Hi,
The way GlobeHopperMama explained it was the way I started out, but I was then told differently. I planned on having both prepared just in case. After looking at the forms closely, the way GlobeHopper said seems correct. Same household address = i-864A for co-sponsor.
But my household member will not sign the AOS, so i'm left with the i-864 option regardless. Even if i'm able to show that the co-sponsor would not be liable for medical bills to the immigrant, but im not giving up yet. I want to travel with my wife, not go to US and then send for her later.
Im glad to hear about ilovedo's response about having a scanned copy instead of a fresh ink copy. I'm willing to try that.
Thanks Kindly for everyone in VJ,
MHiko

Thanks ilovedo, we are hoping to to have our AOS complete, but if not, I will setup the interview regardless and have faith we will be approved. I have shown we have a bonifide marriage with 3yrs of living here and having a beautiful baby boy. We have completed the CRBA and he has his US passport. I have read many DCF interviews in Manilla and rarely has the AOS been discussed. I understand the requirements so we will do our best to get them ready.
Thanks again,

Sorry for the confusing question, After a day of research I will explain my error that got me started down the path of a K-3.
I need a co-sponsor, i-864, for my IR-1 but family was saying it's too risky and i should fly to US without her and setup a job 1st. They are correct, but I don't want to go without her. So I started looking at options and I read about the K-3. It said that she could come to the US with me while the i-130 was being processed. THIS is where my confusion started, because I was not understanding that the i-130 use to take a long time to process, which is when a K-3 could be pursued. Mine has already been approved and thus the K-3 option is CLOSED.
I sure appreciate your responses. Maybe this will come in handy for some other traveler.
I now must try to alleviate the fears of an i-864. I'm researching the cases where claims have been made to require the sponsor to start coughing up money to give the beneficiary. All of which I know would never happen with my situation. But worse case scenarios are what's being discussed.

Just another thought about the i-864...
The 864 does have certain contractual obligations that the Immigration Atty, that my family spoke to, said was not recommended. The atty also said that Manila was the most corrupt embassy. Not sure why he said that and it wasn't worth pursuing. But as far as some resarch goes, one of my documents for 864 legal precedents was on a Florida Bar website: My link
None of which pertains to the worse case scenarios my family talked about. They are concerned that if I get disabled or die, or if my wife gets injured or ill, then they would be liable for the medical bills or whatever. Still doing research to alleviate these concerns.
I hope I will find a sponsor, because I'm not sure how long it will take me in the US to qualify for Affidavit of Support on my own.
Thanks again,
Miko

Thanks, I will review my domicile proofs.

I just want to clarify my statement:
Both, you and your sister will use form i-864, if your sister's income alone can qualify for the 125% poverty guidelines. Otherwise, with combined incomes, then she will use i-864a.
Hope that helps.

Im looking at K-3 non-immigrant visa, Manila. If I have an approved i-130 Petition which I filed DCF in Manila on June 26, can I file the i-129F in Manila also?
According to the http://travel.state.gov website, to apply for the K-3 Visa, I would file the i-129F after the i-130. Im confused if the i-129F can be done DCF, since the addresses given are in the US only and it doesn’t give any notes if it can be DCF.
Im also confused by the website statement if the i-130 is approved first, then the K-3 visa option ends. The website link is below.
The First Step: Filing the Petitions,
You, the U.S. citizen sponsor, must first file Form I-130, with the (DHS), (USCIS) office that serves the area where you live. You must then file Form I-129F, to file the petition for a K-3 visa. See Direct Filing Addresses for Form I-129F, Petition for Alien Fiancé(e)( USCIS ) for information on where to file the petition for a K-3 visa.
Important Notice: Effective February 1st, 2010, when USCIS approves the I-130 before the I-129F, the availability of, as well as the need for, a nonimmigrant K-3 visa ends.
I have been married and living in the Phils for 2.8yrs now. Kindly, any thoughts on this is greatly appreciated.

Hi Brian, The docs for your interview are listed here: http://manila.usembassy.gov/wwwh3217.html
Your 2011 should be enough and the 2009 is good for added support docs. I think your burden will be proving that you will have income in the future. Meaning it might be good to have a statement from your employer (or other means of proof) that will indicate what your salary will be.
hope this helps.

Hi Matthew, I learned that if your sister's income is enough to qualify as a sponsor, then she will fill out the i-864. But if, like you said, it has to be a combined income with yours to qualify, then she will use the i-864a.

Yes, your case is going great! You should receive a letter with instructions for getting the interview started. It has a form DS2001 which says that you have all your docs ready, your wife signs this. You send it by fax, email, or deliver it yourself. Im doing mine by email. After they receive this they will tell you how to setup interview. Not sure about this part on how to set interview, but it seems easy to do. When you have the date available and an appt letter, you can start setting up your medical exam at St Lukes, this can be done online too. In your statement about your docs you have, do you have your i-864 (affidavit of Support)done?
I just found this link to the letter we receive after we turn in the DS2001:

Hello fellow VJ's. After searching this topic, I wasnt able to find any results from someone who went thru an interview, so I may be asking an old question.
The question regards using a Tax Return Transcript or a Tax Account Transcript. It appears that from previous years posts that it depends on the country. So Im looking for Manila requirements. Both Transcripts have the required information for the Consul to approve our Co-sponsor, which is income, SSN, Name and Address. This information supports and gives proof that the information we filled in on the I-864 form is correct and official. To most people it makes no difference and will just use the Tax Return Transcript to be safe. But our issue at hand for us is confidentiality. The SSN's and other private info is on the Return Transcript but not on the Account Transcript. So please remember this in your replies. And the reason we like the Transcript option is because they do not require copies of W2's and 1099's when a transcript is used. This instruction is stated in the recent Petition Approval packet we received recently in the mail. But we know that experience is the best proof.
Also, does anyone know what happens to the case file after the interviewer grants approval for the visa. Does the tax documents get seen only by the Immigration Consul that does the interview? And then does the file get sealed in a brown envelope, sent to us with the visa and then taken by us on the airplane to be submitted to the immigration authorities in Los Angelos,CA. (BTW, the above process was the explanation given by the Manila Visa help line operator)
Thanks in advance for your blessed help.

CFO
in Philippines
Yes, this is great info. Nice to know there is no expiry date. My wife did CFO in Cebu to get her name changed on her passport. We will need to get her stamp now.
Is there anything difficult about going to the CFO office to get the stamp? Is it located close to the USEM?
thx

I don't have an interview appt. I am just now submitting my petition this next week. Thx.

Bron, after reviewing more on the I-864 forms, I have found your explanation to be correct and I understand now. I'm sorry that my earlier post revealed that my thinking was incorrect. Thanks for that info, as I have reversed course and have been able to explain it to my brother.
Another reality check is the US Embassy is booked till August 17 for appts to register my Childs birth...grabe!!

Ok yes, you will need to get those for sure. My Filipino wife of the last 2.5yrs will be interviewed and I wanted her to be prepared if they ask her about my divorce in the states back in 2007. I am my wifes only husband and I don't want her to be burdened with having to answer questions about my past. She knows everything about my past, but I would like her to be prepared for any uncomfortable situation.
Thx for your replies

I would like to ask question about the divorce issue. Does anyone know what interview questions are asked when there are US Divorce papers present. (DCF in Manila)

Moved from IR-1/CR-1 Process & Procedures to DCF forum; OP filed petition at overseas USCIS field office.
Sorry, what does this mean? Is the discussion about preparing for interview been moved? Thx

Many many thanks. You brought up several things I was not aware of. You let me know I need the CFO stamp in my wifes passport. We completed the CFO n Cebu over a yr ago when we changed her name. So grateful to you for that info.
I found our DS230 form ready to fax. No prob there now.
Another good info is preparing a pc of mail addressed to my US address for domicile intent and another is the birth cert.for my brother and that his signature must be ink, not copy. I didn't understand your explanation of the I-864 issues, so let me ask if Im thinking ok: I am the sponsor petitioning for my wife. My AOS is form I-864. My last 2 yrs of income is not enough for 124% poverty, so I have a co-sponsor, my brother who prepares the i-864a. He is called a household member and the contract is between him and the US govt to provide funds for my wife should she ever try to claim benefits from the USgovt. (which I wonder how long that contract is valid??) So as long as his income is enough for all his dependents plus my wife, all is well. So the way Im thinking is that the I-864 and the I-864a is required in my situation.
Thanks for your presence on this forum. Congratulations on your successfully getting though it.
I will be scheduling an appt for my sons CRBA (child report of Birth Abroad) to get his USC and passport processed. That's when I will turn in my I-130.
Thanks again, cheers.

Also, I forgot, the i864a from my brother in the US.. does the form need be one with original signature, or can he scan it at home and send me the PDF copy?
Thanks again, Miko

Hi, this is Miko, thanks for new thred on DCF MNL. I'm filing the i130 this mo. All the docs listed on USEMBASSY MNL site are ready, but it didn't mention the i864 & i864a sponsor forms I have for support. So do I assume right that I don't need those when I submit the i130, but I will give those at the interview? I'm also glad I read something about a DS230. What is that? I thought I did a pretty good job looking thru this site but I missed that one.
A little info: I'm a USC filing immi visa for wife. We married in PI 2.5yrs ago & I hav lived here the whole time, we bought a lot, but lived n an apt, hav joint acct, and a 7mo old boy.
This forum is great cuz you guys are going thru it at the same time. I posted this question in another topic not knowing this one, sorry.
Thanks for any info, Miko

Hi, my first post. I am about to start DCF in MNL for IR1. Been married 2.6 yrs living in phils total. My question is I'm going to MNL to submit the I-130 petition with the required docs per USEmbassy MNL website. I have I-864 and 864a sponsor and co-sponsor forms, but when do I need to give them, at the 1st visit or at the interview of my wife. Thanks for any help
