Hi everyone,
I have a quick question about the oath ceremony scheduling. I am sorry if this question has been asked before, but I could not find an answer.
I submitted my n400 in November 2016, and had my interview in early September 2017. I was recommended for approval after the interview, but did not receive any update until January 2018. I knew that USCIS had 120 days to make a decision, so after waiting 121 days, I called, placed a service request, and my status changed the next day to "Your oath ceremony will be scheduled." It's been a month since my online status changed, and I have not received an oath ceremony date yet. It's been 5 months since my interview, so I am getting a bit impatient. Here is the question: I know that USCIS has 120 days to make a decision on a case after the interview, but how long does USCIS have to schedule/administer the oath, if there is such regulation?
I requested a name change, so this is probably the reason why this whole process is taking so long (my case is really simple otherwise). I cannot make an infopass appointment. I live 7 hours away from where I had my interview (and with a small child, I don't want to drive all the way there if I can avoid it).
Thank you, everyone, for the help!

Thank you for your answers! This is really helpful. I never thought this process could be so stressful!

Hi everyone,
I have a few questions regarding the K3 visa and how to go with the CR1 visa instead. At first (and before I began reading VisaJourney!), we thought we would try both visas and see which was faster. Now, the circumstances have changed, and we definitely want to go the CR1 route because I can't move to the US before the end of the year.
Both I129F and I130 petitions were approved the same day (early May), except that on the I130 notice approval, it was written that I (the beneficiary) was in the US and I was adjusting status. My husband had called USCIS, and they had told him that it was a wording mistake on the notice, but that our petition was being sent to NVC. They refused to send a corrected version of the notice though.
My husband called NVC a few days ago, and they said they hadn't received anything yet.
Problem: today, my husband received an email from NVC saying they were forwarding the I129F to the Paris embassy.
Does it mean NVC hasn't received the I130 petition?
What will happen when they receive it?
Can we still continue the CR1 visa and how can we do that?
My husband is travelling to Europe tomorrow, so he won't be able to call USCIS and NVC before Tuesday evening and I'd really really really appreciate your comments.
Thank you very much for your replies.

Hi everyone,
We filed both the I130 and the I129F (for CR1 and K3 visa - we now know we should not have filed I129F...but too late!). And I have read somewhere on this forum that we shouldn't withdraw the I129F as it could cause a big mess and a big delay.
Both petitions were approved a few days ago, and my husband received NOA2 for both petitions yesterday.
The problem we have is that the I129F is correct and states that the petition has been forwarded to NVC. However, it is written on the I130 NOA2 that the beneficiary (me) is living in the US and that we are adjusting status, which is not what we're doing...
My husband, the US petitioner, called USCIS and he was told that it was just a mistake on the NOA2, but that our I130 petition will be sent to NVC. However, they refused to correct their mistake and to send us a corrected version of NOA2.
Is this going to be a problem in the future that we have a NOA2 that states that we are adjusting status? If so, what do we need to do to make them send us an updated version of the NOA2? How can we make sure that they are really sending the I130 petition to NVC (and to avoid NVC to begin processing the K3 visa)?
Thank you so much!

You are forgeting one variable, the one variable we've been telling since the begining: fraud.
Now let's say they were 10000 german applicants before applicant A and 10000 Nigerians before applicant B.
10% of Germans committed immigration fraud. 20% of Nigerians committed fraud. The fraud has a bigger impact applicant B because there was more fraud, therefore, it'll be more difficult for the Nigerian to prove that he's genuine. Is it racism?
-
Do not think this way. It's not because one guy in the US is committing fraud that there is generalized fraud in the US, and it's not because one guy in Kenya for example is a billionaire that everyone is rich in Kenya. Look at trends, not particular cases.

Madoff and Martha Stewart weern't applying for visas...what do they have to do with any of this? They are american citizens who committed federal crimes in the US.
Yes exactly, it's like if you were saying: Mr. X commited murder in Great Britain, therefore there is imigration fraud and people shouldn't get visa approved!
-
Fraud can be done anywhere, you are completely right, except you're forgetting the fact that there is more fraud in some countries than in others. This has nothing to do with racism.

I completely agree with life's journey. People in Europe tend to fraud less because they already have a very good quality of life. This has nothing to do with racism.
Also, but that's just a thought, maybe there are more approvals for people from 'rich' countries because both the petitioner and the applicant have money (and WVP) and therefore can spend more time with each other than those who can only see each other when the US husband/wife/fiance travels to that country, so the relationship might look more "serious" in the eyes of the US immigration officer (don't be mistaken, I am not saying these relationships are not serious, just the US officer might think that).
Please don't see racism everywhere.

Sorry to intervene in this post with a question, but I am in a similar situation (I129 and I130 approved the same day even though the I129 was sent about 2 months and a half after I130 - We would like to go the CR1 route).
You all seem to agree that it is highly likely that the K3 will be administratively closed and that's valuable information for me. That's maybe a stupid question, but do you know if a notice is sent to the petitioner or applicant informing them that the K3 is abandonned or not? Or do we just assume that it will eventually be closed? Also, canadian_wife, you said to just ignore any correspondances related to the K3. Is it clearly written on the documents which document will be used for the CR1 and which ones will be for the K3?

Thank you both for your answer.
Karalynn, thank you for your offer, but for now, I think I'm first going to try to get the documents at the Syrian embassy in Paris. You probably know how bureaucratic Syria is... and I want to avoid having to send/receive documents to/from Syria (I have done it in the past, once a simple letter took 7 months to arrive in Syria...)

Greetings everyone,
I have been watching the forum for a while now, and I have a question. My USC husband has filed a I-130 for me (CR1), and it should be approved in a few weeks. We are now preparing for the next steps.
I will need to get a French and a Syrian police certificate. The process to get a French police certificate is pretty easy.
However, does anyone know how to get a Syrian police certificate from an embassy abroad (Paris specifically)? What documents do I need to provide in order to get a PC? To provide a little background, I am both French and Syrian, but I do not hold a Syrian passport, and I am not planning to go to Syria anytime soon (ie not before the situation gets better, which sadly probably won't happen before the final approval of the visa). Also, does anyone know the validity of the Syrian PC and how long it takes to get one?
Thank you very much!
PS: Moderators, I wasn't sure if I had to post the topic in the CR1 forum or in the regional forum. Please be indulgent if I misposted it and do not hesitate to move it to the right place :-)

Thank you, both, for your answer. I tried to do an e-service request, as suggested, but it says that I am still within normal processing times (processing times for Memphis are "as of November 30" so they haven't been updated in a while). I guess I'll wait a bit more then start to make some phone calls. I didn't actually move, but I live in East Tennessee, and had my interview in Memphis. There is a place in Nashville (3 hours away)for infopass, but they only do biometrics so I don't think they actually have anyone to give you real answers (different from what we can read on the website). Good luck to you both with your applications!
