  1. If your mother is not currently in the U.S, start off by filing forms I-130 and I-864. You do not need to file the i-485 since it is an adjustment of status for those already here. You need your proof of citizenship and birth certificate to show the relationship.

    You can use a co-sponsor, but I think the co-sponsor needs to be a member of your household. Your mother's assets can also be used. Send the forms as soon as possible. After the I-130 is approved, you'll have to fill out another I-864. Hopefully by then, you have a job or a sponsor showing you can support your mom. Goodluck with the process

  2. Did they provide you with the interview date? If not, in a few days, you should get the letter notifying you of the interview date and what you need to take with you to the interview. You have to do the medical test. They'll send you the details when they send you the interview notice. All you have to do now is prepare for the interview.

  3. The consulate should have all original documents forwarded my NVC. Your mom should get original documents such as marriage certificates and birth certificates back during the interview. If you look at the letter sent to you for the interview, the back page has a list of required documents, and the page before that has a code chart stating the status of the documents. If your mom is required to bring any document with her, you can tell from that last page by the code next to the document.

    My mom was asked most of the questions stated by Chiommy. They also asked her how many children she had, and where were the children. She said the interview process took about 7 minutes and she was done.

    Whats so confusing me is do i need to pay for that I-485form? I read that if they are not currently in the USA then the GC will be mailed to the address indicated on the application when they get here.

    Oh well... this is making my head hurts! lol i guess i will just wait for RFE whatever they need me to submit.

  5. I don't know. I'm extremely confused. This is all new for me so I have no clue what that is. Yes, it's 80 pages. I'm guessing it's because she worked 3 jobs. I don't know.

    I do not think they run a credit check on you. You need to provide your taxes (preferably tax transcript from irs) to show that you earn what you claim you earn. Same applies for the co-sponsor.

    I'll say try to approximate the months on the G 325. Get as close as possible.

  7. Can anyone give me an insight regarding the application of support? Last year, I only earned $12K, but i got a job this year which will enable me to go beyonbd the poverty guideline for three, which is what I need. Can I use this expected income? Any thoughts are surely appreciated. Thanks.

    Yes you can use your expected income for the year to show that you are above the poverty level. You'll have to provide a letter from your employer stating your income for the year. Also, you may need to provide pay stubs to show that you are actually earning the amount being stated

  8. If your AOS was filled by the petitioner, you do not have to take it with you. They already have it since NVC sends it to them. On the notice of your interview, they normally list all documents needed, and have a code for the document status. If you have a Y next to financial support, which means required document has been received, then you are all good. Goodluck on your interview.

  9. My husband (USC) applied to bring my son (his step-son) to the USA. USCIS received this on Sept. 19th, 2011. At what point can I contact the USCIS to see what's is happening with my son's petition? Is there a number that can be called on this situation?

    Did you receive a receipt confirming they got the application? If not, you can call them after 30 days just to find out what is going on. I had sent applications for both my mom and dad, for some reason they confirmed they had my mom's but could not find my dad's until I started receiving the documents in bits and pieces from the post office saying they apologize for not handling my mail properly. I digress.

    If you have received the receipt, then it takes approximately 5 months for them to send you the decision. There is no harm in calling them to find out what is happening after about 2 months.

  11. Hello there, my wife recently became a citizen and we are sponsoring her mom to immigrate to the US. We have filed the I-130 a week ago and it appears that the USCIS website states it will take 5 months to process. My questions is, once that 'process' completes, how long should I expect for the remaining steps before she is able to come to the US? We are expecting our second child in a couple months and wanted to try and plan for when she would be coming.

    I have tried to search posts and it was difficult to tell which steps really applied... We are aware of the i-864 requirement and actually filed that at the same time in the hope it would expedite things.

    I don't believe she would need to process an Adjustment of Status (AOS) as she is not in the US yet. Does she get interviewed? Medical test?

    After approval of the i-130, how long does it typically take? Does it vary based on which country the recipient is from? Any advise to expedite or get ahead?

    Also, has anyone seen any value in writing a letter to your Senator? We actually were hoping she would come to help when the baby was born and first applied for a tourist visa but she was denied as she was just her six months ago. Now we need to go this route and clearly she wont be here before the baby arrives.

    Lastly, I tried to update my process / timeline, but wasn't sure what Visa type this is...I thought it was an IR-5, but the timeline questions it asked confused me as it was asking about an i-129.

    The entire process could take anywhere from 7 months onward. After the I-130 is approved, USCIS sends the approval to NVC and then NVC sends you the Choice of Address and Agent forms and at the same time request the AOS payment which is about $88. This normally takes about 30 days. I'll say once you get the Choice of Address form, have the applicant sign it. Also send the immigrant visa application form to the applicant so that they can fill it out, and return with all the required documents and the Choice of Address and Agent form. This is so that you avoid having to go back and forth requesting document. I learnt this from experience. Once you can get all the required documents and have the fees paid, it does not take long for you to get a date for the interview, *depending on availability*

    In my case, the entire process took 10 months, and that was because of processing time on my end. Best place to check for all the documents needed for your mother inlaw is the state dept site. It tells you all that is needed per country, so you can have her start getting those documents together.

  12. I am petitioning my mother to come to the U.S. My husband and I are both self-employed, so with all of our tax deductions, we won't be able to meet the 125% guideline. We can, however, include our assets, which must be at least 5 times the difference of the our income and the 125% poverty guideline. If we add up all our assets, we have more than 5 times of what is asked to qualify basing on assets. While I was filling out the I-864 and after my husband filled out the I-864A, I realized that we both have disclosed our JOINT bank accounts. It will ask for me to ADD both of our assets, and that means, the amounts in our joint bank accounts will end up doubling. I tried to call the USCIS on this, but they don't know the specific answer to it. Should I keep the amounts as is? or should I divided the assets in two so they'll add up exactly what's in our bank accounts?

    I'll advise only one of you declares the balances in your joint accounts. If you have several accounts, I'll say you can split who declares what. At the end of the day, the total amounts should add up. You do not want a situation where you both enter the same balances, and the person reviewing it assumes you are trying to game them.

    Normally, it is safe to apply for a visa with a passport that still has six or more months before expiration. If your passport is going to expire soon, you should be able to renew it. Not too sure what the requirement is in your country, but in most cases, you should be able to have your passport renewed a few months before the actual expiration date. So I'll say follow up with your country's passport office to find out the requirement.

    Rather than having them send the documents one at a time, have them fill out the Immigrant visa application, and send all the documents back to you. Once you receive all the documents and the immigrant visa forms, send in the choice of agent forms. State Dept will then get back to you requesting the fee, which I believe is $404/person be paid. Once you pay the fees, print out the confirmation and place on top of all your documents, then mail them out.
