  1. Hi All,

    I filed I-130 for my parents mid this year and got RFE hard copy today. RFE says:

    You submitted what appears to be the English translation of birth certificate for <my name>. You must submit a photocopy of the original foreign language birth certificate for Ishor Dhakal AND a new full English translation of that document. This must be a complete translation of the original document in its entirety. Extract or summary translations of the original document are not acceptable. The translator must certify that the translation is in complete and accurate, and that he or she is competent to translate from the foreign language to English.

    I submitted following documents for filing petition for my parents.

    1. Separate I-130 form for my mom and dad.

    2.Photocopy of certificate for of my Parents ( Written in English Language) .

    3.Photocopy of English Translated birth certificate of mine.

    While submitting N-400 for myself and I-130 for my wife, I have used same photocopy of my birth certificate and I never got any RFEs. I don't know why they are not accepting my document and requesting another one with my original birth certificate. Also I have lost my original birth certificate written in my native language and the only one I have is the English translated birth certificate. Do you think creating a new birth certifcate from the record with be an issue?

    Also in Nepal, Notary public does translation from Nepali to English. I dont know how to assure USCIS that they are competent to do translation.

    Any thoughts or comments in this will be highly appreciated.

  2. I know there are a lot of examples of package but I would like to make sure I'm not missing anything and another pair of eyes can't hurt... and I've noticed there are some people on this forum that really know what they are talking about.

    We got married in October 2013 in Colombia and we live together. We have known each other for 9 month, she is 29 and I am 32. (if that matters)

    I will put the whole package on ACCO Fastener with tabs at the bottom.

    Here is my table of content of my Cover letter. Is this all I need to send?

    1. Form G-1145: e-Notification of Application/Petition Acceptance.

    2. Cover Letter

    3. Form I-130: Petition for Alien Relative (Immediate Relative (Spouse)).

    4. Check for $420 payable to U.S. Department of Homeland Security

    5. Copy of ALL pages of the US Citizen's passport.

    6. Copy of petitioner's proof of naturalization.

    7. Copy of petitioner's proof of permanent residency. (Cedula de Extranjeria)

    8. Copy of the immigrant's birth certificate. (With English Translation)

    9. Copy of the immigrant's passport.

    10 .Certified Copy of Marriage Certificate. (With English Translation)

    11. G-325A filled out by the US Citizen, signed and dated.

    12. Two passport-type photo of US Husband

    13. G-325A filled out by the foreign spouse signed and dated.

    14. Two passport-type photo of Colombian spouse

    15. Evidence of a bonafide marriage

    - Affidavits sworn and signed by friends and family.

    16. Evidence of a bonafide marriage

    - Random pictures of us together in Manizales and Chinchina. (January 2013 to [Present])

    - Pictures of our first trip together to Cali, Colombia (Mars 30th, 2012 to April 2rd, 2013)

    - Pictures of our second trip together to Santa Marta and Cartagena (July 2nd, 2013 to July 6th, 2013)

    I did all the translation myself with the ... I (me) certificy that I am fluent....

    Everything looks good to me. Make sure you write name and date of birth on back of each US passport size Photo.

    2 yrs age gap should not matter, my wife is 3 years younger than me.

    Regarding the English Translation which you did by yourself, I am not sure about it. I translated all the document from certified translator from my wife's country. I hope someone from here can enlighten about it.

    1st of all we appreciate everyone for their help and support which have brought us until this point. My wife will be having her CR-1 Visa interview just three weeks before our 2nd marriage anniversary. So if embassy took time to (more than 3 weeks), then does embassy grant IR-1 visa, or still it will be CR-1 ?

    If she was given CR-1 Visa then she will enter US only after our 2nd marriage anniversary, and we are confused what happens at POE if she enters US after our 2nd marriage anniversary? Will they change her visa from CR-1 to IR-1 at PoE or what happens ?

    Please let us know your thoughts. we will highly appreciate if someone with similar situation can share their experience

  4. Hello friends:

    Our DS-260 (Immigrant Visa Application) is available to be submitted online, does it absolutely have to be submitted by the beneficiary? My wife is in remote part of Nepal where internet is not readily available. So, i was thinking why not I submit the application on her behalf as a Primary Applicant.

    If I (the petitioner) submit the application, does it have any adverse impact? Do they track IP addresses or any other tracking system that would make the application invalid or get rejected during the NVC processing or at the interview because the application was not submitted by the beneficiary?

    Any petitioners who filed DS-260 on beneficiary's behalf and had no problem?

    KP&SP, I had same doubt and I filed both DS-260 and DS-261 by myself on behaf of my wife. I even called and asked NVC customer service personnel before filling the form by myself on behalf of my wife.

  5. hello everyone i am just wondering what comes next after i get the case number...please share your experiences you had with the nvc because i am learning from the experiences i did read the nvc chart but i wanna make sure from everyone experience smile.png ...and when we can submit the DS 3032 to the nvc is it the same day we get the case number or not ? ......and when we can get the invoice identification number ? please share your experiences only

I submitted by ds260 (september 13)after reciecig a checklist due to the new form which i had already submitted in august he ds230.the 20th of september nvc received the police certificate i resent jut incase and until now no case complete can anyone gove me their opinion suggesions please how much more is the wait time

    NVC approved our DS-260 after approximately 30 days of submitting it online. You can check details at my signature below.

  7. Not sure whether i am posting this question on right place or not. If I am not posting on right forum then I apologize for this. I am posting here because, as far as I know, K-1 processing step requires I-134 and I think I can have someone in this forum who can answer me.

    I am USC and I married non-USC who is current residing in her home country waiting for her CR-1 visa process to complete. NVC has already been completed the case and we are currently waiting for Interview at US Embassy. I have filed I-864Ez form for my wife on AOS ( Affidavit of Support) stage.

    So my question is, Can I be a co-sponsor for my friend( non- USC) who needs someone to sign I-134 ? I have already signed I-864Ez for my spouse, does it prohibit me to sign I-134 for my friend? Does Signing I-134 for my friend effects my wife's CR-1 Visa Processing?

    I want to help my friend, but at the same I want to make sure I am doing things in correct and legal way. According to US Federal Poverty guidelines, My income level is enough to sponsor upto 7 people. My friend is trying to get admission in college and his college wants him to have someone who can sign I-134 for him. I am not knowledgeable on I-134, what are the legal bindings of I-134?

  9. I called NVC I was kinda expecting them to be closed because of the government shut down but instead they were actually there. We submitted the last of our documentation in the beginning of August. Had to complete the online application beginning of Sept and was told 30 days more. His police report expires end of this month so I called to find out what was going on and to my utter amazement I heard the words I have been waiting so long to hear " your case was complete on Sept 27th you are just waiting for your interview to be scheduled in Lagos now" OMG finally thank God now we are finally to the interview. Granted alot of the wait was him getting his passport but still it is almost over now. I cant believe it...

  10. Read the first two post of the NVC Filers October thread. It is quite a regular occurrence for NVC to issue such 'false checklist'. Just call them to confirm receipt of your civil documents.

    I'm betting it's a false checklist based on them reviewing (and accepting) your AOS package the other day wink.png The thing is, when NVC reviews packages, they quite typically issue a "false checklist" for the other package, even if it's in the building already (they don't bother checking to see if it's there).

    They probably didn't put it in the system yet and that letter and your docs probably cross each other.

  11. Hi Everyone,

    We submitted DS-260 on September 19 and Mailed our Civil Documents to NVC on September 20. Civil Documents Showed up in NVC's System on September 23.

    Today we got checklist from NVC that they are waiting for Civil Documents from us to review DS-260 form. We dont understand why they are asking if its already with them.

    Have anyone been though this? We will really appreciate your thoughts and comments on this issue

  12. On the last page of the instructions, the following is written in the "Check List" section:

    What about the tax transcript for the most recent year? Earlier in the instructions, it is stated that a tax transcript can replace the Federal income tax return/W2 combo

    I submitted following Documents with my I-864Ez and the form is already approved by NVC:

    1. Tax Trasncript of Last three years from IRS

    2. W-2 from all employers from Last three years.

    3. Employment letter from current employer stating my current position and annual gross salary.

    As Mentioned by Darnell above, these two are not related at all. You can see at my signature below how many days it took for NVC to issue IV bill after I sent I-864 Packet. As Per my Signature below, NVC put I-864 Packet in their system on September 11 and issued IV Bill was invoiced in September 16. Hope this helps. Wish you all the best on your IV journey.

  14. Hello Friends,

    My friend (US Citizen) is going to have an interview for his wife (Nepalese Citizen) in Kathmandu, NEPAL on Oct 3rd, 2013. Issue is what to say during an interview:

    he actually got married (religious marriage) on Feb 9th, 2013 and there is a 15 days waiting period in Nepal to issue a marriage licence and in marriage license it says that their marriage was registered on Feb 24th, 2013.

    Now the question is when did they get married, if the counselor asks? Feb 9th or Feb 24th?

    As far as I have understood the marriage certificate was issued from CDO office, right?. We didn't have that issue as we registered our marriage in our VDC office and got our certificate on same day( No waiting period) . I am sure consular will definitely understand this issue as they are working there from past several years and they know how CDO office registers the marriage. Explain the situation clearly at the interview and they will definitely understand it. This is NOT a big deal. Best wishes for your friends for upcoming IV interview.
