  1. My I130 petition was approved 5/15/2012. My husband is living in Mexico, we have 2 children. I lived there for a year and I had to return, me and my kids could not adjust to life there. He has been deported once in 2000 and in 2003 he was stopped at the border but an hr later managed to pass ewi. Before we get into the fees of the visa apt, biometrics and filing fees, is he even able to apply for an I601 or 212? I would hate to pay all this money for them to deny him completey and still have to wait out the 10yr ban he may have on him. Any info would help. Also worst case senerio, if he does have to wait out the 10 yrs can he just directly apply for the visa without a waiver?

    i filed for 1-485 aos and that g-325a form confused me to,so in question file no.i put my alien registration number,then at the buttom it says alien registration number i put the same number in file no.mine was fine they dont send me RFE at all..look at your noa2 and u can find the alien registration number.a lot of people confused to that one too,

    Im a citizen I dont have an alien ID and my husband doesn't have one that I am petetioning either so what do I put there?

  3. I called the immigration dept and cant get a rep on the phone! On this form at the top right corner, it asks for a file number... I dont know what to put there, also at the very bottom it asks to complete the box it says family name, given name, middle name and alien registration number... Im not sure what its asking neither of us has an alien registration number. One more thing I am terrible with dates, does the dates have to be accurate for past employments for the months? Any help would be appreciated this problem is stopping me from sending in my petition. thx

  4. when my husband filed for my i-130 he sent many things n we got our NOA2 in a month Alhamdulillah..so i will just write it for u

    4)copy of my birth certificate

    5)copy of my police clearance

    6)copy of my national residency certificate

    7)copy of my passport

    8)2 passport size picture

    9)copy of my husbands passport

    10) and i guess also his name change paper or something..

    11)copy of my o'levels certificate

  5. They set themselves up for this when they entered the US illegally. The pitiable situation they find themselves in now would not have happened if they hadn't broken the law to begin with. I do have sympathy for their children, but their situation is not the fault of the Alabama government or it's new law. They took the risk that something like this could happen when they entered illegally, and when they chose to have children in the United States. They presumed it wouldn't happen because the federal government has a record of selective law enforcement. The Alabama law mirrors federal law, with the additional caveat that it requires Alabama law enforcement officers to enforce the law. I'm a little disgusted with the media for trotting these people out with their sob stories and completely glossing over the fact that they got themselves into this mess voluntarily.

    She shouldn't be working in the US to begin with, and her employer is breaking the law by providing her with a job. What's next? "We're doing the work that Americans won't do!" What they really mean is that they're willing to work for slave wages because they don't have legal status, and there's no shortage of employers in the US who are more than happy to exploit them. If they had green cards then they too would be demanding minimum wage jobs. The ones who use fake ID's and Social Security numbers and lie on an I-9 form are even worse because they actually ARE taking a job that a US citizen or permanent resident would be happy to take.

    I know a farmer who grows strawberries near the Northern California coast. He only sells his fruit through roadside stands and local farmer's markets. Because he doesn't have to pay distributors he gets to keep all the profit, so he can afford to pay minimum wage to strawberry pickers. He insists on proof of lawful presence for everyone who shows up for work, and he turns people away every day because he's got more than enough workers by the time the shift starts. Every day he says someone will show up and offer to work for half as much if he'll overlook their legal status. He just laughs and tells them to go find a farmer who is willing to break the law because he's not. Other farmers who sell their produce to distributors are forced to hire illegals because their competitors are hiring them, and the net result is artificially deflated prices.

    This is the same reason that unemployment is so high in the US. We can't compete with Chinese labor costs, and we don't charge tariffs to offset the difference. Nobody can afford to produce anything in the US because their competitors will always be able to undercut their retail prices because they're getting their products made in China. Free trade is the reason the middle class are disappearing in America. It's not the greed on Wall Street.

    Frankly, I think every state should enact laws similar to Alabama's. Eventually, there would be far fewer people in this situation because they'd simply stop coming if they know the chances of getting away with it were slim. Someone's willingness to break the law is directly proportional to their perceived chances of getting caught.

    People have mixed opinions on this subject, most want pitty for their situation as illegal parents of citizen children but you hit it right on! Anytime you enter any country undocumented you forfit your rights on the spot. Adding children to the equation is risky in my opinion. I know the process is difficult and expensive but so is a "coyote". Great post, honest!

  6. My name is Natasha, an American born citizen. I got married in 2004 and have 2 children. My husband entered the states illegally and we couldn't find a way at the time to fix his documents at the time so we both decided to leave the country to Mexico, where he is from. After a year, I realized I couldn't raise my kids there for so many reasons so me and the girls came back. I am now trying to get him back. Finding this site has helped a lot. I contacted a lawyer who offered free advise, which Im glad I didn't send in the I130 petition with the information he gave me because it was very wrong. Any advise of filing correctly would be awesome because being a single mom of 2, my funds are very limited. Thx a bunch!

    Is the process pretty quick? I am trying to have him back with out waiting out the process seperately. How does that work, l am seeing different things online with this form. Thx

    hello hi congratulation first of all to both of you! hi,I ply for my wife the i130 form as well as the i129f, no you have to wait in tell the reply to for the i-130 form notice of 797c notice action receipt if then you will send the i129f in deferment city then they will send to you 797noice of action again for each form you apply they will send you noice that they have receive. the waiver will be send after the i130 form once for each one case. the form i-912waiver form you feel the form and send.

    I thought I read this petition can be submitted with the i130. Is there anything I can do to help him get back faster?

  8. I am petitioning my husband to come to the US. I completed form i130 and noticed i129f has to be read the same day or it will be denied. Do I need to send the forms together? Also if any wavier has to be sent, when is it appropriate to send? Is there any other forms to send at this point. Im just starting his process, he was here illegally and went back to his country to start the process the right way. Any advise, thanks.
