  1. I have decided to become a citizen, but I am not sure if I can apply now. I became a Green Card holder on May 14, 2010, but I have taken two 6 month+ trips during these past 7 years. As follows:

    December 26, 2012 - September 15, 2012    (264 days)

      October 12, 2012  - September 25, 2013    (348 days)

     February 23, 2014 - July 16, 2014                (143 days)

            May 12, 2016 - August 22, 2016            (102 days)

     

    Looking at my two long absences, can I still apply for naturalization? I was outside the U.S. because I have been receiving medical care back home, and I have a proof from the doctor. I also received a re-entry permit for my second leave. I also have my taxes for the past 6 years, but my earnings are not much for 2012, and 2013 because of my absences? Please let me know what you guys think?

  2. My son and I are green card holders. This summer we traveled to my home country, and I decided to change my name and my sons name. I changed my name and they automatically changed my sons name and they gave me and my son new passports with the new names. Now I am facing some issues. First issue: How my son and I are gonna enter the U.S. since our names changed? Or do we have to keep our old passports to enter the US, and then change our names on our green cards once we are in the U.S.? Second issue: Do we have to change our names again in court in the U.S. for the I-90? I just need an advise how to do this name change without facing any problems?

  4. Short answer : no you are not eligible. As far as I can see ,

    Extended absences outside of the U.S. may disrupt an applicants continuous residence.

    Absences of more than six months but less than one year may disrupt an applicants continuous residence unless the applicant can prove otherwise, (see legal basis)

    Absences in excess of one year or more may disrupt an applicants continuous residence, (see legal basis)

    Physical Presence

    Applicants are required to show that they were:

    Physically present in the U.S. for thirty months within the five year period before applying, or (see legal basis)

    Physically present in the U.S. for eighteen months within the three year period before applying in the case of qualified spouses of U.S. citizens (see legal basis)

    If I am not eligible to apply now then when am I eligible to apply?

    Does the 4 year plus 1 day apply on my case?

    Maybe I can apply on September 2017, after 4 year and 1 day?

    If you could explain I would appreciate your help.

  5. Please help me as I want to apply for US citzenship. I have been a green card holder since May 06, 2010.

    I was sick and I couldn't come to the US. In September 2012 I came and I got a re-entry permit and I left, and I came back. So can I still apply for citizenship with two over 6 month stays? And when can I apply? Can I apply now or should I wait and apply in August 2015 to satisfy 30 month in the U.S.? Or can I apply now before 90 days?

  6. Please help me on this! I sent my and joint-sponsor’s I-864 package on Dec 17, 2013 attached Tax transcripts from IRS not form 1040 and any schedules. I received a checklist saying that please correct the following:

    In Part 6 Items 13.a.1. (I corrected it)

    You must submit the following financial evidence: [x] Proof of current employment (examples: a recently dated job letter, pay stub, or a copy of your business license).

    When I submitted the new I-864, I also sent my tax Form 1040 and also attached my Schedule D for proof of my self-employment as a Trader. Do you guys think it should be enough?

    I also recently started working at pizzeria and received my first pay stub. I was also wondering if they could check on the system and see that I am now employed and paying taxes and that’s why they asking for Proof of current employment?? Please guide me through this!

    I sent my and joint-sponsor’s I-864 package on Dec 17, 2013 and I sent my Tax transcripts from IRS. I realized that I have made a mistake on my annual income so I corrected it and sent a new one with a copy of my Form 1040 on January 7, 2014. Today I received a checklist saying that please correct the following:

    In Part 6. Sponsor's Income and Employment, please correct the following...

    [x] Items 13.a.1. The income you enter must match the total (gross) income reported on your most recent Federal

    income tax return. If you filed Form 1040EZ, use the adjusted gross income instead.

    I already did correct it and sent it, but they haven’t reviewed the new one that I sent on January 7, 2014. On the new one I put #22 of Form 1040 on Part 6, Item 13.a.1. Is that correct?

    On I-864 I put that I am self-employed as a Trader. But with the first I-864 I didn’t send the Schedule D, but with the new one I sent Schedule D attached with my Form 1040. My question is, if they review the second I-864 that I sent would they be satisfied with my proof of employment? I don’t know what to send them that shows my proof of current employment.

    I just started working as a Pizza delivery two weeks ago and received my first Pay stub. Should I just put my current employment as a pizza delivery and send my pay stub?? So then I have to change everything on I-864 and send it again since I have a joint-sponsor who meets the income requirement. Please advise me what to do next or just wait for them to review my second I-864?

    My friend is willing to be a joint sponsor. He has past three years taxes filed (2010, 2011, & 2012). He made around $35,000 which is above the poverty guidelines. But it is been 6 months he is not working there anymore because he got injured and he is getting unemployemnt from the government. Now he is working at a Pizza place, but doesn't make enough. My question is, can he be a joint sponsor since his last 3 year taxes were above poverty guidelines?

  12. I started my job at Subway two weeks ago as a Cashier and I work 60 hours per week. I make $24,00 per year. Can I go ahead and file I-864 for my spouse as I am getting my first pay check just for two weeks that I worked. My manager is willing to write me an Employment Letter, but I am not sure if the letter is on a regular paper or Subway's letterhead. Does a regular paper work as well, as it has all the contact info in it!

    I tried to find a joint-sponsor to support my family to come to the US, but whom ever I asked, they refused to do so. i am a green card holder, but I am living with my wife abroad. I am planning going to the US in the summer (July or August)to find a job and then send the AOS, I-864 package. My wife's PD is Sep 08, 2011 and it will be current by December 2013.

    My questions are:

    1) Can I delay sending the AOS package till August?

    2) Also can I pay and send the IV packtet before sending I-864 package?

    3) Do I pay another $404 for my child (he is added as a derivative to my wife's case)?

  16. Reasons for EXPEDITED Re-Entry??

    Need help on these questions: I am a LPR who has been outside the US for 8 months till I return to the US. I am planning to come back in September to the US and file I-131 for Expedited Reentry permit. I have a few questions:

    1. What are good reasons for Expidited Reentry?

    2. Is the total cost for i-131 - $445?

    3. Do I need to send two photos with the form?

    4. Is it required to include two express mails in the envelope? One should be enough i think for the appointment letter to be sent to me!
