I just became an US citizen, I am planning to bring my parents to live here in the USA. They have a tourist visa and come and visit once a year for a couple months.
Is it better to apply for their I-130 while they are here (meaning that they can’t go back to my home country until the whole process is approved? ) or while they are abroad. If I apply for them while they are abroad can they still come with their USA tourist visa? or I have to wait until the get approve for their green card?
Thanks for the info.

You'll be fine, assuming you did not accumulate 6 months of overstay in the past. Given that your visa has just expired it doesn't sound like that's the case, so enjoy your trip.
I have not overstay in the past..
Thank you very much for the help.

Hello,
I already have my Employment authorization / Advance Parole document card combo (Valid until Nov-2012). I'm still waiting for the interview appointment date.
I'm planning to travel home for the Holidays.
It will be any issues at the time of re-entry to the US with the advance parole document and my current passport (valid until 2014), but my previous visa expired on Nov-2011.
I just want to make sure before I book my flight.
Has anybody done this before? and what was your experience?
Thanks and good luck in this journey!!!!

In the same topic, I have the same situation as above, can I fill the I-864 EZ or do I have to fill up the regular I-864?
Thanks!
