Anyone with anything to add?

I don't think there is a written rule on how long she should stay in her home country before going back to the U.S., the general rule is that she should not be staying in the U.S. longer than she is living in her own country for the last year. i.e. she visited 3 times last year and stayed 3 months each time (total of 9 months in the U.S.) and lived in Mexico only for 3 months, the CBP officer might give her a hard time if this happens.

Always keep in mind that the tourist visa is to visit only and can not be used to "live" in the U.S.

Thanks for the response. Ever since her husband (my father in law) passed away...she's been bouncing back and forth between our house in San Antonio and my sister in laws in Monterrey, Mexico. We're just worried that they might deny her entry at the border one of these times. She's 62, retired and owns 2 homes outright in Mexico...so it's not like she's coming here desperate to work. I'm quite surprised that there are no written guidelines...or a set rule.

I am a US citizen and my wife is a Permanent Resident at the moment. She isn't eligible to start her naturalization process for another few months. Her family is from Guadalajara and she has a sister that lives in Monterrey, Mexico.

Recently, her dad passed away, leaving only her mom in Guadalajara. Since we live in San Antonio, it is very easy for her mom to visit her sister in Monterrey and then stay with us in San Antonio for a while (4-5 hours on the bus).

Her mom has a tourist Visa and gets an I-94 every time she comes here. I've looked for this information...but I'm having a hard time locating what I need::::

I know that she has a 6 month limit on the time that she can stay here...then she needs to cross over into Mexico.

How long does she need to stay in Mexico before she can come visit again? Also, if she stays say for 2 months here..then goes back to Mexico for a short time and returns...does that mean that she is eligible to only stay for 4 months... or does the clock reset every time? Is it a certain amount of months in a calendar year? How does it work?

If anyone knows this info, or can point me to the right place.....I'd really appreciate it. We want to follow the law in every way possible.

We received our NOA1 on 11/9. We are TSC transferred to CSC. No Biometric notice as of yet (12/24) and cannot lookup case status online (error message).

Is this normal? How long after receiving your NOA1 are you guys receiving your Biometric notice? Can you look up your case before Biometric notice?

Our receipt number starts with WAC

We got our NOA recently, but I cannot look up the case status at the USCIS site. I get an error message that's telling me the number can't be found. Is this normal? Do I have to wait for the biometric appointment letter in order to look up the case status? I thought that the receipt numbers would've been the same. Need advice.

Don't feel so bad, I made my check out and instead of 2007 I put 2005 on it, got the package back can you say Duh.

Re sent it lost a week.

And I put 2008 ...mine was sent back as well. Duh!!

All, Luz and I received her NOA1 recently. Today, I went to the USCIS site and plugged in our receipt number to look up the status of our case. It failed... it couldn't find the receipt number. Tried a few times. Is this normal? Maybe they need some time to enter the receipt number into the system. We have had the NOA1 for 2 weeks already.

Well, since the cover sheet had the California address,the envelope had a California return address and the paperwork already had what looked like case numbers on it (not starting all over), I went with my gut feeling and sent it to California.

I'll update this thread once I know more.

OK. I made a mistake on my wife's I-751. I actually wrote the wrong year on my check. 2008 instead of 2007. They sent the whole package back with the reason "can't accept postdated check."

I totally understand and it was definitely my fault.

Problem is: We filed at the Texas Service Center....but the package came back (with all of the doc's that we submitted) from the California Service Center.

So, do I re-send everything (with the new check) back to Texas?? Or straight to California?? It looks like they went through the files and had made some markings...even clipped all the papers together. The cover letter with the box checked off for post dating the check, has a return address of Laguna Niguel, CA 92607.

I'm thinking of sending it straight to California with their cover sheet and all...even though we live in Texas.

What do you guys think? We have only 6 weeks now until her 2 year conditional GC expires.
