  1. Hi everyone,

    We need your advice. My husband recently had a background check done and it revealed an active warrant. I called to inquire and was told the reason they were given was he is a "previously deported felon." My husband has never been deported and he certainly isn't a felon. He received his unconditional perm. resident green card last year - no problems. His whole immigration journey has been without problems. He qualifes to apply to be a citizen in May (which he is planning to do). I called the USCIS Customer Service # and they told me to use InfoPass and make an appointment to speak to an officer. I've done that. Our appointment is on Tuesday.

    I'm thinking there was a clerical error sometime during the last year. Did USCIS do another background check when he applied for the conditions to be removed on his green card (last year). We've visited Canada last fall- there wasn't a problem crossing the border and coming home again.

    Can they arrest him while they straighten out this mess? What's going to happen when we go to the immigration office and speak with an officer on Tuesday? This needs to be cleared up but we are freaking out.

  2. My husband came in the house after work today with a letter from USCIS - Notice of Removal of Conditional Basis of Lawful Permanent Residence. :dance:

    We applied on March 20, 2009 and the Date of Decision is May 30, 2009. That was lightning fast!

    The letter says the green card should arrive within 60 days. The letter came from the Bloomington, MN office.

    The whole process has been very easy so far. Next is citizenship.

    We sent our I-751 packet on Friday, March 20 and I noticed our check was cashed today. It's good to know California received the info and the process is in motion. :dance:

    I have a really stupid question- how do I update my timeline? It's been a long time, over 2 years, since I've done any updating and I can't find how to do it. I've gone into the control panel but I don't see a link to update my timeline. Please help.

  4. Hello everyone, it's been a long time since my last post but it's time for the next step in our immigration journey.

    My husband's green card expires in May and we're working on getting our evidence together to send in form I-751. Several in my family and friends are willing to submit sworn affidavits for us. Do they just type up something and have their statement notarized or is there a formal form that needs to be filled out?

    How many affidavits are sufficient? The instructions say at least 2. We have 7 people willing to do an affidavit. Is that overkill? What do they look for? We have my parents, my brother, two aunts, a couple of friends. They're all from Minnesota, should we ask a friend and my sister who live in other parts of the country?

    I also want to make sure the fee haven't changed. It's still $465 for the filing fee and $80 for the biometric fee, $545 total.

    This process causes my anxiety level to skyrocket. I also start to over-analyze things. It was nice to have a 2 year break from paperwork and proof... :yes:

    Carlos got his Green Card on Monday. :dance::dancing::yes: Actually this was the second one. The first arrived earlier this summer with a mistake on it. It had my birthday on it and not his. That meant more paperwork and proof of his birth date and more waiting.

    We tried not to dwell on it too much. The only thing was his brother is getting married in Chile in April and it's getting time to search for good fares.

    Quick question to confirm... we are now able to travel freely outside the US. He'll use his Chileno passport and his Green Card to get back into the country. Is that correct?

    Thanks for all the advice and encouragement during this process, especially in waiting for the K-1 visa. This site is invaluable.

  6. Thanks for the responses. This makes me very nervous, especially after reading the post by Reba.

    This may seem like a stupid question, but on the AR-11 Form, this is the form for Carlos who entered the country on a K-1 visa and we got married in April..., the question is "I am in the U.S. as a: visitor (no), student (no), permanent resident (not yet), other-specify." I should check "other-specify" but I'm not sure what to specify.

    Also, another question is "If not a permanent resident, my stay in the U.S. expires on:" What date goes here? The expiration date from the visa? The expiration of his EA card?

    We are leaving on Monday, Nov. 13 and are scheduled to close on our new house on Monday, Nov. 20. We know the new address, etc. Should we send the forms now before we get there or wait until we're at least in MN?

    This whole process makes me second guess myself. Thanks for your patience and guidance.

  7. His social security card had his complete name- all four names.

    On our bank account, he only used the two middle names- Carlos ********, which is what he goes by with his friends and family.

    It's very confusing!! Consistency is needed most.

    On the NOA, it says if any of the information is incorrect to contact them. I called the number on the form and it led me to a labryth of extensions and when I finally got to an area where I could have talked to someone, they cut me off because the wait would have been 30 minutes. Very frustrating!

    I'm a little confused about form I-693. Does that form need to be submitted with the I-485 AOS? Reading in the instructions it says "If you are a K-1 finance who had a medical examination within the past year as required for the nonimmigrant fiance visa, you only need to submit a vaccination supplement, not the entire medical report."

    Form I-693 is from a doctor here that has performed a medical exam, correct?

    Carlos received a card that has the date he received two vaccinations. Is that the vaccination supplement that's requested?

    This process is just as confusing as the application for the K-1! Thanks in advance for any guidance and help.

    It's been a while since I've posted. Carlos and I got married on April 22 and have enjoyed being together and getting adjusted to married life. So far life is great. More than I expected.

    It's been a while since I posted and I have one last question before we start with the AOS and EAD process after our wedding in April.

    Carlos and I will be traveling tomorrow from Chile back to the US. I just wanted to make sure we are completely prepared. All we need is his passport with the visa and his sealed envelope, right? Is it okay to pack his x-ray?

    Who wants to swap dress nightmares??? I had a dress. Long story short turned out there was a problem with it and the national chain bridal store refunded my money... thankfully. I've order a new dress (actually two- so I have a backup) and it is supposed to be here sometime in March. That's cutting things a little close...
