  1. Hi Nich-Nick :)

    She filed her own affidavit as my co-sponsor. With AOS i was told even if i put that i have no income i need to file my own sperate I-864.

    So you are saying that I, the petitioner, can send in a new affidavit for myself with MY information (not my mom's) and they will replace my old one that said i made $0?

    i have decided hat i am just going to have to ask them to disregard my co-sponsor. i figured out last night why they are sending the RFE, its because my mom has not yet filed her 2012 taxes and they want the most recent tax year. Her CPA filed an extension for her.

    So is it possible for them to take her off my application and just use as a new affidavit with my work info, and drop a co-sponsor altogether? i am just worried they wont accept it since i already sent in my affidavit saying i made $0 and included a co-sponsor ;/.

  2. Hello all,

    My husband and I filed our i-485 for his adjustment of status in May, and a few weeks later we received his biometrics letter. About a week after we completed his biometrics, we received an RFE for financial documents.

    I called USCIS and they told me that they couldn't tell me anything, and that I needed to consult an attorney or make an InfoPass appointment. So I proceeded to make an InfoPass appointment and drive 2 hours to the nearest embassy office, just so the immigration officer could tell me she wasn't really sure what they would accept and that I would just have to submit what I had and hope they will accept it...#######?

    So my question is this. When I filed our affidavit, I listed my mother as my co-sponsor because I had just started working at a job and didn't have sufficient evidence or working there yet. i put my income as $0.00 and just had my mom's income listed because she makes more than enough to cover her household size. Well listed on the RFE, it says that I did not submit any evidence of my mom's income and I need to send in bank statements, tax returns, W-2s etc. I sent in 6 months worth of bank statements with her income being deposited in to her account, and highlighted all the transactions. I also sent 3 years of tax transcripts.. do they not accept those anymore?

    My mom owns her own business, so she doesn't have any W-2s. And with the tax transcripts, her CPA advised her not to take her wages through the payroll, but through owner withdrawals instead (a tax thing). So even though my mom makes $120,000+ a year, on her tax transcript it shows that she only makes about $40,000 - $50,000. Well according to USCIS, this is not enough to cover her household size because under the list of information I needed to send in, they said that according to the documents my mom does not make enough to meet the guidelines. I looked on the poverty guidelines, and unless I'm mistaken for a household of 5 the limit is $39,000... so how do they figure that she doesn't make enough?

    I guess what I'm asking is if there is any way possible I can just send in the information they're asking for, but include a new affidavit for myself with all of my updated work information and evidence along with a letter of explanation? I had previously sent in one saying I made $0.00

    (because of just starting my job) and so I'm wondering if they will even accept it or will just disregard it and deny me because my mom supposedly doesnt meet the guidelines even though I now have enough evidence of a job that easily supports my husband and I for a 2 person household.

    I'm sorry if this doesn't make a lot of sense, I am just very confused myself and nervous that we are going to be denied on a silly technicality that her income isn't listed under "gross income" sad.png

  3. What did you mean by this if you didn't get those marked on yoursheet. Should have a date beside Tdap/Td if you took an immunization record from your GP. Where did the Oct 2005 date come from? You said:

    That's why I'm confused though.. I was looking through the forums to see how the Ds-3025 should look if it's complete. My DS-3025 matches a supposedly complete one, except that I have no dates on my form for vaccinations received except the Oct 2005 for the MMR and then a date for Influenza. They ticked the boxes for Tdap/Td, but didn't put any dates because I don't have the vacs supposedly? So what I was trying to figure out was if they had just done that so I could continue with the K-1 visa process until aos came along, or if that is sufficient, or if they forgot to add the date, etc.

  4. Well it's actually not perfect. MMR is two doses. If your one dose was within four weeks of the medical exam, then a waiver for "insufficient time interval" would be marked. It wouldn't be medically advised to get another until 4 weeks had passed. With everything else done, it would do to have only one MMR. But seven years had passed since your dose one, so there was no medical reason why you wouldn't get the second dose.

    I forgot to ask the date of Td and Tdap. One needed to be since Dec 2002...within the last 10 years. Do you have that?

    Also A flu shot is required between Oct 1 and Mar 31.

    See that's the thing, I don't have dates on any of the shots because I don't believe I got them. The doctor told me I could get them from my GP for less or cheaper than there, and that it wouldn't mvtter that they weren't from Knightsbridge (she didn't say specifically for less or cheaper, but I'm assuming that's why she would recommend this). The only date I have is next to the MMR, and that is the Oct 2005 which I suppose I need to get my second dose for.

    I'm guessing that I am going to have to get those shots in america then, oh well. While I'm at it might as well ask if there is a specific doctor I need to go to get them or will just any american doctor do?

  5. They confuse people at Knightsbridge with their incorrect instructions. There is also no reason to write the extra comment. That is not in their technical instructions. Good news is I've known other UK persons to get the AOS ok, even though Knightsbridge wrote the comment. Your DS-3025 sounds complete IF the date of the MMR shot was in the last 10 years. For clarity what is the --

    MMR date?

    Medical date?

    MMR date is Oct 2005, and medical date was December 17th. So it should be fine? I was worried that maybe the comment would make my DS-3025 invalid and I would need to get all of the vacs done in US ($$$):/

    My K-1 visa was recently approved, and now my fiance and I are beginning to get the paperwork ready for aos. My question is about the DS-3025. When I went to have my medical done, I was told by the Knightsbridge office that I would need 3 vaccinations. The doctor there told me that I didn't need to get them right that moment and that I could go to my local GP and get them there. Now after looking through VJ, I am seeing that USCIS won't accept this and I will need to fill out an I-693 and get the vaccinations done in america by a CS.

    Now here is where I'm getting confused...

Or does it mean that I don't need to pay the CS in america to have the vaccinations done there..

    Sorry if this post is a bit confusing, I'm just very confused myself lol.

  7. Hey everyone. I was wondering if you guys could help us out again. We got our NOA2 on 18th of may and havent received packet 3 yet but expecting it very shortly now my question is, how long can you hold on to the packet 3 before you MUST send the forms to the embassy to get a date of interview? We are dealing with some financial problems and sadly we are gonna have to delay our visa journey i am just worried that it might get inactive or something then we would have to re apply from step 1 and that's not really what we want to do. I have been reading that you have 4 months since the approval of NOA2 to get everything done so i assume packet 3 is part of NOA2? I also understand that once you get approved for your interview the K1 visa lasts 6 months until it gets expired. Just want some clarifications. Thanks for any replies everyone :)

Heyy so i am doing my packet 3 forms and i stumbled upon this question which asks list the last 10 years of employment now my situation is that i am not employed full time for any company or anything like that however i have worked for several agencies who send you around the local area if there is any job going on but the problem is its never been stable and i remember that the most time i have worked via agencies is around 3-4 weeks. Now my question is do i even bother listing the name of agencies and writing down that i have done month of work? Thanks for your help (:

Heyy guys i did not know where else to post this as i am directly trying to see if there is any lithuanians in united kingdom who filed for K1 visa and had to get a lithuanian police certificate from Lithuania embassy in London. i know this is a long shot and i doubt that there will be anybody to answer my question but i am just trying to see whats the quickest way to get lithuanian police certificate.. can i file for one online? or do you have to go directly to LT embassy in london or what? if anybody went through this process i would appreciate any information possible.

  11. we actually received our noa2 approval on the 18th and now you guys got me all worried with this nvc thing going on!! just to pop a question to the lithuanian beneficiary about getting medical examination done before getting the packet 3. do you have any idea if Uk residents can just do medical examination with nvc number/code number? because i would gladly get it done before waiting for the packet 3. thanks :D

  12. On May 18, 2012, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E).Yayyyyyyyy just like visa journey predicted haha. We are sooooooo excited and hope the rest of you get your NOA2 soon! If anybody has any good information about London embassy or what to do after NOA2 we would really appreciate a link of it :).

    i know i just posted, but now i have another question. we filed in december for our k-1 visa and are hoping to get NOA2 by this summer. what we are worried about is if my fiance makes enough for the affidavit of support so that she doesn't need a co-sponsor. she currently makes just under the limit for a 2 person household with her job alone. what i am wondering is if a structured settlement could count as income? she said she asked her parents and a couple other people, and they said it couldn't be counted as an asset because she can't access it all at once? she currently gets monthly payments, plus large sums every few years. i think she's going to be getting the monthly payments until she is 30? or some age like that. just curious if this could be counted as an income, as we would really like to avoid having to get a co-sponsor. thanks! :)

    OH btw, she does not pay taxes on that. that is a big reason we wondered if it would count, as she does not pay taxes for it?

  14. You could get banned for material misrepresentation i .e. lying to the CBP, and that doesn't matter if you are using tourist visa or VWP.

    You are going there to see your fiancee, are you not? you are not going to see your friends this time. So if you tell the CBP you are here to visits friend, that is lying and if they bust you, there is likely to be consequences.

    Not sure what exactly they can see on their little screen but I read several places that people with immigration visa pending got pulled for secondary screening. I can tell from my own experiences that they can see your family travel history to the USA for sure. I was questioned about my dad's frequent trips on one occasion.

    edited. I also read a lot of people with immigration visa pending got through without any problem with the usual question business or vacation, no secondary screening. So chances are that you are over worrying about things that you could very well breeze through it. But be aware that though, if you do get pulled for secondary screening, you are definitely going to get turned away if you don't have any strong ties to show.

    I'm going to visit my fiancee on the 1st of march myself, will report back how it goes at the POE.

    as in banned from coming back to the USA? so say if i said i was coming to see friends, got pulled for secondary screening, they asked about the visa and i told the truth about filing. would i then be banned because i didn't mention the visa? because haven't people been denied entering before for not telling the truth but weren't banned? :unsure: i would not be happy if i got turned away, but i don't think i would even risk it if it's possible i could be banned...

  15. So, my fiance is coming here on Wednesday from the UK under the VWP. We started the K-1 process in December. There are so many questions about visiting while a K1 is in process, I really don't know why there isn't a "pinned" thread. Obviously since he isn't here yet, we only have past speculation to go off of and the same questions.     My plan is to have my fiance come here starting on Wednesday for 87 days under the VWP. He is NOT going to lie to customs and he is going to say "I'm here on vacation to visit my fiance, meet her family and friends and see the sights of America while our K1 is in process." There is much speculation as to whether the customs officer will know there's a K1 in process, but everyone I've talked to seems to be under the opinion that they do know because airlines transmit all passenger names before a flight takes off to the U.S. government. At that point, the government does whatever screenings, etc. and I'm sure that would include immigration since it's the same government agency as customs under the Department of Homeland Security.

    That being said and all of the past threads about visiting on this message board, I had a consultation with an immigration attorney AND called Customs passenger services at O'Hare airport (where my fiance will be flying into) about visiting while the K1 was in process.

    The lawyer said I was definitely "over-worrying" and that having a return flight and any ties to home would be very helpful. He said that he might be called in for secondary screening, but that he's confident that everything will be OK. When I explained that I read on a visa message board about someone being turned away from the UK (previous post linked to this person's story) and said the reason they gave her was abusing the VWP, he said that only happens if a person visits a lot, i.e., visiting for 87-90 days, going home for 3 days, then coming back for another 90 days. He said someone who has visited a few times for a few weeks, that's not going to be an issue. He also said to just bring a copy of the NOA1 and show that we're doing everything legally. Overall, the lawyer didn't seem concerned.

    When I talked to Customs about it, they said there is absolutely NO PROBLEM with visiting while a K1 is in process. The woman on the phone was very pleasant actually and just said as long as a person qualifies for travel under the VWP and has a return flight and is here for tourist purposes like visiting friends, seeing the sights, etc. there shouldn't be a problem. I mentioned him bringing a letter from his employer and she said that's a great idea if there's secondary screening but that the main thing to remember is that anyone who travels under the VWP, they just want to make sure the person qualifies to travel under VWP.

    Sorry this is so long, but I've done a lot of research and a lot of planning. I know there's no guarantees at the border, and will keep everyone posted with what happens with my fiance on Wednesday night, but my advice is: do not lie. Be up front about everything because visiting as a tourist while the K1 is in process is OK.

    thanks for the reply, we also filed in December. :) we are just very worried because i feel like if i say i am going to see my fiance, they are going to look at the past visits where i said friends and deny me. then again if i say friends, what if they can see the K-1 visa and deny me for that? kind of tempted to just cancel the tickets and wait until she is done with school to have her come visit me. :( please keep me updated on how his POE goes! x

  16. You should never ever lie to the CBP and now you shouldn't try to make things worse by lying again next time, That would make sure that you will be turned away at the POE and risk a ban.

    Answer the questions truthfully but brief, if they ask what is the purpose of visit, it is enough to say you are there to visit your fiancé. No need to elaborate unless they ask you to.

    Now that you cannot prove any strong ties to home country, it is very likely that you will be denied entry and put on the plane back home. You can still take the chance and go there in March, but do not be surprised if they pull you aside for secondary screening. I would change the trip and have her visit you instead if possible. if not then it is up to you if you want to take the risk or not. The worst thing that can happen is you lose the ticket money and time.

    how would i be banned? if i get turned away i don't think i will get a ban from coming back, just a ban from using the VWP....

    the whole reason i started this thread was to get FIRST HAND experience of someone not mentioning they were going to see their fiance, and if the officer KNEW they filed the K-1 visa, or if they just didn't mention it...

    i am NOT coming there on a tourist visa

    i have NOT told them i filed for the K-1 or that i even have a girlfriend there

    all i want to know is if the border control officers can see on their little passport info screens that i have filed for K-1? does it show up VERY clearly right there, or would they have to search for it or put in a request blah blah. i really don't feel like straight out announcing i am going to see my fiance, since i mentioned before i have never said that before. so i think my best bet would be to just say friends again...somehow i think i will have a way bigger chance than saying yes i've been coming here for 2 years to visit my friends now i am coming to see my fiance.

    so again, my question is this.

    CAN the border control officers see that we have filed for K-1 visa? I know someone said that they do know about it, but does anyone have any EXPERIENCE with going there and being denied because they did not mention it?

    i am asking for advice, not rude comments. not really sure why you would say you hope so? i have not done anything wrong i have simply been telling them i was going to see a friend because when i first went it WAS a friend, we liked each other but we weren't sure if we would fit together in person. the second time am i going to switch my story around to 'i'm going to see my girlfriend' so they are suspicious? NO.

  18. No i will be coming through the visa waiver program, i am lithuanian but i have lived in UK since i was a kid. We have only received the first notice of action and i am just worried if that is all i have to show for proof they will deny me, as i said before i dont have alot of ties to home that they would accept as proof. i am just wondering if anyone has had any first hand experience with coming to see their fiance during the K1 visa process and didnt tell the officer if they were coming to see their fiance. Did officer mention the K1 visa? or were you denied because they found out that you were lying? any info would be great, thank you
