You would not file an N-400. After he automatically acquired his citizenship through the CCA you could file an N-600 to obtain a Certificate of Citizenship, but it's voluntary. Instead, many people jump right to a US passport, which also serves as proof of US citizenship.

I don't think there is any set procedure for showing he is in the legal custody of his mother; the child's birth certificate showing their US citizen parent is a required document though, as is a copy of his current green card. If he has an I-751 pending then a copy of the extension letter / receipt NOA should also be enclosed. You can see the other necessary documents at the link above.

He will automatically become a US citizen under the Child Citizenship Act when all of the following are true:

(i) he is under 18 years old.

(ii) he has at least one US citizen parent, who is a US citizen by birth or naturalisation.

(iii) he is in the legal and physical custody of that US citizen.

(iv) he is an LPR.

They do not have to be done in any set order, but on the day that they are all true he becomes a US citizen automatically.

My step-son immigrated 18 months after his mother. His mother has already received her 10 year GC and is in the N-400 process for citizenship. I have just submitted my step-son's package to remove conditions on his GC. My question is this: Since he will be eligible for immediate citizenship when his mother gets hers, how/when do I submit his N-400? After she receives her citizenship, or after she passes the test/interview?

My wife received her notification letter that USCIS received her citizenship packet, and it stated that the background investigation will begin and then we will receive a interview date. No mention of Biometrics, and it has been three weeks since we received the original letter.

My step-son (11 years old) immigrated one year after my wife, so I was not able to send in both of their I-751 packages together. His ROC package is due next month, and I was wondering what evidence I need to send in with it? His mother has alread yreceived her 10 year green card, and he has been living with us for the past two years. The only real evidence I have is his school records. Will that be enough? Thanks!

Approved, Dated 11/18/2014. No status update online or any texts

USCIS' new website is now showing that they received my I751 on 5/30 instead of the 5/16 that they originally showed and that is on my NOA1. What the hell is wrong with these people? Also, I called about the cases being transferred to CSC, and I was told "All cases received on/after 06/01/2014 are being sent from VSC to CSC to help equalize the workload". So, I think we will begin to see that June/July VSC filers will be processed before those of us stuck in the hellhole that is VSC because we were unlucky enough to be behind the cutoff date.

Ok, I've been patient up to this point, but now I'm pissed! I just checked the June filers, and 90% of the CSC have been approved and about 75% of the Vermont filers have been transferred to the CSC! ####### is going on?? If the June VSC filers start getting approvals before we do, Im headed to my Senator's office!!

Mailed I-751 to Vermont on 5/12, USPS shows it delivered on 5/16. Check hasnt been cashed yet and havent heard anything back.

I'm 90% sure I know the answer already, but need your help.

Wife came over on K-1 11/2011, received her GC on 08/2012 which expires 08/14

Step-son came later on a CR2 visa....07/2013, received his GC 07/13, which expires 07/15.

I cant file jointly for removal of conditions, since he didnt come over within 90 days of her, correct?

So, I will have to pay another $505 plus the biometric fee when it is time to do his I-751? Do I file his I-751 after her conditions are removed, or do I have to wait until 90 days before his card expires. He came over on a CR2 visa.

No, there are no additional fees, paperwork, or AOS filing once he arrives to get the green card. He will get a green card in the mail in about a month.

Since the visa is CR-2 I'm not clear on whether he'll get a 2 year green card or 10 year green card, since CR-2 implies it will be a 2 year green card. IR-2 would be a 10 year green card.

How long have you and your wife been married?

We have been married for a year and a half.

Do you have the letter from the father granting permission to emigrate?

Yes, in Thai and translated to English.

My 9 year old step-son has his interview in Bangkok for his CR-2 visa next month, and I have a nagging feeling I am missing something. I received the letter from the embassy saying they have all the paperwork they need, and I have paid the Affidavit of Support fee along with the Immigrant visa fee. Do I have to pay an adjustment of status fee at some point? My understanding is that he will be issued a green card at some point, but is there additional paperwork involved like I did for my wife (came over on a K-1).

Got the email last night.....AOS approved on 08/27/2012. Thank God for the "faster" processing at CSC, it only took 7 months and 25 days

Got the email last night....card in production! I guess being the squeaky wheel finally paid off!

Finally heard back from my congressman....after 5 weeks. He told me that CSC told him their current processing times for I-485's based on family are NINE MONTHS from the date of transfer to CSC! I called BS and told him that they are telling everyone else it is 180 days. He told me to call him back once my nine months are up, which will be on 11/02/2012. These people are freakin ridiculous! He definitely will not be getting my vote this November!

You should now see something with in the next couple of weeks when we recieved this we got our green card with in a couple of weeks. If you want some one more to investigate it try this some one had told me try them actually I did then with in a hour I got the text message stating card was in production (coincidence or this guy is just really awesome...??)

It reads: "USCIS records indicate the I-485 case MSCXXXXXXX is currently under review with an officer. Your constituent should receive a notice of action within 45 days." To say that I am underwhelmed is quite an understatement. Is this the standard response? I checked today, and our case still hasnt been touched since 02/03/2012.

You are not alone. There are MANY people waiting longer than you. It can get very frustrating, especially when you seeMay and June filers getting approved already.
