  1. good morning:

    1) While there is time, I would get one or two more originals from civil registry. If you were married in Mexico, it lists the marriage and to whom on the bottom. If your husband needs to get or renew passport, they will require an original and keep it for their records. I would consider starting the quest for the police record (letter of no antecedents). This takes some legwork.

    2) If you can add your husband's name as father (hopefully the father's name is blank)on birth certificate, that would be beneficial. Doing so in the US should be almost easy in comparison to getting tasks complete in Mex. At the least, consider composing a statement that you attach to the birth cert. and get the statement notorized. The notory seal will attest that you wrote it only and are of sound mind.

    3) I believe as a USC you should be filing your tax paperwork even if there is no income. That is what I will be doing.

Kudos to you for living in Mexico for 6 years. I have just begun year 2 with my husband here and teach English in Cuernavaca

  2. Getting a RFE is manageable. It happens even when you cross every 't' and dot every 'i'. We got one. We submitted request info. and got approved. It did ask about how me met and who introduced us. My response was that "...we lived in the same community, saw one another from time to time (e.g. the market, gatherings) and then was invited for a scooter ride. This was the beginning of our friendship which blossomed into committed love and then marriage. There was no one who introduced us as we lived in the same beach community".

How did you meet? Were you introduced by a mutual friend, co-worker? Chat room? Facebook? If it was online USCIS would like transcripts and explanation of 'how you met'.

  3. good evening. What you have researched seems accurate. Know that you can skype call USCIS for free. You will be doing this a lot. Are you asking if you should wait for the I-130 approvals before you move? After approval (if you don't get a RFE-which I did-which can be handled) there is a substantial amount of time for the transfer of the case to NVC and then they assign the number. This time period can cause some grief. I (USC) live in Mexico and USCIS, after mailing my receipt of I130 and my RFE to me, started encountering their own issues with my address here in Mex. They found it to be 'undeliverable' during my approval phase. I think after several calls that this has been resolved. I am planning to move back to the US and change my address after the NVC number is assigned. Try to limit their confusion. And as much as you limit, some will still seep through for you to handle. Expediting your case once you, as USC, move abroad may payoff. Look into how to ask for it. Some USCers abroad it has helped. It seems a touch random.

  4. If you can be listed as one another's beneficiary on let's say company health insurance program this would be good. Also you may be listed as beneficiary on the bank accounts that you may have in both countries even though they are not joint accounts. You will be more vested in your visa journey, like us on this website, than a lawyer.

  5. On June 29, 2012, the post office returned your document I130, IMMIGRANT

PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN as undeliverable.

The above is the email I received. Before this on the June 13 received approval email of I 130. I talked to an officer, I was transferred from Tier 1. Perhaps they attempted to mail this to NVS and it got returned. " ...returned your document I130".

  6. Okay u keep saying package. You are talking about the I-797C approval letter or the actual package? Have you talked to an actual tier 2 supervisor seems they don't know at the lower level whats up. Well its approved so thats a relief. and your I-130 packet is on its way to NVC i would think. Call NVC and ask them also. This is the weirdest thing I have heard. I am so sorry.

  7. On June 13 we received email that I-130 was approved. June 29 received email from USCIS that packet was returned undeliverable. July 2 called USCIS. I stated both me (USC) and my husband (Mex) reside in Mexico and have received prior correspondence (i.e., receipt of I-130 application and RFE). USCIS said I-130 approval packages can only be sent within the USA and since the address was Mexico US postal service couldn't deliver it within the US (invalid zip). We went through US lockboxes and not Consulate. Shouldn't USCIS sent the package to NVS? I asked them to send it to my domiciled address in the US. They said they couldn't after approval of petition. How do I obtain this package? I can not find any info. on this type of situation nor have I read anything to make me aware of this prior to my circumstance. Thank you so much.

  8. I just finished speaking with USCIS. I spoke with an officer who said my I-130 packet was returned as undeliverable by the US postal service because there was no known zip code. I said I have received several pieces of correspondence in MEX already, let's check the address....they said oh... approval packets can only be mailed to US address not to MEX and I said okay let's mail it to a US address and they said sorry but once the I-130 is approved we can't change the address. Is this happening?

  9. I am a USC, married in Mexico and living in Mexico for over 1 year. We submitted our I-130 in Feb. and received a request for additional evidence from USCIS to prove bonafide marriage. Initially, I submitted evidence of 27 pics (wedding included), 11 affidavits both from Mex citizens and US citizens, marriage cert. and translation, bills with both our names at Mex address. They wanted more... If you have any documents listing one another as beneficiary or you have a joint bank account this would be helpful to include. Be as thorough with your evidence as you can on your initial submission. Yes, our I130 was approved after additional submission of 20 more pics and me being listed as beneficiary on my husbands work insurance. Happy filing!

  10. Two weeks ago we celebrated the approval of our I-130. I just received an email from USCIS-CA that the approved packet for I-130 was returned to them as undeliverable. I am a USC living in Mexico with my husband at the same address I have been living for over a year. We have received correspondence from USCIS before ... I will call them this morning ...this is such a RUB!

    Thanks for listening.

  11. Getting ready to mail the response to RFE from I-130 to CA. The I-797E blue form USCIS sent says "RETURN THIS NOTICE ON TOP OF REQUESTED INFO". Then at the bottom is says ... "Save this notice. Please enclose a copy if you write to us about this case..." I feel like a child. Should I send the original and keep copies for file and to use for further correspondence? or send a photocopy with my RFE response and keep original? I think the rule is all forms should be original. Please help me make correct determination. Thank you, always.

  12. You can look at the consulate reviews for Jamaica on this site and read how the medical(s) went. In some countries, Mexico for example, sometimes even when you bring proof, they still make you get the vacc/immun. again. I would be prepared in case this happens and have the money to cover it available.

  13. Good afernoon folks:

We just received an email alert from USCIS requesting addition evidence for the I-130 application. Granted USCIS received out application on Feb.13 so I guess this is good for timeline purposes ...but I cannot imagine what they need at the intial stage of proving our bona fide marriage. I (USC) have lived with my husband in Mexico for now over 1 year. We submitted 11 affidavits from the US and Mexico, proof of cohabitation and many photos... and everything else on the checklist in the exact order it was requested. Now that we have this email alert and the request was mailed on April 10, we will wait for the Mexican postal service and wait.. We looked on USCIS website to possibly retrieve what exactly the request is ...to no avail. Is there a place to find out what the request is without waiting for the postal delivery? We hope there is...Can't wait to let you know what we overlooked ...

  14. Good afternoon all:

When my husband received voluntary departure last year from the US, I believe he should have gone to Mexico City and shown proof to the US Embassy of his return to Mexico. My husband claims this was taken care of at the airport by the Mex gov. We are in the I-130 process and I believe it would be prudent to go to the embassy will all documents proving his arrival last April. Actually, I believe this to be an immediate necessity. I ask, please, to be advised. Thank you.
