  1. Hi VJ Community,

I have been searching for information regarding a stepchild adjustment of status, who currently has a pending i-130 with USCI; The dilemma here is that USCIS has the following: "Alternatively, if your stepchild is already in the United States, after USCIS approves your Form I-130, your stepchild may apply to adjust their immigration status to become an LPR by filing Form I-485, Application to Register Permanent Residence or Adjust Status," so since the i-130 has not yet been approved, the question is:

Can the stepchild adjust status with the pending i-130 (797 - Receipt)? Based on other information I've read he qualifies as an IR of the US Stepparent and as such a visa should be immediately available

Thank you all in advance for your help and time

  2. Wepa Jerron305,

Mira, that list is out with all cases with interviews scheduled up to December 2013.

So, at this time, I do not believe there will be any updates any time soon.

Go to the site or let me know if you want me to send it to you.

On a regular basis, they post a "preliminary" list toward the end of each month, with final at the beginning of each month.

    Best of Luck,

    Kel

  3. Hi,

My in-laws received a letter stating such a fee (as mentioned above). They arrived late May this year and received their GC as soon as about 10-14 days after paying the fee.

Their Immigration Visa Number is located in the I-1551 (to the right of the form - about 8-digit number I believe), if you call USCIS, it is the number you should use and they should have.

    Best of Luck.

  4. Good Day bxespinosa,

Here is a link to the DoS website that will assist you in preparing to complete the visa process:

    http://travel.state.gov/visa/immigrants/nvc/nvc_1335.html

Notice the links for Payment, Document Collection and Interview Preparation within the page on the link above.

I strongly suggest you do not start anything until you receive guidance fron NVC, as some documents (like the Police Certificate) are time-sensitive, meaning they have expiration dates and such); just familiarize yourself in the mean time with what will be needed from your end to provide the NVC.

    Best of Luck.

  5. Hola Golda24,

La Categoria de F2A visas estan vigentes, asi que ya estabas supuesta a ver recibido la cita. Llamen a NVC a ver que novedades tienen. La cita llego 27 Agosto para la entrevista en Octubre.

    Buena Suerte.

    Hello Golda24,

F2A category is current at this time, since your case was completed in July, you should've received the I/L (Inteview Letter). Call NVC to find out if they have any news. We received ours for October (F2B - cases completed back in March this year - but because the Visa Bulleting was not current at the time for our priority dates, we had not received our appointment). Our cases cut off dates became current for September (and hopefully the cut off date stays current for the coming months) and the I/L came in Aug 27 for the Interview in October.

    Best of Luck.

  6. Hello Mike,

Outside your question, as I have not use any assets as an sponsor...here it is

If you are a contractor in Afghanistan you should not worry about meeting the income requirement (the Poverty Guidelines - I-864P 2012 has a minimum income requirement of $18,9112.00 for a household of 2) to sponsor your future wife.

I don't know how long you've been overseas; I have been in Kuwait as a contractor for a minute now and I have been able to sponsor quite a few family members with just income along.

Just a thought, it will be easier if you can go this route.

    Best of luck.

  7. Hey Kel

My Priority date is June 2006 but so far i havent received any form like choice of agent or anything.? How advance you received yr first document like choice of agent.?

    Thanks

    Hi Jeshpatel,

All documents started coming in late January this year, by early March the cases (three + derivative) were completed.

It looks like the VB is moving forward. I hope it does not retrogress. I'd suggest your sponsor to call NVC to ask for a status update and see if they can start sending those forms. We used to call every month, just for GP.

    Best of Luck.

    Kel

  8. Hi Edwige,

I am not from France, but based on information from the DoS website, "

All documents must be in English or French. Documents in all other languages must be accompanied by certified English-language translations. The translation must include a signed statement by the translator affirming that the translation is accurate and the translator is competent to translate. "

The interviewer (Consular Official) conducting the interview must be fluent in French as well as English. In the DR, for Instance, they counduct the interview in main coutry's language, Spanish, but if you feel confortable with english, it should not be a problem.

    Hope this helps.

    Best of Luck.

  10. Hi Beth,

If you have an address that's cool.

Here is the timeline for the Vermont Service Center for your category:

I-130 Petition for Alien Relative U.S. citizen filing for a spouse, parent, or child under 21

    October 22, 2012

You can check the Service Center that Applies to you here by selecting it from the drop down list:

    https://egov.uscis.gov/cris/processTimesDisplayInit.do;jsessionid=bacNiL4e1qcuG8wX0R6cu

It took me about 8 months to complete my wife's (that was in 2009).

Once the I-130 is approved and sent to the NVC, it should go downhill from there, meaning it should not take too long for the NVC to contact you to further process the case (about 2-4 weeks I think for them to contact you). In order to avoid delays at any stage during the process, ensure all documents are in order (forms filled out correctly, evidence and supporting documents provided) prior to sending them to USCIS and when ready, to the NVC.

    Best of Luck.

  11. Hi B Houthuijzen

Where are you located? Depending on your location, you may be able to file at the US Embassy in that Country (I read your post), but they have to have/know more info to assist you, that's what they're there for. Look at the US Embassy's website located in that country for information on Immigrant Visa (again, I find it kind of hard to believe they are not able to assist you), I'll look something up real quick and will try to comeback with more info.

Note: If you held a home address in the States it should be even better. I've been out of country for about 9 years and petition for my wife a few years back, but it was easy for me because I've always held my home address.

    Best of Luck.

  12. hi tringuyen,

As Samberb0408 stated above...I'd say you are most definetely in the wrong place to be posting that kind of stuff...and as I always say...unless you're in someone else's shoes, you will never know the real feeling, experience, agony, etc., of the person wearing the shoes.

We're here seeking assistance/help in our immigration journey and/or to help/assist other Vjers with their problems, not to entertain your political agenda.

    Regards,

    Kel

  13. Hi benanddawn,

Sorry to hear about your last name mispronunciation and hard time, I feel you. I have two last names (Common in DR and it is long) and get the same quite often. Back to your question...

My wife changed her first name only while going through her Naturalization process, as she was already carrying my last name (her visa was done under my last).

You should be fine. Once you go through the interview, they will ask you if you want the name change and make sure it is spelled correctly, etc. During the Oath Ceremony you will receive your Naturalization Certificate along with the Petition for Name change form.

    Best of Luck.

    Kel
