delay with the affidavit of support because my bf had it sent through USPS. So he had to request for another batch of documents and had it sent using fedex. Thank you for the speedy response. much appreciated

    Good day to all. Hope all is good. I got approved last April 3, got my visa 2 weeks ago. The visa says issued April 12, 2013 and expires July 10, 2013. Please help me understand, Do i need to be married before July 10, 2013 or do I leave my home country (Philippines) before Jul 10 2013? I was under the impression that I am given 90 days upon arrival in the US.

    Please shed some light.

    Sa NBI clearance ba for Travel abroad or US Visa? ANong NBI ang finile nyo? Help me.

    Ang schedule ng interview ko Jan 17, 2013, is it advisable na mag pa medical or sa January ko na gawin or kelan ba ang dapat?

    Gaano katagal marereceive ang ITR kung kababayad lang last week (affidavit of support) - reason kya ako nag reschedule kasi worried ako na baka di ko mareceive yung affidavit of support on time.

    Kailangan ba ang copies ng passport ng petitioner? Aside from ITR ano pa ang kailangan nya isend?
