  1. Just throwing this out there - have you looked at the DCF method at all? Getting married first and then having your spouse file I-130 (Petition for Alien Relative) to get a CR-1 visa. As far as I know Australia does not have any residency requirements for the USC - Same a Switzerland where I did DCF. It only took 1 month for me to get my CR-1 visa and upon entry to the U.S. I got immediate work authorization.

  2. i finally got my interview letter last sat 5/16... my interview date is June 17..pls update my timeline...i dunno how to do it lol...

    i applied N400 based on a 3 year marriage to a USC and i have our 3 years tax returns from H&R. i want to bring tax transcripts on my interview..please give me the website or form where i can apply for transcripts..thanks a lot.

    Hi ikyang.... I've been checking the March thread everyday to see if there was any updates to your timeline as my office is also Memphis. I'm glad they are not way behind - I have heard they are slow....

  3. I have a question regarding Part 9. on form N-400; in the instruction for form N-400 it says to list all your children including stepchildren....

    My husband who is the USC has a son from a pervious marriage. We did not list him on our I-751 form as it did not specify exactly which children to list and we thought it would only be my (Alien) biological children.

    Are we going to have a problem when we file N-400 (after May 25th) because we will have one more child on the list??

  4. Well, I was on vacation in Switzerland and when I got home, I had a letter dated 3/12/09 informing me, that my case has been moved from VSC to CSC. And last week I got a letter dated 3/18/09 informing me that the conditions on my residency have been removed and that I will receive my 10 year green card within the next few days. So it was less than a week from transfer to aproval for me (at least the correspondence was). There's hope - you might get your aproval sooner than you thought!

    I am sorry, if this has been asked before... I tried to look in the FAQ's but haven't found an answer...

    Can anyone tell me how to look up my case status online. I have the receipt # from my 1 year extention letter...seems to be the right #, it starts with EAC...... The USCIS website keeps returning my request saying my case couldn't be found.... I filed at VSC back in July 08.

  6. Habe ich dich richtig verstanden, dass du (dt. Staatsbuerger) sozusagen mit einem Studenten-Visum in Amerika einreisen moechtest und dann "spontan" heiraten willst?

    Wenn du mit dem Studenten-Visum einreist mit dem Hintergedanken dort zu heiraten und zu leben, dann ist es rechtlich gesehen ein Visum-Fraud und die US-Regierung

    kann dir bei der Beantragung der Greencard etwas auf die Pelle ruecken, indem du nachweisen musst, dass du nicht mit der Absicht zu heiraten nach Amerika gekommen bist.

    Wenn du vorhast die US-Staatsbuergerschaft zu beantragen geht es nicht so einfach, dass du von deinem Studenten-Visum aus dies tun kannst.

    Du muss mind. 3 Jahre im Besitz der Greencard sein bevor du die Staatsbuergerschaft ueberhaupt beantragen kannst.

    Ich weiss nicht wie lange so ein Studentenvisum dauert, aber bei mir hat es mit dem K1-Visum (Verlobten-Visum) knapp 6 Monate gedauert. Vielleicht solltest du es in

    Erwaegung ziehen, damit es bei der Beantragung der Greencard keine unnoetige Komplikationen auftreten.

    Primär will ich in den USA mein Studium beenden, deshalb ja auch das Studenten-Visum. Mir ist schon klar, dass eine Heirat in der Zeit als visa fraud ausgelegt werden kann und für die Greencard nicht grade förderlich sein wird. Was erschwerend dazu kommt ist die Tatsache, dass sowohl meine Verlobte als auch ich es kaum aushalten, ohne einander zu sehen. Deshalb versuchen wir natürlich auch, die Zeit kurz zu halten.

    Mit der US-Staatsbürgerschaft habe ich mich nicht klar genug ausgedrückt wie mir scheint. Natürlich muss ich ne längere Zeit warten, bis ich die beantragen kann. Aber letztendlich ist das mein Ziel.

    Problem bei der Sache mit dem K1-Visum ist dann halt, dass ich erneut mich bei der Uni bewerben müsste, weil es halt deutlich länger dauert. Und ich wollte meinen Abschluss recht schnell machen. Allerdings ist dann aber wiederum das Beantragen der Greencard letztendlich einfacher.

    Es sieht einfach so aus momentan als ob ich nicht beides haben kann. :(

    Ich verstehe dich vollkommen, dass du keinen weiteren Tag von deiner Verlobten getrennt sein moechtest.

    Es gibt einige Leute die mit dem Studenten-Visum eingereist sind und geheiratet haben.

    Und haben auch keinerlei Probleme bei der Beantragung der Greencard.

    Ich wollte dir das nur sagen, weil es in anderen Faellen auch schon anders ist. Nur damit du dich darauf gefasst machst.

    Ich bin zwar nicht Deutsche wollte aber trotzdem antworten... Wir haben die DCF Route gewaehlt und ich weiss, dass das auch in Deutschland moeglich ist und das geht relativ schnell. Bei uns ging das ganze 1 Monat. Nach der Hochzeit bewirbst du dich direkt beim Amerikanischen Konsulat in Deutschland (dein Ehemann muss dabei allerdings anwesend sein soviel ich weiss - im DCF Forum hats einige Deutsche, die dir sicher gut Auskunft geben koennnen). Wenn die Petition genehmigt wird erhaeltst du ein CR1 Visum mit dem du in die USA einreist und am POE (Port of Entry) den "Green Card"-Stempel in den Pass bekommst. Die "richtige" Green Card folgt dann wenige Wochen in der Post.

    Where does it ask for this in the instructions?

    I'd also like to know why this particular document would be useful. I'm sure I have it somewhere in my files, but I'd rather not go through the hassle of looking for a document that isn't exactly necessary for the application.

    It doesn't say in the instructions that this particular document is necessary - it says to send supporting evidence and this is just one more document that I am sending in support of the petition. It happens to be the frist document that was sent to me at our address in the USA where my husband already lived so along with other bills in my husband's name sent to that address it's additional supporting evidence of a shared address.

    I just looked on the instructions and I guess not... I don't know where I got that from... I think I just saw someone else send that and wrote it down as one of the things to attach...

    What about the white card the 2 year green card came attached to? Did you keep it?

  9. Well, I know this is probably getting old but I just wanted some input on whether we have enough evidence. We are sending off the package next week...here goes

    • Bank statements (per 12/06, 06/07, 12/07 and 4/08) showing joint account (as well as mortgage pmt coming out of joint account as the house is only in my (Swiss Citizen) name)

    • Car insurance declaration showing joint policy
    • Tax transcripts of our 2006 and 2007 joint US tax return
    • Letter from hubby's company of the designation of his life insurance to me
    • Letter from my company of the designation of my life insurance to my hubby and our daughter
    • Letter from BCBS showing joint health care policy
    • Our daughter's birth certificate
    • Various correspondence showing same address (inclueds utility bills spanning 2006-2008, invitations to both of us, I-797 Notice of Action, AR-11 Change of Address Form)

    I think we're good - I was just a little worried because the house is only in my name but I think we should be alright...

  10. I've been in the U.S. for almost two weeks now :D and thought I'd post my POE experience:

    I got to Atlanta, GA at around 2:30pm got in the "US citizens and permanent residents" queue with my brown envelope in hand :D the officer there just looked at my passport asked me how I met my husband (I think that was more out of curiosity than anything elses though lol) and told me to go collect my bagage, go through customs and then turn left... The officer at customs took my envelope stuck it in a folder, gave it back to me and told me to go >left. There was guy right behind me who was going the same place I was while everyone else went straight ahead... I asked him if he was also immigrating to the states today but he wasnt...Turns out I was lead to go the the "things to declare" section and I kept thinking I was in the wrong place... The officer there took my envelope again, said to leave my bagage outside the waiting room and to take a seat until my name was called. Most people there were randomly picked out to have there bagage checked and I couldn't stop wondering whether I was in the right place...until I got to talk to another couple (American / Mexican) who was there for immigration purposes too :) I had to wait for about 50 minutes before I was called upfront. There was no second interview or anything. The officer asked me if I knew that I had to remove my conditional status in 2 years, took my finger prints, stamped my passport and that was it! He said it would take 3 weeks for my SS card to arrive and up to 8!! months for my green card to be mailed to me... He welcomed me to America and wished me good luck :)

  11. Well, my CR1 visa arrived yesteday in the mail and I thought I'd share with you my interview experience... I had my visa interview on July 26th and got my visa in the mail a week later :)

    I got the the Emabssy at 10:45 (my appointment was for 11am) and just stood in the line behind about 5 other people waiting... right away the security guard came up to me and asked to see my passport and tried to find me on her list... but I wanst on there!!!! Thank God I had my appointment letter with me.... One of the women working at the Embassy came up to me and asked me for my documents.... I told her that I had already submitted the form and what documents she wants? She was like >>> HUH!? You've already submitted something? Why? When? How? (this happend to us before when we submitted form I-130 - they didnt seem to know what we were wanting to do...) I gave her my cover letter that I wrote to the Embassy when I submitted the Visa Application and she still didn't understand... She went away with it and came back 5 minutes later and told me I was in the wrong section lol (this was the visa section though..and I was there for a visa?) anyway... I didnt have to wait in the line and could go in first of all the people waiting outside the door too... the security guide inside gave me a ticket told me to slip it under window 6 and to sit down...I didnt have to wait long...maybe 5 minutes and was called to window 6 where the same lady that we had last time (when we submitted I-130) was at.... she looked through all my documents... and asked me some questions about the forms... After that I had to go pay the fee and wait again...this time about 40 minutes... then I was called to window 4 for the interview itself. He asked me:

    • Where am I going to live
    • When did we meet
    • When did we get married
    • When am I intending on going over to the States

    After answering ALL those questions, he said.. well, looks good to me.. we got everything here.. do you want us to mail you the visa or are you picking it up? I said to mail it please ...and that was it! I even asked..that was it? he said yes and laughed...and I could go :) the interview was max. 5 minutes... And he didn't look at any of the photos and letters etc I had brough for evidence...

    DCF in Switzerland was a very pleasent experience - it took us 1 month start to finish >>> Filed I-130 on June 27, 2006, Visa was issued on July 27, 2006 :D

    UPDATE:

    I received my visa application letter yesterday, July 12th, 2006 - only 9 days after I sent of DS230 Part I! And I got my visa interview date for July 26th 2006. I made the appointment for the medical examination yesterday too - I go in on July 20th. They told me to bring

    • my vaccination records and to make sure I got all required vaccinations at my regular doctor here BEFORE I come to them for the medical examination
    • A passport style color photograph
    • The results of antibodies test (if applicable)
    • glasses, contact lenses (if applicable) I wear glasses
    • and the fee in cash - 490 Swiss Franks - that's about 335 USD

    It's all happening now! lol

    I'm not quite living in the USA yet, but am planning to move to the DC area next summer (2007). We are still looking into how we can best accomplish to be together, but I hope everything will work out...

    I know not a lot of Swiss people are immigrating, thats why I was just wondering.

    I'm from the German speaking part in Switz - We are doing DCF right now and I'm planning on flying over on August 25th this year. My husband is in Tennessee :)

  14. Hello all

    I just wanted to let you know that my USC husband has filed the I-130 at the Embassy in Bern, Switzerland (it has to be done in person here) on June 27th and we were approved right there and then :D Everything went really well - apart from some confusion at the Embassy cos nobody of the front desk personal seemed to know what the heck I-130 is!!!!!! lol but it all worked out well in the end. I got packet 3 >>> again... I had already received it through the mail when I made the appointment for filing I-130. So I already had everything for the visa application (birth certificate, police records etc.) with me on our fist visit there but they wouldnt except the Applicant readiness form right away and asked me to mail it instead... Which I did on Monday and now I'm waiting for my interview date.

    Thanks to this board for your help and the infos! Will keep you posted on how the interview and immigration itself goes :D

    Do we, both my husband-to-be (USC, living in the US) and I (Swiss citizen, living in Switzerland), need to file G325A? I wasn't aware of this form until I saw it mentioned on the cover letters some of you have posted on this board.... They are on the checklist of form I-130 but have been crossed out manually by the Embassy.
