  1. They probably won't be able to see their status until after their biometrics appointment. I'm pretty sure I had to wait that long before the receipt number would work. It sounds like they have only got their NOA1 and haven't done their biometrics yet.

    I got my biometrics appointment done on the 26th of April. In the original posting I mentioned that I have completed my biometrics. I checked my case status online between the 1st and the 5th of May and still nothing. I will call (if I can get through) and keep checking. But since I have NOA1 and I have finished my biometrics I know my case is there somewhere.

    As Steve D. said, if he is waiting for an approval for 10 months, this is a 'minor' issue for USCIS.

    I am aware, as juliava stated, that the form I got between the NOA1 and the biometrics is not an approval for ROC. I don't have an question about that and I am not under the impression that I should be getting a GC in the mail.

    I was only trying to figure out about the issue my case status not showing up online. Steve D.'s reply about the USCIS website not being trustworthy is reassuring. Its good to know I am not alone is facing this issue. Anyways, I have all the documents (NOA1 and biometrics) for proof.

    I filed for removal of conditions in March 2012. I have received my NOA1 and my biometrics appointment (which I have completed). In between the NOA1 and the biometrics letter, I also received (as have many others) another letter from USCIS with "CRI89 Approved Removal of Conditions" in the subject line. The receipt number on the NOA1 form is different from that on this letter. The receipt number on the biometrics letter was the same as that on the "CRI89" letter.

    I have tried to sign up for email notifications for case updates but I am unable to see the status of my case online. I can also not get email updates because the USCIS site says my case number is not present. My receipt number starts with "EAC". I have tried with both the receipt numbers (the one on the NOA1 and the other on the biometrics letter).

    I was wondering if anyone else also has had such issues. I will call the USCIS helpline but just wanted to know if others have experienced this and what action was taken to correct the issue.

  5. I have added my info for VSC..a bit late but was busy..Just wanted to also everyone know that I received another NOA today with a case number. The document is 2 pages, says "Notice Receipt" but also “CRI89 approved removal of conditions (I89).” This does not mean my case was approved. According to the USCIS (page circa 2008) that statement means that "the biometric portion of the case has been successfully transferred; it does not, however, mean that the petition itself was approved."

  6. I received the same form as mentioned here, the two page Notice of Receipt with "CRI89 APPROVED REMOVAL OF CONDITIONS (I89)". I did not think that this meant that that the case has been approved. People have been waiting for >6 months and it is too much to expect our cases to be approved within weeks. There is nothing that different about us. Plus the notice clearly states that it does not mean the case has been adjudicated.

    Following this chain of thought I did a search and found this page on USCIS' site:

    The page states that USCIS will change language in notices that state what we got. From the page, "The current transfer notice currently contains the following phrase: “CRI89 approved removal of conditions (I89).” That statement means that the biometric portion of the case has been successfully transferred; it does not, however, mean that the petition itself was approved."

    The kicker is that this page is from 2008. Maybe its not a surprise.

    So the wait continues. Sorry to crush the expectations.

    Just finished collecting the material for my ROC packet. I have read a lot about what constitutes good evidence on this forum and have tried to followed suit. I have also tried to go for quality and not quantity.

    So I just wanted a frank opinion on the material I am planning to send, based on your experience and knowledge. Is this good and strong? Anything else to make it stronger? Anything obvious that I missed?

    We have car registration documents showing common address but not joint ownership of the cars. Do you think we should still send these given the other documents.

    Note that some of the documents also show our current address.

    Here's what we am have ready to send (in addition to the fee, form and copy of GC):

    -Tax form 1040 for the 2011 tax year showing joint filing.

    -Tax transcripts for the 2009 and 2010 tax years showing joint filing.

    -First page of the bank statements for our joint checking account for 2009, 2010, 2011 and 2012. They also show our current address.

    -First page of the bank statements for our joint savings account for 2009, 2010, 2011 and 2012. They also show our current address.

    -First page of statements from February and December 2011 for our joint Certificate of Deposit (now matured).

    -Information about our joint Certificate of Deposit for the duration of 2 years from 2011 to 2013. This also shows our current address

    -Agreement indicating joint custody of safe deposit box at out bank.

    -First page of the rental lease agreements for 2011, 2010 and 2009 showing joint tenancy.

    -My 401k beneficiary form documenting my wife as beneficiary.

    -My supplementary retirement account beneficiary form showing my wife as beneficiary.

    -Wife's life insurance form showing me as beneficiary. This also shows our current address.

    -Wife's pension information showing me as beneficiary. This also shows our current address.

    -Car insurance documents showing joint coverage.This also shows our current address.

    -Copy of the account information for the health insurance policy form showing a joint policy.

    -Confirmatory email showing itinerary for trip in July 2010.

    -Confirmatory email showing itinerary for trip in July 2011.

    -Pictures taken during our trips (I am just sending 4 pictures given that they are not that important but expected).

    -Page from my passport showing name of spouse and residence.

    Appreciate any input and thoughts. Thanks in advance.

  8. I will be sending my ROC application in March. I had a (possibly stupid) question on the documents.

    A lot of the documents that we are going to send with the ROC package are same as those we sent for the AOC. Examples include lease agreement, joint checking and savings account statements, beneficiary information for 401k and life insurance, medical and car insurance showing both names. Only difference is that these will be more recent. We will have some new material like copies of itineraries of trips taken together, pictures and letters from friends.

    I was just wondering if this is common and okay. If you think we need to send in something more please provide some examples.

  9. You said you're going to be filing in March but is that the date of expiration of your conditional green card? If not, why not wait and see if you get the job first and then apply (as long as that doesn't bring you near or past your GC expiration date)? That might makes things easier as far as filing goes because then you won't have to worry about transferring your case. Besides, if you move to the West Coast you'll be lucky to get an "upgrade" to the CSC which is processing cases loads faster than VSC right now :P Also, there's no guarantee you'll even be interviewed; only a select few cases with the ROC process get interviewed. If you do end up on opposite ends of the coast when filing, I would definitely include an explanation with your application. It won't delay your case. Maybe include affidavits as well (not required but may help in certain "uncommon" circumstances like yours).

    Financial support is not an issue for ROC. You don't have to provide any form of proof for income whatsoever. I remember even specifically asking this in our AOS interview; I asked "If I stop working when we have children will this be a problem [as I am the USC and my husband is the green card holder]?" I was told "No, we really don't care as we'll have no way of knowing." Very unconventional response but a good one nonetheless :blush:

    I will know if I get the job or not by the beginning of February. So although March will be the beginning of the application window, I will know about the job and the relocation by the time we apply.

    Also, the candid reply you got from the immigration official may not be completely valid in my case. In my case, since we will have to explain the situation it will be obvious that my wife will quit her current job. So I was wondering (also worried) that they may want to know if she has a new job.

    Anyways, it looks like we will just file normally and explain our situation and take it as it comes.

  10. Hi All,

    I will be applying to remove restrictions on my green card in March of this year. My wife (US citizen) and I live together on the east coast and have all the required proof we need to provide. I am currently interviewing for a new job which is located on the west coast. If everything goes well I will have to start the job towards the end of March. The job, if I get it, will be a great step up and I do not want to let it pass. My wife (US citizen) is a teacher and does not want to quit her job in the middle of the term. So it is possible that while the I-751 application is under review my wife and I will be living separately till the summer (about 3-4 months after we file the I-751).

    I am wondering if this situation is going to cause problems/delays with the application. I have the following questions :

    1. Do I need to explain the situation and that we may live separately for a few months in a letter attached to the I-751? Is this going to delay the review of our file?

    2. Will our USCIS center where the interview may be conducted change from the east coast to the west coast?

    3. If I get the job, my wife will quit her job in the summer (about 3-4 months after we file the I-751) and move to the west coast. It is uncertain at present whether she will get a new job quickly. I know that we do not have to provide financial support documents with I-751 as my wife had to do with the original application. But will the USCIS raise a problem about financial support if we explain the situation. Obviously, I will still be earning enough to support the family.

    I would appreciate any input from the knowledgeable members here. If you have been in a similar situation please let me know how you handled it. Also, do you recommend discussing the situation with a lawyer or an USCIS official.
