My fiance wrote up an affidavit for why he should be considered for a hardship wiaver

....our situation is a little different - he's still living in a refugee camp...

I don't think it would hurt to write up an affidavit - stating exactly why it's a hardship....

Yeah i see what you are saying of course and indeed your case is definitely different. I think there are many variations and none of them are wrong as each of us have a different case anyway and all we can do is pray.

I guess we can agree to disagree. For me being away from my husband for 10 months was hard as hell. Again its not defined so it will be up to the CO to decide.

Does anyone have an update if their waiver was approved? We're getting closer to our interview. I'd love to know what you put together to submit for hardship.

I don't know about the others but my interview is soon too and i wont be preparing anything for my husband. Its a CO who decides whether the applicant is qualified or not. He/ she will review the docs and ask questions. The thing is the Executive order doesnt define what is "hardship" so its hard to understand what to do.

Some people write affidavits but not sure what they put.

The thing is, rejecting a visa will be a hardship on its own coz either you are separated from your spouse or cant live in the US together.

Hope all goes well for all of us

    His interview is Jan 9th.

I'm trying to remain positive - but having a hard time trying to get any answers.

He's a refugee I met while we were volunteering together and now he's finally been placed in another country but still living in a camp for refugees in his new country.... surely there must be some waiver...Anybody know what the procedure is for requesting a waiver?

I know that you bring a waiver to an interview. My suggestion if you still can is to consult an attorney. My husband is Syrian and im in a similar situation but interview hasn't been scheduled yet

You said your interview in Jan 9. Has embassy asked you to bring waiver supporting documents? I am in a similar situation but for a CR1 case and my appointment is not set yet.

    Hello,

My husband is Syrian and we have been waiting for an interview for 7 months and nothing.

The issue is they will still process them anyway but will they issue a visa; thats a different story. I heard that in some cases they dont even consider waivers

Yes- I have heard of fathers, mothers, brothers, and even children being denied visas from Iran since the ban went into full effect. Our plan is to wait as long as we can until we get some good news, perhaps when the courts help sort his madness out.

Did you ask the embassy to extend your USCIS NOA2 expiration date? I think I will need to do that too.

Really?? See i was hopeful until i spoke to my attorney the other day. I moved back to the US 8 months ago to be domiciled from Dubai and after all this, thinking to come back as i have no clue how long this process will last. Not sure about NOA2, and if applicable coz im at the last stages.

I’m a member of many forums and from what I heard this past week, fiancés are getting denied on the spot, even though many possess waivers! It’s a really bad time to go through any interview with this ban in full effect and if I were you, I would possibly try to delay an interview as long as possible! Or at least until the Supreme Court makes their verdict.

Also, I highly recommend a good Facebook group called, IMMIGRANTS UNITED. This group has over 14,000 members, and most are also impacted by the ban and have valuable advice to share. Here is the link:

Thank you for sharing. My husband is Syrian and  we have been waiting for an interview for 7 months and nothing. Now with the ban things got ugly with the spouses too. Attorneys are also battling a battle. Its been a crazy process.

yikes - i didn't know a complaint was such a serious matter. by the way, i didn't know walk ins were possible at the US embassy (for US citizens). my friend did tell me that afternoons are only for US citizen visits but she had to take her passport collection letter with her.

You know it could just be me, overcausious. But once you come here and live here, you'll understand where you can freely complain, and where it can hurt you.

If it is a discrimination, harassment, unfair treatment...etc - its one thing. But as of right now, its no more than an inconvenience to us. Yes they are slow and we are raging, but yes they have their system and they will stick to it.

I can only speak on my behalf but imagine writing a complaint to a Homeland security about us waiting, for the Embassy., or reaching out to the Senator. Just my opinion though and im not imposing it on anyone

You know at this point 7 or 8 months is fine by me I mean we have waited 6 months already I'd wait for another month or two as long as they'll give me a freaking appointment in that period of time! Lol some ppl have been waiting much longer than us and thinking I might end up waiting more than a month or two is super scary & frustrating so nshalla our long wait will end in 2 months & hopefully less 🙏🏼

I agree with you 100%. That's the way to look at it and yes lawyers cant do anything, because its not in their hands either. We'll just have to wait longer. I mean what other options do we have.

Hey, I see why it’s so sensitive as we don’t want to risk any chance of being with our loved ones. But I think more than for myself, I feel it’s not right to Keep anyone (particularity the ones who have no other option but Abu Dhabi) apart from their families for so long due to what seems to be an unbearable work load.  I didn’t mean to retaliate, but maybe just to inform someone that the particular embassy is overloaded and some action needs to be taken about it.

But yeah I wanted to throw it out there to hear what everyone’s thoughts are because there might always be something i’m not seeing.

Oh i get it totally. I think im just overly careful plus in the past my attorney did recommend not to be very pushy. The thing is, look what's happening in the world right now, everything that has been passed on, messed us all up. Coz in the past the wait was 6 months. Although if i remember correctly one of the former VJs members called Auds did say that AD embassy is between 6-8 months, i was in denial back in May but now its making sense.

  11. 41 minutes ago, sthomas said:

oh wow, walking into the embassy is actually an option? For some reason I thought it must be some highly secured area and they would only allow you in with valid interview/appointment letters. But yeah I am totally down to go too. Maybe we can all go on the same day! lol

But I still feel a simple email to the authorities here just inquiring about abu dhabi delays MAY be helpful. But again, I think multiple email would be needed for them to give it some consideration.

But who would you email to?? I mean by now NVC does have a clue thats its been forever. If my lawyer hasn't yet i will call NVC and ask for a manager.

  12. 58 minutes ago, Suha said:

Well actually on my husbands last visit he did go lol but has been told that they haven't received my folder from NVC yet and that as soon as they receive cases they schedule appointments everyday.

so I dont really get who's fault is this delay but all I know is that it has been about 4-5 months since he last visited and asked so I guess he'd have a stronger case when he goes bk. Sooooo we shalll seeeee lol 🙏🏼🙏🏼

How does he make an appointment??? Im thinking to go this time.

  13. 4 hours ago, Suha said:

Yea true, ill see what my lawyer has to say.. I was thinking when my husband comes he goes to the embassy here and see what's going on.. so we shall see

You know, i wanted to go too last time but didnt know how can i get in. I think that might be a better option rather than trying to find someone to complain to here. I feel that even attorneys can only do this much. We are battling a system here. But like u said wait wait wait, pray pray pray

If you all are IN the USA...I am sure there has to be somebody (an Ombudsman, or customer service person) to contact there to point out the fact that this embassy is not responsive. You have a much better chance of getting action or at least answers than those of us outside the US. Maybe  your Representative's office? Your State Senator's office? For sure an immigration attorney would know whom to contact to get results. This is getting to be ridiculous.

I see what you saying but its not as easy as it seems. Firstly i won't know who to contact. Secondly, its a US embassy we are talking about, trust me they will be defending them. Lastly, legally the embassy is covered, while it does say 90 days, it states might take longer plus on travel.state.gov -the same info is given.

No one really cares about our emotions but us, sadly but true. But ill see what my attorney says.

  15. 4 minutes ago, sthomas said:

Exactly, you should’ve been next!  All I want to know is was anyone even scheduled in end of November, or at least how far  are they with this process. I mean we deserve to know at least that much!  I did find a few emails and mailing addresses we can contact regarding complaints here in the USA. Yeah i’m worried about the negative impact too, but part of me is also like.. should we be worried?  We are legal US  citizens, doing this legally just like everyone else, but yet so many more countries are getting to fly through this process. I mean the email they sent us in the CC specifically states that we should hear back within 90 days, and it’s not even staying true to that. Maybe it just needs the come into someomes attention that Abu Dhabi is short staffed...? I don’t know.  i’m just so frustrated 😞

I know honey its BS for sure. Refugees get here faster than our spouses.

Ill see what my attorney says coz yeah its crazy.
